those notices went out around the 27th, 28th of july of this year. at that time, when staff did their research, the owner of record was in fact the bank of new york. the hearing notification went to the property owner. unbeknownst to the department, there was a pending sale. the bank never notified us of this. three days before the directors hearing on february 8, the title changed. staff did not know that but we have subsequently become aware of that and a copy of that deed is in your package. the property owner that was notified 10 days before and an order was issued on the property. what happens in these cases is we have access to the recorders information. we go online to see what they recorded documents are that exist. the problem is, when there is a new deed that is reported, it is not put into the system right away. so the system does not have, in real time, that information because there are things that are beyond our control, namely data entry from the reporters office. as you can see from your records, we did not know -- it did not show up

now, that's a little not quite fourth of july. and the reason that's not quite fourth of july is there's really a difference of opinion. everyone thinks when you judge, interpret a statute, you've got some words here. and these words, i use a good example from i found somewhere in a french newspaper about somebody who was trying to transport some snails. >> oh, go into that. >> all right. it was a schoolteacher. i didn't know they brought snails around in trains in paris, but apparently they do. and this man was taking some live snails from normandy to paris to show to his biology class, and he put them in a basket. and the conductor said you have to pay a fare for the basket, there are life animals in there -- live animals in there. and they said, no, read this, it says right here in the tariff, no one can bring live animals onto a train unless they're in a basket, and if they are in a basket, you have to pay a full fare. he said, smails? that's what it says. next july 21st we become an agency that actually has power. and we take over responsibility for enforcing the federal consumer laws statutes that are out there and for making new laws as needed and for creating a platform for financial education. what we are doing here right now is that we are trying to put everything in place. we are hiring people, we are reading the statutes, we are figuring out our strategy for what comes first, what comes second. we are trying to put a whole business plan to get there. we are kind of a start up here in the government. we will be working on behalf of american families. tavis: to whom is this bureau accountable and who has oversight? >> number one, this bureau is accountable to the american people,. this is unlike some, we are not here to be accountable to the banks or to be accountable to the rich and powerful. we are here to be a voice on behalf of the american people and to be accountable to them. now, the way this thing is set up, the structure is just like all of the other federal banking agencies. when
