kpix 5's jessica flores joins us live from outside tesla's manufacturing plant in fremont. jessica. >> reporter: kenny, michelle, two consumer advocacy groups want the ftc and the dmv to crack down on tesla. they say tesla's advertising is deceptive because they say the company makes it seem as if the autopilot feature is safer than it is. they say statements from elon the vehies are capable of self-driving. now, tesla manuals say that drivers must keep their nd on the wheels and maintain control of the car even in autopilot mode. this complaint comes as tesla has been under scrutiny following a series of autopilot crashes. the latest in laguna beach where a model s ran into a police officer's car that was parked. the officer was not inside at the time. the driver of the tesla walked away with minor injuries. in march an apple engineer was killed when his model s crashed into a barrier on 101 in mountain view. the company had this to say: "tesla has always been clear that autopilot doesn't make the car impervious to all accidents." federal investigators are looking into the

as kpix 5's jessica flores explains, demanding wage increases, those workers are out there striking. ica? >> reporter: if you can hear, there is a lot of enthusiasm out here. take a look behind me. we are at uc berkeley where dozens of folks are already on the picket lines. they have been here since about 5:00 a.m., protesting for better wages, and they plan to be here through wednesday. but today they are already celebrating a victory because senator harris will not be delivering the commencement speech in support of the strike. in total, about 50,000 workers across the uc system are off the job. the union representing service workers such as custodians and cooks, wants higher wages, and they are protesting what they call gender and racial pay despairties. the nurse's union is joining the strike today. they will be on the picket lines. the service workers union called for speakers to boycott commencement so senator harris office released a statement saying "due to the on going libeer dispute, senator harris regretfully cannot attend and speak at this year's commencement ceremony." sh

kpix 5's jessica flores joins us live from fremont where board members got an earful. jessica. >>> reporter: kenny, that meeting just got out at 2:30 a.m. and this is an issue that certainly has divided the community. hundreds of folks coming out to speak on both sides about this controversial sex education program. after 10 hours in the meeting, the vote finally came down. the board made a decision. they decided to adopt the new curriculum for grades 7 through 9. they voted 3-2 against adopting the new program for grades 4 through 6. that means elementary school children will not be getting sex education this year. the controversial sex education program is known as the three r's, standing for rights, respect and responsibility. it was set to be introduced beginning in the fourth grade. parents against the curriculum say it's too graphic. it teaches about sexual orientation, gender identity and rape. but the group in support of the new sex education says it teaches acceptance because it's lgbtq-inclusive. hundreds of parents and community members filled the meeting fro

kpix 5's jessica flores reports. -- more affordable housing built in the area. jessica flores reports. >>> reporter: kenny, we're near the macarthur bart station and this will be part of the macarthur transit village project. there's actually going to be a major high-rise right here in this empty parking lot. it's eight acres here and that's going to be the site of a luxury apartment building. now, the building has about 400 unions in it. -- 400 units in it. the bottom floor will be businesses. the 24-story tower is 260 feet high, three times taller than any other structure around the station. this particular area is zoned for just 90-foot buildings. city council approved the project last year, made on exception for the developer after the developer agreed to reserve about 10% of the units for affordable housing. now, this project is all about that bigger effort we have been talking about, bart's plan to bring more affordable housing near transit centers. and later today, city officials will be here for the groundbreak at 10 a.m. jessica flores, kpix 5. >>> bart

jessica flores reports. >> reporter: the scene is quiet and clear now. but it was an intense situation yesterday. this whole area on lockdown. we now know that gunman shot two people, then turned the gun on himself. he is dead. so is one of the victims. now, sheriff's department declared this an active shooter situation yesterday afternoon. they were searching for the gunman. tactical teams surrounded the apartment building sending residents running. we now know the shooter was an 80-year-old man. neighbors say the victims are the apartment owner and his daughter. the woman died at the hospital. >> first deputies on scene grabbed the two victims, carried them out of the scene to waiting ambulances. >> reporter: about 90 minutes after the initial reports of the shooting, a tactical teams broke down an apartment door and threw a flash-bang inside before rushing in and that's where they found the dead man. the 80-year-old man was discovered. we are waiting for identification of the people. the victims were the apartment's owner and daughter, according to th

