cnn national correspondent jason carroll is in philadelphia. so, jason, how is sarah doing? >> well, she's still resting, carol, as you can imagine, after such a difficult long surgery. a surgery lasting about six hours. yesterday her parents throughout the morning and throughout the day yesterday have been by her side nonstop. waiting for her to wake up. they want to be there for her as soon as she opens her eyes to let her know what has happened to tell them in their own way what has happened to her. as you know, doctors yesterday said that they face no special challenges in resizing the lungs so it could fit into sarah. her parents basically been telling me how excited they have been when they got the news that a lung donor had become available. this has been a very traumatic time for the family throughout the past several weeks leading up to what happened yesterday. as you know, sarah had been very, very sick and that's part of the reason why the surgery took so long. she was so sick, extra special care had to be taken in her situation to make sure the transplant went of

jason carroll is there. jason, bring us up to speed. how is she, what do you know?e hearing from a family spokeswoman who sent me an e-mail before we went on the air, saying that sarah had come out of surgery, right now she's in icu, and apparently doing as well as can be expected. she's still not out of the woods yet. this was a very difficult surgery. there can be a lot of complications, but we're hearing she is doing well and is out of surgery here. just before 5:00, when 10-year-old sarah was still in surgery, i managed to get her mother to come down and speak to us, as well as her aunt, about what this whole experience has been like for them and what it's been like for their entire family. >> mostly relieved. it's been really hard, there's no good place to go from here. so mostly relief. i'm a little nervous. my baby is in that operating room. i'm trying to focus on we did it. we have lungs. and she has hope and a future. >> reporter: and her family also wanting to make the point that the real hero in all of this is the donor that made all of this possible, som

jason carroll is "outfront".is clear the way for her to get a set of adult lungs or not. >> quite possibly could. when i spoke to sarah's mother this afternoon, she was so excited. she said everyone in the hotel room was literally jumping up and down. this is a huge legal victory for sarah and other children like her. sarah's family says she definitely has a better chance of surviving. this after late this afternoon federal judge in pennsylvania ruled in favor of a ten day temporary restraining order basically telling the secretary of health and human services kathleen sebelius at least for now to allow her to be put on the adult donor list. i'll read you part of what the judge said. it says in part to immediately cease application of the under 12 rule as to sarah murnaghan so that she can be considered for receipt of donated lungs from adults based on the medical severity of her condition. sarah has late stage cystic fibrosis and for the past 18 months she's been on the donor list children not adults. her parent

i want to bring in national correspondent jason carroll. the judge is doing in this case. >> well, first, let me say from what the parents are saying when i spoke to them this afternoon, this is a huge or what could be a huge legal victory for the family. and for sarah murnaghan who has been struggling, trying to get a lung transplant. earlier today, they filed a lawsuit. let me back track. they filed a lawsuit in an attempt to get kathleen sebelius from enforcing this policy that prevents children under the age of 12 from receiving lung trance plats, being put from the children's list onto the adult list. they filed the lawsuit, and just within the past hour or so, they got the results of what the judge has said, the judge, they say, has ruled in their favor. we're still trying to get the exact language of what the judge is saying here, but i do have something to read to you here. it says federal judge michael bailson of pennsylvania has ruled in favor of a ten-day temporary restraining order, telling the secretary of health and human servi

jason carroll, he's been all over this story. jason carroll, this is a huge development. that investigators know the material is, in fact, human remains, what's the next step? >> yeah, brooke. it's the story that just keeps on giving. right now the medical examiner's office is conducting what they call an an tlo po logical investigation on the human remains. doctors will try to extract dna to help them identify who was buried beneath the home. and when. and, brooke, you remember fbi agents -- when was this, last week. that's when they began searching burke's former home in queens. it was last monday. it's now owned by his daughter. a law enforcement source says investigators are looking into a case that occurred sometime before 1996. though it is widely speculated that burke was involved in that infamous lufthansa heist back in 1 1978. in the movie "good fellas" burke kills many of those who helped him out in the heist. the reality is many of those missing crime associates are still unsolved even to this day. investigators say it should also be noted burke was also involv

cnn's jason carroll has the latest. jason?urnaghan's mother said doctors told her it was a miracle she survived two lung transplants. it got so critical doctors told the family sarah had a 50% chance of dying in the second surgery but they had a 1 in 1 million chance of surviving with the first set of transplanted lungs. her parents telling everyone who had been following the story that things went well. later that night a code blue. the donates lungs were not working. sarah's family said doctors told her she would not survive the week. she was put back on the transplant list and because she was so sick and because of the change in rules, a change that happened because of her and her family, she was approved to be listed for adult lungs. so on june 15th the second surgery took place. her mother explained why she kept the second surgery so private. >> this all happened very fast, and we weren't expecting it, and frankly we were told in those three days that she was going to die, and so it was never something that we wanted to k

rachel, you heard it in jason carroll's piece. 27 people arrested since february that are nfl players in the nfl. do you think the league has a problem? do you think the league has a problem in culture or is it something else? >> i don't think the league has an actual problem. there are 1,700 players in the nfl. if you look at the arrests since the bowl, you are talking about less than 2%. the fbi puts out statistics about the number of arrests as per the general u.s. population. that's more like 4.5%. you're not talking about guys being criminals to a greater degree. in fact, they are sort of model citizens if you're going to look at those numbers. it's the perception. it's the profile, the high profile nature of these cases and what the nfl has done to battle that is roger goodell is a law and order commissioner. he upped suspensions and increased power he has to impose suspensions before there's a conviction in the case. they have tried to clean up the image of the nfl. you're going to get in a group of nearly 2,000 people some guys who are breaking the law. it happens if you gathe

