john miller joins us now to discuss.ays last year saw more cops killed intentionally in the line of due to since 9/11. what's going on? >> well, that has been the subject of a lot of debate and questioning within law enforcement and even the fbi. i mean, if you look at 293 in 2019, 312 cops shot and/or killed in 2020, 346 in '21, that you see number climbing each year. i mean, this year would be up a high percentage if the numbers stay on track as we pass 252. the fbi did a study on this in 2017 and the conditions then after the ferguson shooting of michael brown and other incidents, eric garner in new york city created atmospherics that really made them look at who is behind the police shootings and what are the motivates. w 86% of people who have shot at police have prior criminal records. 56% of them were known to the police department. now, that is more interesting than it sounds because it means that agency arrested them before and largely their experience was they hadn't resisted. 60% of them have long histories of

but i'm going to start with john miller. john, you have been analyzing the secret service documents that were handed over to the january 6th committee showing that people in law enforcement knew about, were discussing the capitol threats ahead of the attacks. and i'm wondering, given all of your background in law enforcement, what questions do you have now after reviewing those documents? >> well, the secret service documents and the secret service turned over just a -- around a million documents to the january 6th committee, i've got through a lot of the threat reporting that was included in that and, you know, it tells us a few things, pam. number one, there was plenty of intelligence. there are documents that show that there's an fbi command post at the washington field office that is doing, you know, briefings every few hours and they're going over reports coming from around the country. so you have information that there are quick-reaction forces that are supposed to be stationed in the virginia in case they're called up

i want to turn to cnn's john miller and abby phillip. and john, you've got remarkable new details about how police got word that something was happening. >> so this starts to unfold at some point in the early morning hours, when the defendant, who is charged here, gets in the house, and encounters mr. pelosi and mr. pelosi can tell, this guy is unhinged, this is going bad. so how he gets on his cell phone and dials 911 surreptitiously and he leaves that line open. it may be in his pocket, may be on the table. but at that point, hearthther grimes, an emergency dispatcher -- this happens all the time, there's no voice on the other owned of it, sometimes you disconnect, but she's sensing something, there's a conversation going on in the background, she's sensing something isn't right, so she listens in, turns up the volume and paul ploelosi is basically trying to tell her in code what's going on. why are you here? what are you going to do to me? you can imagine how he's trying to not let the attacker know that 911 is listening. so she puts o

i've got john miller with me now as well. tion. so this is also in the context of what, 40 odd cover sheets that they did find, which were marked classified in some sense that had nothing behind them. >> right. so you have to ask, there are these folders. they're marked at very high classification levels. so where are the documents that belong in them? are they there? are they somewhere else? it would be very odd to take the folders without the documents. >> and it also seems then in that case, and now we know trump himself from some of the reporting did go and pick the documents he wanted. those documents were specifically separated from their classification and put somewhere. >> so if this was a normal criminal case with a normal criminal search, and we've had other cases related to trump investigations where this has been done, you would search the house. you would search the club. you would search the office. you would search the new york apartment. you would search everywhere these things could be. in this case, they were

. >> joining me intelligence analyst john miller. john, you're a former member of the nypd, so you know of what you speak when it comes to this debate. as was noted, crimes in new york are on the rise. how much does a governor's political position affect the crime rates in the city? >> well, it can affect it a lot. i mean, kathy hochul is talking about stronger gun control laws and assault weapons. but the vast majority of new york state and especially new york city's crime is committed with handguns. so the issue there is are people really going to jail? and i think, you know, i think what we learned from the candidates last night is, you know, kathy hochul wants president biden to run again. she's pro-choice. she's looking for stronger gun control laws. lee zeldin told us he likes donald trump. he is pro-gun rights. and pro-choice. or, rather, anti-abortion. so, they played the type. but crime is the thing that kept creeping back into this. and the core of it was, two things. one. the zeldin camp saying he would reverse the complex

. >>> joining us now, cnn chief law enforcement and intelligence analyst john miller. john, this detail about the zip ties and the duct tape, tell us what about the worst-case scenario this could have been. >> well, it tells us a little bit about the offender. this was very high-risk behavior, showing up with a hammer and no real getaway plan. but bringing duct tape and zip ties means he was going to go into a situation where he needed to control the people on the set which would have been mr. pelosi and mrs. pelosi who i believe he thought was either home or coming home into some kind of hostage situation. if you're just there to kill them, you don't need to tie them up. >> if we are -- at this point in time we're waiting to see if federal charges will be filed. do you think they're likely? >> i think that title 18 section 115b comes with a 30-year sentence, a $250,000 fine. it's all about attacking a federal official or a member of a federal official's family to intimidate them or keep them from doing their jobs. so i would consider it likely. however, i think there w

