effects we took action and adapted the ordinance the ordinance requires cleaner construction equipment already and is enforced by different contracting public works agencies the heart of the ordinance relate relates to either a engine or verified emission strategy the acronym the epa and california resources started to reblth the amount of regulations from the 190's this chart illustrates there are four tier levels the equipment becomes cleaner and the standards stricker i want to highlight tier two the existing ordinance this is applied to new engines on not applying to existing equipment but cleaner i was mentioning for this only applies to new engines and existing equipment there's a regulation that went into effect just last year i'm going i'm not sure e i'm sorry 2013 companies will closely clean up their equipment's one of the ways through the verified emission control strategy it is a filter you can put on the existing engine to reduce the matter especially further so if you look at the orange and you have a tier two engines a new engine and in 2004 let's say and you put a filter on it that reduce the matter emissions tiring percent beyond the tier 2 engine and how this relates to ceqa it subsequent to page of the ordinances in 2007 in the bay area management district released new guidance are documented the harmful health effects from the air pollution month jurisdictions in san francisco claremont the air quality with ceqa this required the construction projects in san francisco the hire consultant to have a costly modeling it requires the pub funded projects beyond the construction ordinance this requirement was often imposed on projects subsequent to ceqa when you have a mitigates project under ceqa the projects will not be otherwise exempt this arrow if you have an project that is exempt and have a mitigation you have to do a 3450ig9sd eir the planning and dpw created a map i'm going to talk about it we talked about that for article 38 essentially for construction if you're project is locked in the zones your subject to a ceqa mitigation measure as an example the planning department currently is reviewing for ceqa public projects foreclosure a health clinic in the bay area they'll be exempt from ceqa with you it's in the exposure zone tlofrs it is subject to cost and time and in order to understand the ceqa the planning department has identified the mitigation measures that was done in outreach this chart here is actually brand new data i got from the california air resources board we originally did research in 2012 but this year chart shows essentially new engines become available as the economy picked up so when the recession hit not a lot of new engines we get the question why are we not requiring the tier 4 engines the reason we don't think it's feasible because the tier 4 engine are not wildly available shown in light pie chart that document 20 to 15 percent of the engines in the state for the tier four if you require tier 2 it's 60 percent and by requiring that verified diesels emotion our that equivalent to a tier 4 engine the real changes i've described as for ceqa outside the air pleasant our subject to the existing requirements and inside the x portion you're a tier two engine and administrative review control strategy there's a monitoring plan associated that this i'll briefly cover so first and foremost this is a health protective ordinance between the emissions reductions compared to a engine that has not emission standard or flexibility through ceqa the mitigation measures is not required but required for city regulation for example the earlier health clinic can precede with the mitigation and it allows for a greater ability to monitor for compliance the state has a regulation that requires all construction equipment to have a 6 character red sticker on both sides of the equipment and a members of the public or someone if the city agency can written down the number and go online and see whatever it's tier one or four so the planning department courageous you to adopt the update i'm happy to answer any questions you may have. >> thank you very much for if presentation violations are nothing go to the happen in the first time and two there are complaints you know what are the resources the city has to insure that the contractors are compliant. the court: again, i support everything this is in here we have a number of ordinances on the boxes our residents have a right to call our office and complain about and we have the resources to properly takeover of that. are going to be subject to accident ordinance and dunn done education that question has come up with every individual agency we develop in doing this outreach is sort of a template for a plan the ordinance tukdz about the construction emissions plan and we developed basically an "x" sell spreadsheet and the contractors can fill out and maintain through the construction the hope the owners passes we continue our educational efforts with each of the individuals agency because some individual agencies have been subject to this through ceqa and they've had some similar questions of how are they going to monitor right now the planning department is monitoring it through ceqa and we're trying to educate them on this so in terms of resources i don't really each year additional resources from the city agrees more of a educational understanding of the requirement in terms of compliance yeah. - in terms of inclines it is subject to each individual agency and actually drawing a blank on what the ordinance specifically says in terms of in if a incarcerating is in compliance with the plan i believe it says they could subject to no longer having the contracts you know. >> okay. so sorry california for a waiver from that particular requirement i would have to relook at what the ordinance legislation says and excuse me. the legislation digest has a quarterly reporting so the public has john mccain, senator john mccain has been in touch with the mueller family -- >> he has been -- >> constituents with joe donnelly talked with the family through the entire episode. both senators working with the white house and families discussed these special operations forces possibilities. they were involved and i know senator mccain as he told me this personally was in favor of these rescue missions. this particular one where they didn't find them sometimes the intelligence doesn't work out and in other cases people are tipped off and odd set of circumstances. it's very high risk. the president has been dedicated. we saw this and one of the interesting things when kayla mueller's name was first put out two weeks ago accidentally by dennis mcdonough on a sunday morning talk show and there was a great deal of worry that would cause damage for her and all of the networks walked that back to keep it away. it was indicative that the president of the united states and staff had her mind at the tip of their thoughts and were able to reveal that. >> well actually reminds me of how -- how much the reagan white house focused on the hostages in beirut. >> i think the bigger thing -- >> a continual problem for the commander in chief. there's been some confusion, clearly this letter now shows us what was in the mueller family's mind because she says i'm being treated well and i'm actually getting food. i've gained weight. she suggests that she doesn't want any extraordinary efforts to find her. so that feeds into the whole question of whether they didn't want the rescue