kpix 5's jessica flores joins us live from san leandro with more on the latest crime stats. ssica. >> reporter: yeah. when you talk about certain types of crime categories, like robberies and violent crimes, those are going down. but aggravated assaults are going up and the new statistics don't reveal what many riders see as the biggest problem at stations and trains, drug use at bart stations. we have seen a lot of pictures and videos over the last couple of weeks. this one from concord showing what appears to be a man shooting up in an elevator. riders have also been sharing videos of drug users taking over a station corridor at the civic center station in san francisco. now, bart police chief carlos rojas reports property crime is down 2% year to year, robberies down 9%. but aggravated assaults at bart stations and on trains are up 26%. there were 34 last year. this year, 43. still, bart police insist that crime rate is lower this year than it was a year ago. but the pictures of rampant drug use at stations tell a different story. >> what you have is you have a moment in t

jessica flores reports. >> reporter: fremont already does this. we are in front of a new build right now that will have solar panels for new homes and new low-rise apartments. well, california may be following fremont's footsteps with their own requirements. today, state regulators are meeting and they are expected to approve a set of rules that will require new homes and low- rise apartments built after january 2020 to have solar panels. the california energy commission is to reduce greenhouse gases and could save homeowners on energy costs in the long run. the commission says the money saved on energy would total $16,000 but you have to stay in your home for 30 years to see savings. and it will cost homeowners about $10,000 more up front. >> it's one of the few things you can invest in, in a home that actually you recoup. >> reporter: now, this does also apply to multi-family homes. those are three stories or less. now, new regulations must be approved by a california building standards commission so it's not automatic. if it were to be approved

jessica flores joins us live with more. >> reporter: this is certainly a disturbing case. a mother of 10 children will now face new felony counts. prosecutors are charging her with nine felony counts of child abuse. they say she put her children in conditions that could cause great bodily harm, even death. she and her husband are accused of keeping their children in an abusive filthy home. voters say allen tortured the children and caused cruel and extreme pain and suffering for a sadistic purpose. the children are a baby to 12 and have burns and bruises consistent with being shot by a pellet gun according to prosecutors. the couple they denied these allegations and allen actually defended himself in a jailhouse interview yesterday. >> i didn't do what they said i did. we have a normal life. but i gave my everything to these children. my everything. >> my mom is just calling the police here and there and making all these allegations. but they didn't -- they didn't even give us a fair chance. >> reporter: those children are actually with the grandmother in her custody. the

kpix 5's jessica flores reports. >>> reporter: michelle, we are talking about bart again and another possible controversial vote that bart has to do today. they are meeting later today at 4 p.m. the board of directors is meeting. this could be built here. that extension would take bart all the way into livermore. this proposed extension would go five miles down 580. it would cost about $1.6 billion. about $1 billion they actually don't have. so they would need to figure out how to get it. opponents say it would mean more taxes to build an extension. supporters argue that livermore has been paying taxes to bart and is entitled to a station. now, the alternative and less expensive plan would be to have an express bus running from livermore to the dublin- pleasanton station. that plan is estimated to cost $380 million. the bart board of directors has to vote on an alternative by the end of june. this is still a long ways away from anything being a reality. it's estimated that even if the livermore extension were approved, it would be two decades before we saw it come to life. in livermo

jessica flores reports. >> reporter: hey, good morning. that's right. it's "bike to work" day and to encourage folks to get on their bike and ditch their vehicles, caltrans is launching a pilot program today that has the bay bridge bike trail that goes over the bridge to the yerba buena island open around the clock for the next 10 days. typically, it's only open from 6 a.m. to 9 p.m. so this will allow folks to use the bike path at any time they want for the next week and a half. now, this is all of course encouraging folks to ditch their cars and choose bikes instead. but the bike path only goes to yerba buena island so folks will need to get on a bus from there to get into the city. we spoke to transportation officials about what the future holds for the bay bridge bike path. >> it's the dream for the bike path. >> the dream for the bike path is to go ahead and connect it to the western span and bring a new western span bike path into san francisco. >> reporter: the whole goal here is to reduce traffic. the pilot program lasts until may 19th. so you c

kpix 5's jessica flores joins us live from oakland with more on a pilot program. jessica?reporter: hey, good morning, michelle. one path a lot of folks will be taking today is the bay bridge bike path. that is actually going to be open around the clock for the next 10 days. now, typically, it's only open from 6 a.m. to 9 p.m. but this is all part of that pilot program from caltrans. they are going to be opening up the bay bridge so folks can bike to work. you can only go to yerba buena island and then bus from there to get into the city. this is a ritual for a lot of folks. they take this path to yerba buena island and then go onto the city. we talked to dozens of people last year who took part in "bike to work" day. >> it's much better than it used to be with bike lanes and bike ways. it's gotten better. >> reporter: "bike to work" day and the bay area bike path are part of the bay area city's push to get cars off the roads. caltrans plans to eventually extend the path all the way to san francisco but that's still years away. now, the whole pilot program for the next 10 d

