to bring in reuters white house correspondent jeff mason, the hill senior writer scott wong and joyce vance. joyce, you heard the last question and what the representative was saying. how will this week be written about? how big a deal? it's what we've been tornado warninging about for how long here in the beltway. but for everyday americans, ma will this be written as? >> it feels very much like this is the week where the future of our democracy hangs in the balance. people haven't focused i don't think quite enough yet, richard, on that second article of impeachment which charges that the president in an unprecedented way has refused to comply with legal process, with subpoenas that have asked for documents and for witness testimony in this congressional oversight proceeding. and instead of providing some information and saying well, that's enough, we won't give you anymore, or at least negotiating in good faith, the president issued a blanket refusal to let congress have oversight of the executive branch. if that's the new rules of order going forward, then we are far closer to a society

joining us now, joyce vance, former u.s. attorney who has been following the story. joyce, thank you so much for being with us tonight. there's a lot of news for this week. let's first of all start with what you make of the fact that we've gotten this new evidence, these emails so late in the game, and we got them through a freedom of information request. >> right. i think that context is incredibly important because this isn't information that the government produced. trump has famously said he won't respond to subpoenas. he might as well be advertising on a banner that he's engaging in obstruction of congress. these came through a freedom of information request by a small nonprofit newsroom. the government turned them over on the last day they were permitted to under the court order, sort of in the dark night on the friday before christmas. so this was not information the government wanted to turn over, and it's aggressively redacted. it makes you think of the mueller report as you look through it with these large blocks of black. there is a lot more here that we do

attorney joyce vance who spent a quarter century as a federal prosecutor. e, john durham, a standing u.s. attorney today commented on an ongoing matter, gave us a status report. is that something you did as a u.s. attorney enjoying the same rank as he has? and is that any better or worse than what comey did with hillary endearing him to so many democrats? >> so brian, that's not something that u.s. attorneys do. we don't comment on ongoing investigations except in very carefully enumerated situations. often we'll comment, for instance, on opening a civil rights matter so the community understands that doj is looking at it. but to make this sort of a comment, qualitative comment on the investigation to say his results are different than the inspector general's results and to talk about the fact that's due to his access to other kinds of witnesses is extremely unusual. it's extremely inappropriate, and i think you're right, we have to look at this sort of obvious comparison that will be drawn between what he did and what jim comey did. if there's one lesson we

attorney joyce vance. good evening to both of you. joyce, taking the wider view that we get to do sometimes, what strikes you as an investigator at just how quick all of that happened and what it sets up as the judiciary prepares for these future hearings? >> i think that the speed with which this unfolded is one of the most interesting features of this entire process in front of the intelligence committee. you know, typically the president is quick to come up with aacy theory or a reason he should be held accountable. but here the pace of testimony was so quick, the drop of news every day of expanding detail was so fast that the president literally couldn't keep up. and i think that that's one of the smart parts of the process in front of the house intelligence committee, is that speed of process. >> yeah. you mentioned he couldn't keep up. a lot of us in news rooms and those of you who report with us were just amazed, mia, when the president was literally at the un. so we know from what he was doing that day he was too busy to confer

also back with us former federal prosecutor joyce vance. to new york history i go right to you, joyce, on legality. obviously mr. giuliani is unbowed by this investigation as he continues. do you see legal problems for him here? >> this is incredible for so many reasons. giuliani is not a federal employee. he doesn't operate under any of the federal ethics laws. he's just off freelancing for the president in a foreign country, doing work we would normally expect maybe the justice department to be doing or some other legitimate government agency. so that i think is problematic. the source of giuliani's payment always has remained a mystery. we know from "the new york times" story today that the government didn't disclose any sort of free legal work, and yet he's not paying giuliani. so the question is who is? we know he was working with lev parnas who received at least a $1 million payment from russian sources, so there's a lot of murkiness there. the real question, though, ari, is would this justice department hold giuliani accountable for w

joining us now is joyce vance, former u.s. e, thank you so much for being here to help us sort through this filing. >> glad to be with you, rachel. >> so, originally, prosecutors did not seem bothered by the prospect that lev parnas was going to be on house arrest with an ankle monitor. to those of us that aren't lawyers, that seemed a little crazy, given with the way they arrested him, he was on a jetway on a oplane with a one-way tickt out of the country. now they're saying, oops, we were wrong. and among other things he had money coming in from places like rushy he lied to us about and that means we think he's a flight risk. tell us how unusual this is, if you've seen patterns like this in other cases. >> you know, i think that this is a pretty familiar pattern. initially, the prosecutors in southern district thought that they'd be able to work some sort of cooperation deal with parnas. that, i think, is why we saw those relatively modest conditions of release, given the fact that he was found, as you say, almost on the tarm

attorney joyce vance at the table. and nbc and nbc john heilemann. john heilemann, you were there. this seems more like a symbolic prospect than a vote-counting one. you've got to get to 20 republican senators to convict him. nobody thinks that's a possibility based on the politics as they are right now as we sit. but even one or two would symbolically sort of swipe at this white house on substance and on politics. >> i think, look, the reality is that that the white house is very focused on the number of republicans who vote for impeachment in the house and they're really focused on the number of republicans who would vote for convict trump in the senate. and anything that makes it not a party-line vote makes it harder for president trump to say it's a partisan witch hunt, it's all the democrats. and you remember republicans that break and the bigger the number on both sides, the worse it is for trump. they are going to spend a lot of time, effort, and energy over the next two months trying to keep those numbers as small as possible. it's possible now with the will hurd news from

attorney joyce vance. good evening to you.t do you think of obstructing congress as the second article and the choice not to get into something that our viewers know about that you testified to congress about, alleged obstruction in the mueller probe? >> so, i think that this is a very clever strategic move by the house. this second article of impeachment is drafted in a very narrow way. it applies only to the president's flat-out refusal to comply with subpoenas in the ukraine investigation. the facts are incontrovertible. republicans have not made any effort to say the president hasn't done this. so the question that republicans will have to face is, is this okay? is it okay for a president to refuse to let congress do its job? i think it puts them in a box in a very nice way. >> i want to read the only reference we could find -- i'm curious what you found -- that goes to something that came up from some of our experts in tonight's broad cast. when do you use a scheme or pattern to suggest things? the senate trial ultimately

