and much of this falls on the shoulders of john roberts, who from the start has tried to differentiate the supreme court from the political branches. you probably remember, john, that he famously said, we do not have obama judges or trump judges. we only have neutral judges trying their level best to do right by both sides but but as we start this new term, it's really john roberts and opinions he's written that have put the court in this position. he wrote the trump ruling, he wrote earlier decisions that favored republican interests, such as against voting rights and essentially endorsing partizan gerrymandering uh, rolling back administrative regulation of the environment and consumer affairs so this is a fraught time but a lot of it and a lot of it lands in his lap, but it's by his own hand john. >> part of the job. all right. joan biskupic, thank you so much kate. >> and we're continuing to track hurricane milton right now. the category four storm is stirring in the gulf of mexico, where the storm is expected to make landfall. how soon its outer bands could actually start impactin

i think anybody who watches the show knows i don't trust john roberts as far as i can throw him across the room. i think he's exactly like the rest of them, and so my question to you is, why should we not believe that trump can get a couple of his election deniers and fake electors in pennsylvania or georgia to refuse to certify, take that all the way to court as to whether they can refuse to society, stop a state from being certified, and get that case right to john roberts where he can do what he wants to do. he wants trump to be president. why should we not believe that trump has a plan that could be enacted wherein he loses the election but he gets john roberts to make him president the way the supreme court majority made george w. bush president? >> i'm going to tell you, of all the things i'm concerned about, i'm worried about voter suppression. i'm worried about a range of things but the certification process doesn't concern me an awful lot. assuming there is a good count, that's another thing. we want to make sure all votes get counted and the question becomes, we have a result

but president trump, as john roberts would no, he is a talker. we are all talkers.around and you're going to hear things that would relay that kind of awful tenor and attitude and tone that he is accused of. fascinatingly, he has been accused of these "losers and suckers" remarks come in front of the military, allegedly. but he says these things can meet me not around people who will come up and say so, not in public, not with people who would normally hear them if that is his attitude, because you have that kind of thing in people's attitudes and comments about other things. but it happens that there is no name sources, anonymous sources, and the people who were there are saying this never occurred. it was the same situation, and yet this has happened before. we have seen this. the american people know it's happen. this has fallen flat. but it abuses the families in the process, and that is i think what is important here. >> kayleigh: it is important. harris, i was standing on a tarmac when the "losers and suckers" comment popped. we were given virtually no headset

the case went to the other john roberts. what do you think they are going to do?> it is unclear what they will do and reason for that, i think the last thing the supreme court wants to do is get involved in the election the week before the election. >> john: they might the week after. >> considering the chief justice roberts and they have had a tough year and i'm sure they are aware of that. shannon bream tells us justices know they may need to weigh in. what should they do? it is a federal crime for a noncitizen to vote. it should be simple. doj is saying, you can't get rid of voters 90 days before the election and virginia said we have been doing this all along, it is virginia law and not systemic voter purge. these people self-identified as noncitizens. you think it would be simple in that sense. no matter where someone falls partisan wise, why is biden administration, doj, advocating for noncitizens to vote in the 2024 election? >> john: they cast a provisional, if they are put back on rolls there is no cure to remove their vote. >> that is why governor youngk

thing this made me think of is the timeline of this case and the intervention of chief justice john roberts and a majority of conservative justices who put it together. in the new york trial judge, who has this case in his custody, who decided to delay the sentencing into laughter. partly because of issues, -traps, sort of placed into the case by the supreme court . just like the political ramifications of this, which is that he should be sentenced. he should have been sentence -- sentenced in the run-up the election. the man is convicted of these felonies. in the supreme court did, very effectively, clear path for him illegally and politically down the stretch of this campaign. >> other people, the new york times did an analysis fairly recently on this looking at other people who have been convicted of the kinds of felonies for which trump was convicted in this case. looking at similar nvicted in t looking at similar circumstances. what they found was, of all of the available punishments to the court, when people come to be sentenced for crimes like this, the punishment that is most often