john miller. >> john, thanks. good to see you, what is going on here?e releasing the surveillance video. person of interest. and the six homicides. saying that they have seen this person on multiple videos, related to several of the shooting incidents. so what do you think? what can you tell us? >> well we've got a guy who did two shootings, one in oakland, 70 miles away. 400 days ago. and then one 6 days later. and then he goes quiet for more than a year. and then he starts doing another shooting and homicide basically every couple of weeks. so where did he go for that year? and what made him return to killing and pick up that pace? so they are going to be looking for that. and you know, the matches they are making are ballistic matches. so is it possible that there is more than one person yet? yet possible. is it likely? based on the history and offender characteristics? no. you've got a hungry serial killer out there who is probably on the prow more often than not. and who only strikes when they conditions are as he chooses. which is desolate areas,

john miller sitting with me. your reaction and what played out?of the strange experience of the trial with him representing himself and the judge's struggle to maintain a fair trial but stay within the parameters of what's allowed but the key question as he said, what it hinged on, was it intentional or could you buy his story this was an accident? you know, when you get to the videos of that day and interview the witnesses and police he broke through the barricades at 40 miles an hour and continued down the parade route weaving from side to side not to avoid pedestrians who were scattering but as it appears to actually target them. when this happened, i was in the new york police department. we assumed this was going to be one of those terrorist attacks, but when you peel back the layers of this defendant, what you don't see is an isis adheerpts, somebody with an extensive criminal record out on a thousand dollars bail after being charged battery, domestic violence, resisting arrests and bail jumping. so he was released on a thousand dollars bail

back with me now to discuss, we have john miller, heiress competent, and catherine rampell. ogressive cities like san francisco in portland, oregon, we're in hotbeds of crime right now. that's not true? >> i think it is true. if you look at the places that have the most progressive district attorneys, philadelphia, chicago, los angeles, violence is off the hook in philadelphia. off the hook in chicago. but i also think that the studies are missing something. one, when you go by percentages, and we don't see the wrong numbers, you can't tell if crime was 60% higher in the city because they had ten murders that year and it went up by a small number -- >> are you saying you reject the premise? that you do think the places with progressive leaders are more crime infested? because that other study about the red states, where donald trump won, i think we have a cdc map, of the ten states, where the crime, no, where murder is the highest are red states where there is not progressives in charge. >> i think that if you look at who did the studies and how the studies were done, they ha

let's dig deeper with cnn chief law enforcement and intelligence analyst john miller. r deputy commissioner of intelligence and counter terrorism for the new york city police department. john, thanks very much for joining us, as you know on monday, russian hackers targeted u.s. airport websites. how worried are american officials right now about an escalation? >> well, very worried. as you see, the control of this war slipping from vladimir putin's grip, you're going to be watching him look for alternative means of applying pain to nato countries in the u.s. so when you look at the blowing up of the bridge and then almost immediately following that a hacker attack against u.s. airports by the group called kill net, you're seeing some of that reaction. that was fairly unsophisticated by kill net is a group that's targeted the major airports across u.s. cities, they have hit ukraine, moldova, italy and in august attacked lockheed martin claiming to get into employee information but we're still analyzing the evidence they put out on the internet. >> as you point out, john,

i want to bring in john miller. it sometimes happens, what could that mean? mean is when there's going to be a major event, demonstrations, marches from the nypd perspective, when i ran the intelligence bureau, we reached out to the group what's your plans for that day, and the secret service jgenera, there's an intelligence division that does the same thing. you'd be surprised you get the groups on the phone and they hang up on you. some groups say, this is where we're starting from, this is where we're going. great to be working with you. it's entirely possible that's what that phone call is about. the witness only heard one side of the phone call from the guy who was on the phone, zimmerman, who said it was somebody from the secret service. so we have to know more there. >> we certainly do, john. also thursday a member of the proud boys pleaded guilty to sedition. he's the first member of the group to do so. he's also cooperating with doj. how might that impact the investigation? >> in a big way. you have a trial coming up where he is one of the defendants

. >>> joining us for more, cnn chief law enforcement analyst john miller, the new york police department'svideo that stockton police released. they say it's a person of interest. the guy seems to have a distinctive swaugger to his wal. >> you see the back of him, not the front, but they also realized that, you know, the still picture they have didn't have that gait. somebody who knows somebody will say i know that outfit, i know those boots, i know that walk. that's that guy. so they're trying to expand their reach. >> they say they've linked these cases through ballistics. the police officer said that this person is on a mission. what does that mean? >> i think when you look at the offender characteristics, there's no indication he knows these victims, there's evidence that he doesn't. this is an extension of what they call instrumental violence. there's no guilty or remorse. the people are just objects in his killing spree because he's after a larger goal. in this case, the goal is probably not a specific thing. it is to feed his feeling of power, this god-like power that i can stand ove