. >> joining me now is januarys nichols and joyce vance. to the point that this has confused the process, americans are not that concerned with the process of impeachment and the trial, so they would assume that because they take a particular oath to be impartial, they think that should be the case, but that is not the case because mitch mcconnell is going hand in glove. they don't need witnesses or witnesses and it will not result in the removal of the president. >> the initial deference from the white hou -- defense on this is that they were talking about the calendar, they were talking about scheduling. and then he went a little further. we'll see to what extent this is lisa murkowski just signaling she is upset, or if she plans to defy her party leader and defect or vote for or put pressure on mcconnell to have witnesses. there are a lot of ways she can exert influence on this process. and ultimately whether or not she would vote to acquit the president or vote to convict the president. one thing we know about president trump is he like

. >> now matt miller, the former chief spokesperson, joyce vance, and brett stevens, i know you believe that what he is asking for is reasonable, but reasonable and real are two things. does mitch mcconnell care? >> no, he doesn't care. >> that is a few different ways that the senate can come up with an agreement for how they would conduct this tripe. that is clearly not can happening they are, the second way is for mcconnell to ram things through the e e members of the caucus are united. they are making the argument that the president should provide a fair trial. so you get guys saying we cannot defend to the voters we have to face in november zif giving them a rubber stamp. the statement that mcconnell made it not one that i can defend. so they demanded a more open trial where the house managers are able to call witnesses. that is clearly what shumer is trying to do. >> what do you make of the argument that if you want mick m mulvaney than we want hunter biden. they are supporting the witnesses that have knowledge that directly bears on the facts be e.g. discussed in the house. that w

. >> all right, thank you, now we know what is going on, let's dig into why you need to care, joyce vance, a former u.s. attorney, deputy assistant secretary of state, and cohost of unredacted. joyce, to you first, those e-mails legally speaking, do they connect any additional dots? >> you know they do connect dots, and one of the most interesting things is why we have this e-mail. it's because of a small nonpr non-profit news room set a question for the freedom of information act asking that they be turned over and they weren't provided until the very last minute that the court order would have permitted. so i think we need to have that context in mine as we look at the big blocks of black in the load of information that was provided, but we see this very clear notice that the final decision to withhold aide was not communicated to the pentagon for 91 minutes. maybe it is coincidence, but at a bare minimum it means they must tough. it is a shame process if we don't hear from them in the senate. >> the president was just using executive privilege, congress was wrong for impeaching him to

attorney joyce vance, who spent a quarter century as a federal prosecutor. joyce, do you draw any inference from ivanka's answer that may shed light on the tonnage of legal jeopardy rudy may be looking at? >> so i thought it was a very interesting answer because it wasn't an answer at all. and here we have the president's daughter. we should always stop and pause and sort of take a moment to appreciate the fact that this is the best advice that the president of the united states gets, not from a career professional but from a woman who is completely unqualified to be working in the white house, and that she's talking about what appears to be the president's equally unqualified lawyer, someone who, if anything, has dragged him into impeachment rather than protecting him. but i was struck by the fact that she would neither disavow rudy as her father's lawyer or do anything to encourage that assumption that he was working for him. it was remarkable for its studied failure to answer the question. >> i want to show you something from "the new york times" that talk

i want to bring in joyce vance. matt miller serves as chief spokes person, natasha bergland. what do you make of their case for not participating? >> i think it is entirely predictable. the only defense that he is pointing at this point is that the process is broken, property access is unfair. i'm sure that we will hear that it is a witch hunt, and you can't demonize the process when you participate in it. as we get into the fact witnesses on wednesday, as they try to educate the public on the legal parameters, trump will stand aside to criticize the process it wa process itself. >> they are saying it is wildly unfair. republicans only get to call one, they're saying it is totally unfair when they don't even know who the witnesses are going to be, and of course i just mentioned they're compla complaining that it is happening white house the president is out of the country. does the president have any ground to stand on here? >> not at all, majority and the democrats in the majority right now get to pick more witnesses. that is the way the process always works. i think the pre

joining me now, joyce vance. thank you for being here.the president's case to present a defense at all? >> you know, maybe not a defense so much as participation in the process. so that he could observe the rules and the reasons ultimately trump always seems to make his defense directly to the people through twitter and other mechanisms. and that seems frankly to work well for him. >> do we get any indication that the president or the white house counsel will actually participate in the process? >> realistically, i think it's unlikely. one of the last defenses they're left with in these proceedings is to complain that the process has been unfair. and it's very difficult to complain about the process when you're involved in it by rejecting the invitation of chairman nadler to participate. perhaps they'll say the parameters that he set for participation were unfair and that permits them to continue to take their case to the public. that the entire impeachment proceeding is not fair, that they won't participate in a witch hunt. of course the

[ laughter ] you know, as my husband says to our children, when you find yourself in a hole, don't keep digging. >> yeah. >> it seems to me that he's just making things worse by continuing to associate with the very people who has gotten him into trouble. you know, there are allegations that he may have violated the foreign agents registration act. and if he continues to work with these people, you know, still looking for dirt on biden, and he's also tweeted that this is all about his service for the president. >> ye