mission -- they denied that yesterday. i don't know if there's anything we know about that. >> i think that there are various people who have been directly in touch with the mueller family through the different stages. i know some of them and can't -- it would be remiss for me to reveal what they said. that said i think the mueller family, from what i know has been incredibly resilient through this process and had confidence at the end of the day that the various pieces of this effort to get her out would succeed and they were incredibly resilient. this is a broader example for the whole country. this kind of practice that we've seen, this horrific practice is not going away. we will have other americans kidnapped and held for ransom and killed. we need to talk about how we begin dealing with this not in perhaps a systemic way is probably the wrong word but this is the tip of the iceberg of what may be coming given our experiences with isis. i think the mueller family gave an incredible strength and confidence through this we should learn lessons from. >> coming up next more power as the president prepares to ask congress to authorize the war already against isis. but for how long? john boehner. let's talk about this with cnn chief congressional correspondent dana bash and gloria borger. welcome to both of you. >> thanks carol. >> thanks for being here. dana really john boehner suggesting funding dhs for only three weeks and it probably won't pass anyway in the house? >> he's suggesting it and not just suggesting it they'll do that later this afternoon. we think it probably will pass but not with the help of democrats. let's start with what's going to happen this hour in the senate. in the senate we're finally going to have a vote on a bill to fully fund the department of homeland security through the end of the fiscal year just as the white house wanted and democrats have been asking for. this is because republicans gave in. they realize they don't have votes to do anything else here's the but. the house isn't going to take it up. they won't vote on it because they do not agree with voting on anything that doesn't also block the president's immigration plan. the one that allows millions of undocumented workers to stay here in this country illegally. what they're going to do is kick the can down the road. in the short-term it's good news. the department of homeland security probably will not be shutdown. in the long-term, talking three weeks from now, we'll be sitting here having the same conversation. so glory, mitch mcconnell bit the bullet and did what was best for the country, right? he showed strong leadership. why can't house speaker john boehner do the same? >> i think john boehner is actually asking himself the same question carol. he's got lots of republicans over there who say hell no. they don't want anything to do with a vote that would look like they were giving assent in any way, shape or form to immigration. i think the only reason -- i was told this by a senior house democrat yesterday. the only reason that some republicans who are conservative and hate the president's immigration plan could potentially vote for this is that they don't want the department of homeland security to shut down when you have netanyahu coming here next week to give a speech on isis. how would that look? and there are some republicans and dana knows in better than anyone who understand that the public will blame them. our own cnn polling shows that 53% of americans would blame the republicans in congress if the dhs were to shut down and only 30% would blame the president. they understand the optics of this looks really bad for them.

john donaldson has the actual timing here. you say between june and september the fed will raise rates, john, correct? >> they have been giving -- yes. they have been giving strong signals, both governors and regional fed presidents have been remarkably in unison giving winks and nods if not absolute hints this is coming. the timing is data dependent. chairman yellen has been very adamant in all of her testimony and notes from the meetings about that point. i think the, issue that is in front of them right now, is while they have reinforced that data dependency, they have also stuck a calendar reference in the form of patience which everybody interprets to mean at least two more meet frogs now. they really need to get that calendar reference out there. they don't want to be stuck by what the calendar says, rather than what the economic data says. liz: let me give you a little breaking news here. loretta meister of the cleveland federal reserve in the last 30 minutes, that a rate hike this year, is quote a very viable option, very viable option. i bring it to michael binger now. does that affect the way you investing for your client at all? >> no, i don't think so. if the economy is strong enough it warrants a rate hike i'm fine with. that i think it will be more towards the third quarter or fourth quarter. i don't think it will be sooner. but you know stocks are now up 2% for the year. that is better than down three, right? i mean people, you know, people are optimistic on europe. oil recovered, seems like some kind of a bottom in there. that brought commodity stocks up. apple has just been a monster and that really drives indexes because it is such a big component. we're sticking to our zero to 5% forecast. flattish year for stocks. nothing too bad or nothing too great. liz: is june too late? loretta is saying june at federal reserve. that might shock the market especially with people like warren buffett here seeing i don't see how they pull that off? they kept saying it will be in 2015 and now they're kind of stuck doing that, or, jeff, can we actually stand on our own two feet if we raise rates by nano inch? it is ridiculous we could handle it, right? >> right. zero fed funds rate is hedge level for the overnight rate and given what we've seen in the last 12 months for the u.s. labor market in particular, over three million jobs added, i think absolutely the u.s. economy can stand on its own two feet. the big question, liz, we've had, will they really hike with inflation as low as it is? we're at about 1.4% year-over-year on their favorite, their key gauge of inflation, the core pce. we think that could hang out below 1.5% throughout the year. do they really hike, absent sort of inflation pressure? that is the really key question. liz: i'm not sure anybody really knows but that brings us right to this, john donaldson. are you bearish, are you neutral or are you bullish right now? let's make people some money here. >> i think in terms of rates we're certainly conservative to being bearish. we do think rates will end up being a little higher. 10-year treasury is at 2.05. could it have a trade some point during the year, back toward 2.70, 2.75, something like that? we think that is possible. maybe concept of a growth scare, where all of sudden people say gee, the could machine my is doing better than people expect, i think jeff hit one of the best nails right on the head, is framing this conversation in the right reference because we are at zero rates and a lot of the people who are more strident on the fact that the fed can not raise rates talk at though we're at mid-cycle rates and we're actually ratcheting toward a tightening. we're just taking off the emergency zero and, you know, the question becomes, is the economy in a position where the rates deserve to be at zero? we think no, it h