kpix 5's jessica flores reports. she reports from livermore. >>> reporter: michelle, we are talking about bart again and another possible controversial vote that bart has to do today. they are meeting later today at 4 p.m. the board of directors is meeting. this could be built here. that extension would take bart all the way into livermore. this proposed extension would go five miles down 580. it would cost about $1.6 billion. about $1 billion they actually don't have. so they would need to figure out how to get it. opponents say it would mean more taxes to build an extension. supporters argue that livermore has been paying taxes to bart and is entitled to a station. now, the alternative and less expensive plan would be to have an express bus running from livermore to the dublin- pleasanton station. that plan is estimated to cost $380 million. one would involve light rail. the bart board of directors has to vote on an alternative by the end of june. this is still a long ways away from anything being a reality. it's e

jessica flores reports. >> reporter: good afternoon. the couple -- it's a couple, man and woman, they are co- defendants in this case. take a look at their mugshots. 19-year-old daniel gross and 25-year-old melissa leonardo, they are accused of stabbing 19-year-old lizette cuesta and leaving her on the side of a remote road in livermore. that was back in february. now, we did today hear from melissa leonardo. she pleaded not guilty. we still have not heard from daniel gross but his lawyer does tell the judge that he is expected to enter a guilty plea. a driver found cuesta just off tesla road back in february. investigators believe she was able to crawl 100 yards on her stomach before being found. she was airlifted to eden medical center, barely alive. now, the alameda county sheriff's office says before she died, she made a dying declaration that led investigators to the suspects. we were inside the courtroom all morning, and i can tell you it was a little unusual, there was an emotional outburst from the galley as melissa leonardo ent

move along 80 near crockett after a big rig burst into flames just a few hours ago. >> kpix 5's jessica flores is live near the scene with the very latest. jessica. >> reporter: kenny, michelle, last time you guys checked in with me, sorry, kenny, anne, last time you checked in with me i was farther back but now we are closer to the crash. you can see it behind me. this is the big rig. it's burned-out. right now they are trying to figure out how to tow it away and there is one lane open getting on the carquinez bridge. but you can see why the backup -- why we have such a backup here, because this burned-out cab and the back of the truck is blocking a lane as crews try to figure out how to clear it. this serious crash also caused another crash. that happened in the backup. so two crashes are causing delays. here's video one posted from twitter showing flames engulfing a truck. you can see that carquinez bridge in the background there and the person taking the video actually says that the fire is getting hotter. it's unclear if anyone was inside the big rig when the fire started. meanwhile, cars

kpix 5 jessica flores is live outside the family's home with the latest. jess can? >> i have to say, this is a nice neighborhood. from the outside, you can't tell anything was possibly going wrong inside the home. inside the home behind me, investigators say these children were tortured and living in squalor. now, the father, he's facing felony torture charges, and those kids are in cps custody a. strange twist, as a mother actually let us inside the home. our photographer saw unsafe conditions. investigators say ten children, between the ages of four months old and 11-career- old were living in there. the mother says one of the -- says her ten children slept in one room, and they used another bedroom as a play room. she claims police gathered the clothes, toys, and furniture around the house when they executeed the search warrant on friday. but we also saw what appeared double feces on the floor in one of the upstairs bath reels. police say 29-year-old jonathan allen tortured ten children, leaving them bruised and burned. rogers adamantly denies any of her children

i'm jessica flores. >>> we are getting a look at an independent audit at san jose's use of force cases and police involved shootings. sandra osborn is live outside the police department in the very latest. >> reporter: this is a routine audit that takes place every year at 1993. just like last year one of the recommendations is being transparent. the use of body cameras throughout the 2017 calendar year did give auditors and the police chief a better look. with the use of body cameras, fewer people are filing complaints against san jose police officers. a greater share of those cases ended with officer discipline. according to the audit in the past five years they disciplined officers in 145 cases of alleged misconduct. penalties were from counseling training to suspension and termination. when it comes to police shootings were there eight officer involved shootings in 2017. of the eight last year half why fatal. half why listed in the audit as involving persons of color. also important to note the audit listed some short staffing i want to get some of these details from you. it's from
