this time it concerns obamacare and a dramatic blow by a federal appeals court aimed at health care tax credits. joe johnsin this to us. >> well, carol, this could be a huge blow to the administration and to obamacare and in a 2-to-1 ruling, a divided court just ruled that federal tax subsidies under the affordable care act cannot be used by consumers in federally run exchanges. can only be used through the state exchanges. it could potentially affect your life in a big way. the question is whether the tax credits could be given to people who got their insurance under the affordable care act under federally run exchanges. the law was set up to get people to the state exchanges, nobody thought there was so much resistance to obamacare as we've all seen. 34 states have decided not to set up their own market places, leaving up to the feds. the twist now, the law doesn't expressly say the people who get their health care through the federal exchanges. >> what will happen? will their premiums shoot up? >> the court has said that this is potentially a big blow for those individuals, but before anybody starts hy

indra petersons is in kill devil hills, and we're in the cnn weather center. let's go first to joe johns. he is in nags head north carolina. joe? >> reporter: this picture sort of illustrates what we're up against here on the outer banks. this is water that has come in off of roanoke sound and spilled onto a parking lot. it hasn't made it to the road. in fact, it started receding as we've been here. nonetheless, there are big problems. many buildings sitting out on the sound have septic tanks. there's concerns about those tanks being compromised. so i don't want to walk around in this water too much, but i can tell you it's about 8 to 9 feet deep at its deepest point. the biggest problems of course if you remember der down the road here in the hatteras island area. hatteras island is still cut off from the rest of the outer banks. that's because authorities are trying to assess what's happening on the roads. there's a road and a bridge called the bonner bridge. that bridge has had structural concerns before and they're trying to assess with engineers whether it's safe for people to trave
