jennifer rodgers is a cnn legal analyst. she joins us now. why would they now convene a grand jury in miami? >> well, there could be a couple things going on. it could be for convenience, there are witnesses down there who need to testify, they can do it there and then read the testimony in d.c. or as paula suggested maybe there's a couple of minor people they want to charge just with obstruction and they would do that in a separate case in miami. or they could be thinking bigger picture. this case could happen either in d.c. or florida but most of the events really did happen in florida. and so they might be thinking about charging just the obstruction part in florida and the classified document kind of substantive case in d.c. or charging the whole thing down in florida where most of the conduct took place. >> so we could see charges in both of these, you think? >> you could. it's unlikely because that would then split the prosecutorial team, it's not very efficient as far as resources go. but there's no legal reason why they couldn't try t

let's bring in former federal prosecutor and cnn legal analyst jennifer rodgers to talk about this. ation of this tape, jennifer, how much does it raise the stakes in terms of the legal liability donald trump has in this case? >> well, it's hard to say without hearing it, jake. but if it is as has been reported, it could raise it quite a bit. i mean, there are a few issues here. one is that it expands the scope of the investigation. we've been talking about documents found at mar-a-lago in 2022. now this is a conversation, had perhaps a document possessed in bed minister in new jersey in 2021. that means potentially a whole new set of charges. and those charges could be based in new jersey. so prosecutors may actually have choices here in terms of where they bring this case and they may have a whole other set of charges based on not just this document if they can figure out what document it is but of course the testimony surrounding the meeting and the document and whatever else they find in the investigation. it's also of course great evidence of knowledge and intent, which are thin

and let's bring in jennifer rodgers, a lecturer in law at columbia law school. thank you for being with us. first question here, as we talked about donald trump is going to appear on tuesday, that is typically when this indictment would have been unsealed. we got it yesterday. do you expect that that was pressure, political pressure for the indictment to be unsealed several days before? >> i wouldn't call it political pressure, victor, but what happened is they gave donald trump the chance to just keep quiet and have the document unsealed and everything come out on tuesday. he immediately started talking about the case. and so then there's no reason to keep it sealed anymore. prosecutors moved for it to be unsealed so that the public could see sooner rather than later how serious these charges are and how strong the evidence is. >> special prosecutor here says that he's going to seek a speedy trial, we know that the trial for the new york hush money case that's scheduled for next march. do you expect that this will happen before, after that scheduled trial? >> y

i have a question for you jennifer rodgers.o appear in court for the arraignment, he has to have local counsel, and somebody on the bar or can add one of his attorneys. if he is unable, and so far we know that he has not made that decision, and the decision has not been made, and if he is unable to get that attorney in florida, does the arraignment still happen, because the arrest could? >> yes, of course, it will happen, and they could waive the requirement for the day for todd blanch to appear and do the paperwork later and i would not worry about that from stopping the arraignment. >> so for all intents and purposes he has attorneys to go forward and whether or not they have the florida attorney that they are struggling to get. >> yes. that is right. >> and jennifer, it might be helpful to understand that one of the things that we have heard from one of the former president's supporters is what about this person, pence or biden, and does this theory that if in fact he did do this, it was not just me, is that is going to hold

and cnn legal analyst jennifer rodgers. great to see you. let's start with classified documents. about this campaign aide susie wildes. >> susie wildes is one of trump's closest aides. effectively running his third campaign for the white house. and a source tells cnn that she is the representative of trump's political action committee. that the special counsel alleges showed a classified map to. now this is one of the most shocking things in the indictment. that allegedly, issued a classified map to somebody who worked for his pack. now course it is shocking which are classified documents and some who doesn't have a clearance. but the other question this raised is how do they know about. this was this somebody who in his inner circle, revealed the investigators. or do they know this from somebody else? we know wildes spoke with investigators multiple times. she was asked about it. but it is not clear that she is the one who gave this information to prosecutors. we are told that the trump team, that they were blindsided by this news today. but as of now, there are no plans for her