. >> john miller, what do you make of how forthcoming the suspect was in his interview with police. he was read his miranda rights but spoke extensively to the police. what stands out to you based on this affidavit that has now been released? >> so many things, wolf. it's a very rich affidavit in terms of the amount of information that they put in about their evidence. but let's go back to our suspect for a minute to get to the core of your question. here's a guy who was involved in a high-risk activity. he's going to do a home invasion by himself with a hammer at the home of arguably the second most power of person in the united states government in the line of succession for the presidency. so there is an extraordinary risk that any rational thinker would calculate that he's going to get caught. and yet when his victim calls the police and he knows it was 911 and he knows the police are coming, he does not flee. he compares himself in a bizarre statement to being like our forefathers who fought the british. surrender was not an option. so you have a guy who took the risk of gettin

john miller is with me now. we talk about warning signs.y stepped in, had the gun taken away. the family got mental health for him, treatment for him. given all of this, where was the failure? >> i mean, the failure is any time all of the signs are there and the event occurs despite that. we will call it a failure, but casting blame is the hard part. families struggle with children with mental illness. they tend to rely, what do the experts say? the police tell them, we will get the gun out of the house, we will give it to another relative, step one. mental health professionals say, you know, we have evaluated him and don't think he is an immediate danger or he can stay home. we have seen this before in the buffalo supermarket shooting by a young white supremacist. he put on his high school goals page to be a mass murderer. state police were called. they questioned him. they turned him over to a mental health facility. 48 hours he was out and went back to his plan. >> police recovered the notebook of the shooter. inside, the killer wrote th

. >>> we have the chief law enforcement and intelligence analyst, john miller and analyst with legal cordeiro. the new secret service documents, they prompted you to write an important piece for cnn.com over your explored whether january 6 was a failure of intelligence or a political failure. explain what you think. >> reporter: there is a few things that could be game changes that didn't happen. with the intelligence shared widely enough and we see from the secret service that it was intelligence from other agencies being distributed -- so, we know it was out there. what are the three things? the department of homeland security did not do a comprehensive threat assessment for that event on january 16 to pull together that information and put it out so everybody had a common operating picture. people were operating on fragments and the capitol police did a good one but it stayed within the capitol police and the same department, homeland security, could have and only by order of the secretary, declare january 16 and national security event, and that would put the secret service in ch

intelligence analyst jon miller is with us now with this new reporting. john of documents involving this threat information that the secret service had before january 6. what did we learn from this that we didn't know before. >> that was whitney wild from cnn in washington working with the online team broke this story an the threat documents that were part of the nearly million documents that the secret service turned over to the january 6 committee told us that there was a lot of information in the possession of law enforcement, including statements from people on parlor, the site we just talked about moments ago, saying i'm coming to washington with my gun and that traitor pence will have to come out of the capitol in handcuffs or we're going in after him. intelligence information about militia groups like the only keepers with quick reaction that would be prestaged in virginia until they got the call from the president of the united states to come in, to back up the protesters. information on the numbers of people coming in, so there was a lot of that. the

. >> cnn's chief law enforcement and intelligence analyst john miller is with us now. ? is that valid? >> reporter: so the mayor has statistically and incredibly accurate point about perception versus reality, but try to tell a crime victim that that's perception, and when you see a video like the one we just saw, that has a very powerful effect on people. if you look at subway crime right now, the mayor said 3.5 million riders, that's up to 3.8 million today. your chances of being the victim of one of those serious crimes is about 1 in 600,000. your chances of being hit by a car is about 1 in 4,000. it's safer on the subway than it is on the street, but what we're seeing is these particularly jarring crimes. the man pushed on the tracks or back in last january, a financial services person who was shoved in front of a train and killed, or the analyst who was on the train and an individual walked up and shot him who didn't know him. we're seeing these crime connected to people with mental health issues who are acting out in the system and that's getting a lot of attentio

l let's bring in cnn's john miller with cnn senior law enforcement analyst and former fbi director andrew mccabe. so john, what do you make of a very short press briefings. what stood out to you? the weapon of choice here being a hammer. >> very short briefing by bill scott. very good police chief. i worked with him in the lapd but he gave us a clue when he personally thanked one of the 911 operators, which tells us a little bit about how police -- it indicates there may have been a phone call that paul pelosi could have gotten to a telephone. now, when you have a congressional leader, that house is going to have alarms, cameras, all of that is installed by the capitol police. the way we would have set it up, it would have had a panic button to sent a call for help out. so layers of security. we'll have to dig deeper to find out how it worked. for the hammer, that tells us a couple things. one characteristics, that's high risk. you break into the house with a hammer, use it as a weapon. it's not a gun. it's very personal. it up close. 2:30 in the morning you're probably expecting your vic

you know john miller made the point earlier saying we're now in an era where there is an ammunition shortagedepartments to get ammunition, yet this suspect had over 600 rounds. one of the many potential red flags out there did someone ask why is he amassing so much ammunition but the mental health institution commitment we're hearing about it shows the limited aspect of certain gun laws in the country. we know based on what police are saying that the suspect's family had concerns about him, took him to a mental health facility for mental health treatment but here is where the limited law comes in because under federal gun laws you cannot purchase or possess a firearm if you have been committed to a mental institution but that has to come from a lawful authority, from a court, from a commission that's not voluntarily committing yourself. here he went to get mental health treatment but that didn't stop him from getting the weapon, maintaining it and causing the shooting. >> and that school shooting in st. louis was at least the 67th attack this year in the u.s. thank you, josh campbell for you