jason carroll has been all over the cases for us. ther challenge to the policy that keeps kids younger than age 12 from getting priority, i know, on the waiting list for adult lungs. brings up all kinds of issues here. so who should get priority? >> well, it really does. and just to be clear, when you listen to the parents of people like sarah murnaghan, whose daughter has cystic fibrosis, needs a lung transplant, they're not looking for a fast track. what they're basically looking for is more of an even playing field. they want a field where the sickest person has availability to these lung donations when they become available. that was not happening in the past, but now that this federal judge has stepped in and changed the policy, the so-called under 12 rule, which in the past basically prevented any child under the age of 12 years old from being put in that pool with the adults who are trying to get donations, now that under 12 rule has temporarily been suspended. that's what these parents are asking for. they're just asking for a

jason carroll joins me along with chief medical correspondent, dr. sanjay gupta. n, you have been in direct contact with sarah's family, how is she doing? >> she had a rough night last night, a rough day today and in fact, at one point, doctors thought they might have to have her intubated, where they put a tube down your throat so you can breathe a little easier. but doctors were able to stabilize her, get her heart rate down. her mother basically saying she's a tough little girl, she's a fighter and she'll have to keep fighting every single day because her condition is critical and every day is going to be a fight for her. >> sanjay, so after the ruling yesterday by this judge, sarah is now eligible for an adult lung transplant but can her body actually accept adult lungs if she were to receive them? how does that work? >> they could. the body could accept adult lungs. there's a couple things to keep in mind. you mentioned she has cystic fibrosis. that's caused by a defective gene so it will affect both lungs so she needs both lungs transplanted. sometimes people

jason carroll joins me. you're outside the hospital where sarah got out of the surgery.hat do you know about how things went? >> i can tell you her father and mother have seen her and she seems to be doing remarkably well. we're hearing she's in good condition, heavily sedated. she's still intubated. we're hearing that tube will not come out of her throat for another 48 hours or so. the surgery, anderson, lasted about six hours and we're told through a family spokesperson that doctors had no special challenges in resizing the lung to fit into sarah's chest. just before we went to air, anderson, we got a bit of a statement here from the family. i'll read it in part because it does provide a little more detail. it says sarah is in the process of getting settled in the icu and now her recovery begins. it will be a long road but we're not going for easy, we're going for possible and an organ donor has made this possible for her. obviously, she still has a long road ahead of her. there is always the risk of infection and the organ being rejected but she took a very major step

jason carroll joins me now. what does this ruling mean? is this the last roadblock for her to get a new lung? >> it may be the last legal hurdle for sarah murnaghan. but certainly she has a lot of challenges still ahead of her. first, it's this legal challenge, and now that this judge has lifted that and said, you know what, children like sarah should be put on this adult list, they should have access to adult donors, as well. in fact, let me read you part of the order here, because i think it spells out. it says, "to immediately cease application of the under 12 rule as to sarah murnaghan so that she can be considered for receipt of donated lungs from adults based on the medical severity of her condition." so anderson, a huge emotional victory for the family. although the secretary of the health and human services department points out that there are still 40 other adults who are very sick in the region. this is a six-state region, approximately, that sarah has to now compete with, with other sick adults, other sick children. approximatel

our jason carroll is joining us with more on how sarah's doing. >> her mother says she's definitely aer, that she is a tough little girl. but the reality is, suzanne, she's just not been doing well over the past few days. in fact, her mother said that last night was not good, even today she was struggling as well. her heart rate was very high. doctors were able to get her stabilized. her mother saying this morning that this is a very scary situation for them to be in. to put it in perspective, there's something called a lung allocation score, which basically measures how sick someone is with this type of condition. on a scale from zero to 100, sarah is at a 78, very sick people usually rate in the high 50s. this is the first time sarah --. if not number one, she's number two, for the reason her blood type. before this ruling, she was number 100, maybe. i mean, since we talk about a difference, we have no chance, no chance of getting lungs and the odds of sarah dying were very high. now we have a chance. and there's no guarantee, but we have a shot now. >> and the chance is what they s

. >> want to bring in jason carroll following this. it's a very, very tough spot that she is in. in all fairness to her, and this hear, this proceeding, is she doing that she possibly can? >> well, its a tough situation for sebelius. arguably it's a tougher situation for children like sarah and for that matter adults who are waiting for a lung transplant or any sort of transplant. but let's get back to, first, what happened just a few hours ago. it was just posed to be a budget hearing that sebelius was. but she faced very tough questions about whether or not the department guidelines are standing in the way of this little girl getting the medical care that she needs and needs desperately. sarah's parents say their daughter, if their daughter does not get that lung transplant she will die. could now be a matter of weeks or months for her. right now she is on the wait list for children but not the one for adults. her parents are asking that guidelines be changed so that sarah and for that matter all children in critical situations like her can then be moved to the adult list. sebe

jason carroll, or correspondent following this live from philadelphia, when i heard -- this has beenen i heard she was going into surgery and that so far a success, it's just -- it does your heart joy. do we know anything more about sarah? >> reporter: well, she's still heavily sedated and as of last night into the very early morning, she was still in icu. still intubated. but even though she was heavily sedated even before going into surgery, her mother and her aunt tell me that they still read to her every day, still talked to her hoping that she could somehow hear them, hear their well wishes in some way, shape or form. and now that the surgery is over, that six hour surgery, her mother really giving thanks to the person that made it all possible. >> do we know anything about the donor? >> they won't tell you anything. but that donor is her hero, our hero of this story. but she wouldn't have had access to that hero if it weren't for the change. this is an adult donor, lungs she wouldn't have had the opportunity to have access to just two weeks ago. >> reporter: this was a delicate
