john durham's appointment of special counsel, his investigation of the russia dossier began with a lot of high hopes for attorney general bill barr, present trump, what happened here? >> well, anderson, it started falling off the rails almost immediately, as this case went to trial. it's a weeklong trial. eager denture was charged with five counts of lying to the fbi last week. the judge threw out one of those counts. and during the trial, almost immediately, durham himself went after some of his own witnesses after they delivered testimony that was helpful to dan zhengzhou. so, it was frankly not a surprise when we saw the jury come back and say that he was acquitted on all four remaining counts. in the, and obviously this was a case where the jury did just not believe that danchenko lied to the fbi. >> and durham is now taking two cases to trial. both have ended in acquittals. is there anything left of his investigation? >> well, he's dropping off his investigation we expect that after the midterms, we are going to see a final report from john durham. by the way, as you pointed out,

i'm not sure what happened, why john durham can't get anyone to indict someone in this case.n your show, back in may, to talk about the acquittal of michael sussmann. we've seen the a acquittals of michael sussmann and igor danchenko, the near probation of kevin clinesmith, a relatively low level fbi attorney, that happened about two years ago or so, august of 2020 if i have the date correct. at this point it appears that john durham probably doesn't necessarily have any more aces up his sleeve. i would like to be proven wrong. my best read on the situation and it is a very unfortunate one is at this point, at this point the best remedy that we can hope for to actually see justice is not going to happen legally. it's going to have to happen politically. john durham, if you look at his statements on monday, he said, quote, the fbi mishandled this case. he said his special counsel team was not there to defend the fbi's handling of the steele dossier so it seems that durham is teeing up his final report to kind of nudge congress to make some political reforms. it's kind of anil

john durham said the elephant in the room is the fbi. trace? >> trace: thanks, david.news warrants. let's bring in andy mccarthy, former federal prosecutor and national review contributing editor. he's also a fox news contributor. andy, great to see you. david spunt set up the question for you. the elephant in the room, the fbi is the elephant in the room. is that the theme of this trial? >> yeah, it's almost like the trial is secondary in the chase of the trial of danchenko. what is really important and this is in terms of the public interest as much as anything else was the performance of the fbi and what the trial has laid bear is the fact that the fbi relied on preposterous information under oath time after time after time going back to the fisa court. their own regulations as well as federal law require that information is supposed to be verified before you go to the fisa course. they don't bother to interview danchenko until they went to the fisa court. when danchenko told them in january 2017 that the information that they hadn't been able to corroborate to that

john durham will issue a final report at some point soon. from the jury and what would you expect in the final report? >> well i was disappointed, obviously. i think they did a good job prosecuting the case. their ability to put evidence on in a very difficult case was limited by some rulings. they weren't able to get access to some witnesses overseas. it was a tough case. this should show people that it is hard to win these cases and sometimes it takes time to achieve justice. but as people say, i think, andy mccarthy said, the real public interest here was being served by exposing the full extent of the corruption that was involved in the russia gate and the abuse by the f.b.i. in that whole episode. and i think durham is going to get a report out that will lay out all the facts. >> dana: it could come before -- if republicans take over at least in the house and maybe even in the senate there could be hearings that ask the f.b.i. to come and explain themselves? >> right. i think it will leave a very good foundation for pursuing it further

also, another courtroom defeat for special counsel john durham whose investigation of the russian probe would once reveal corruption on a level never seen before in our country, end quote. so far it has not done that. the investigation began with a lot of high hopes for attorney general bill barr, president trump. what happened t here? >> it started falling off the wheels almost immediately. he was charged with five counts of lying to the fbi last week. the judge threw out one of those counts and during the trial, almost immediately, durham himself went after some of his own witnesses after they delivered testimony that was helpful to him. it was not a surprise when we saw the jury come back and said that he was acquitted on all four remaining counts. this was a case where the jury just did not believe that danchenko lied to the fbi. >> and durham has taken two cases to trial. both ended in acquittals. is there anything left of his investigation. >> well, he's wrapping up his investigation and we expect that after the midterms we're going to see a final report from john durham and by th

this trial is in many ways the culmination of more than three years of work for special counsel john durhampointed by then-attorney general with bill barr in 019 to look at origins of the russia investigation. when it was announced late yesterday afternoon in court in northern virginia that the judge was going to allow out one of five charges, john durham and his team clearly were not happy. as you mentioned, the defendant in this case, igor danchenko. he still, though, does face four counts of lying to the fbi after the judge removed that first count over a technicality. danchenko is the man the government says was the primary subsource for ex-british spy christopher steele who filed that infamous dossier. durham alleged that danchenko lied to an fbi agent when he said he hadn't, quote, talked to a democratic political operative named charles dolan about the zeal dossier. dolan gave danchenko information that ended up in the dossier, but the two communicated via e-mail. technically, they didn't talk. the judge threw out that one charge. dolan, a witness in this case who's not on trial, has
