"the guardian" revealing document that is the nsa can keep documents about communications on or about u.s. citizens if it contains developments or evidence of crimes. this comes as new questions about admitted leaker edward snowden after reports that highering screeners at nsa contractor booz allen hamilton found possible discrepancies on his resume' but hired him anyway. president obama set to hold his first of ever meeting with a privacy board created way back in 2004. we have team fox coverage. white house correspondent ed henry is live on the north lawn but we begin with national security correspondent jennifer griffin live at the pentagon. jennifer, how would you describe these new leaked documents?. >> reporter: john, they certainly contradict the assurances from u.s. official that is the nsa goes to great lent only to. the nsa mandate is very broad from what we can see in the documents. for instance i it can keep e-mails and telephone calls of u.s. citizens and legal residents

jon: and i'm jon scott.rs of gay marriage are hailing two rulings from the u.s. supreme court handed down just a short time ago. first, the high court strikes down the federal defense of marriage act known as doe ma, ruling that -- doma, ruling that legally-married, same-sex couple should get the same benefits as heterosexual couples. they also made a ruling that may clear the path for same-sex marriage in california. what was the court's reasoning in striking down doma, shannon? >> reporter: essentially, jon, it came down to how couples were treated and whether it was fair to treat same-sex couples differently under federal law than those married in a traditional marriage. it's interesting because, of course, doma doesn't actually say anything about the legality of same-sex marriage itself. it simply says if your state recognizes same-sex marriage, then the federal government cannot deny benefits to you, some 1100 or so benefits, tax laws and other benefits. the federal government has no say in the matter.

jon: thank you, maria.ell, just then, the it man accused of holding three women captive in his cleveland home for a decade. he pleads not guilty in court. ariel castro arraigned on 300 charges including murder and kidnapping and rape. the world watched as the three women he accused held hostage escaped last month. one escaping a calling for help. police then arrested the other two of them. so what happened in court today? reporter: it was a court hearing just like we expected. much like the last time a, about a month ago, he entered the courtroom with his head down, he kept it down throughout the hearing. he did not make eye contact with anyone in the courtroom. he had his eyes closed out the hearing as well. 329 charges that he is facing only cover the first five years. meaning that there is an additional 62 charges against castro. they are going to continue the investigation. jon: the legal team spoke after the hearing. what did they say? >> craig weintraub essentially said that there were certain charges

jon: yeah. have seen from this evidence that the irs has been throwing itself some lavish conferences, paying full rate for hotel suites, $50,000, you know, parody videos, that kind of thing. this is an agency that doesn't seem to necessarily know how to economize. >> well, and for me the problem is that our tax code because to be a special tax-exempt group there's certain guidelines. so the irs is in the position of policing political speech, of deciding are you overly political, or do you really count as a social welfare organization? if you are a democrat surrounded by a bunch of democrats, no matter how well intentioned you are, you're going to be more skeptical of a tea party group. are these guys really pursuing social welfare? it's going to not occur to you that, well, yes, they are trying to pursue social welfare. so my problem is these people are in charge of policing political speech when they are democrats surrounded by democrats and the campaign contribution numbers tell that story.

jon: here we go again. i'm jon scott. news confirms the former second highest ranking officer in our nation's military is being investigated over the leaking of the stuxnet cyber attack on iran's nuclear facilities. the probe focuses on retired marine general james hoss cartwright. "the new york times" reported last year that cartwright, a four-star general, conceived of and ran a cyber attack called olympic games in 2010. that attack temporarily disabled at least a thousand centrifuges that the iranians were using to enrich uranium. the article and a book written by the statement author included sensitive details about the operation. the leak, considered by many in washington, to be very damaging. national security correspondent jennifer griffin is live from the pentagon. jennifer, what's going on there? >> reporter: well, jon, a senior u.s. official does confirm to fox news that the department of justice has been investigating general james cartwright for more than a year. they are investigating his role in leaking, the

jon: i'm jon scott. the american at the center of the leak in hiding overseas as washington vows to bring him to justice . his name you probably know by now, edward snowden. he faces arrest and possible extradition to face charges if he can be found before a country grants him asylum. he's previously mentioned iceland as one possibility, now russia is also throwing its hat into the ring. a spokesman for president vladimir putin saying russia would consider giving snowden asylum if he were to ask for it. meanwhile guardian newspaper journalist glenn greenwald who already revealed many state secrets says more are on the way. revealing via twitter, no den has way, way more than just some slides. meanwhile the fbi is on the case searching snowden's home and pursuing interviews with anyone who knew him. his former employer, booth allen confirming he was fired yesterday for violating the firm's code of ethics. the guardian's greenwald says he's been working with snowden for february before he was hired by booz
