katelyn polantz is "outfront."s is shaping up to potentially be a rough summer for the former president. >> it's certainly not going to be a sleepy summer for donald trump. that's because he has this huge cloud hanging over his campaign in the form of the indictment against him in florida from the special counsel's office related to documents at mar-a-lago. and that case has kicked off with donald trump pleading not guilty a few weeks ago, but really is going to get moving in earnest toward a trial beginning this week. because on thursday, that's when his co-defendant walt nauta is due back in court, and nauta will be pleading not guilty at that time. he will also have a lawyer show up from florida at this time. it's going to be a short and sweet and procedural hearing from what we know, but it does kick off a lot in that case where they can move towards arguments. they can move to discussing classified material. and we also know that the justice department keeps wanting to talk to more witnesses around there. so t

katelyn polantz, to that point, your my ask jeeves, what's next?gie makes a great point, no charges have been brought. this is a target letter. generally or often ends up in charges. we obviously saw that in the documents case as well. but no charges have been brought yet. what should we be watching for in this specific case going forward? >> yeah. well, phil, we're going to be watching the federal court. that's where the grand jury has been sitting and hearing this evidence. we don't know exactly what stage the justice department is in. clearly they're in an end stage and donald trump may very well be right that he may be arrested and indicted in very, very short order. but we know that the grand jury, they will have to meet. so it's a secret panel of people who have been listening to this evidence. they will have to sign off on the indictment. they will do that in secret. all of their proceedings will remain secret. their names will remain secret. but, once that indictment is signed off, the judge also will approve it and then it will be released

katelyn collins, i know you've been doing a lot of reporting on this. what are you hearing from the trump team? >> there's a big question here for even trump's team. they really didn't have an indication as of this morning of whether or not they were going to see this either today, wolf. and of course that meeting happened. and that is something critical. it's not likely to change the minds of where prosecutors were going. and i was actually told trump wasn't interested in having his legal team go and meet with the special counsel's team initially. you know, it was 11 days ago he got that target letter. and he just didn't seem to think that there would be much benefit in it, believing this third indictment was inevitable in his view. but despite that they still did go and meet. it was todd blanche, john lauro, those are trump's two latest attorneys, meeting with them for an hour, and jack smith was in the room. but i was told, wolf, they weren't going in there to argue the facts of the case or say you're wrong on this, you're wrong on this measure, but

let's bring in cnn's senior crime and justice reporter katelyn polantz. this is potentially a big day, all eyes are on that grand jury. >> yeah, so abby and phil, the grand jury, they industrial have tissu -- a little bit of work to do. a man who was quite close to trump as a person aide after trump left the white house, but who also had worked in the white house, a man named will russell. we don't know exactly what he's going to be testifying about, but this is his third trip in to provide secret grand jury testimony. we do believe one other witness is going to be going into the grand jury today. the grand jury has a little bit more work to do confidentially. the decision may already have been made at the justice department to bring a charge, an indictment through the grand jury against donald trump for actions related to january 6th and the 2020 election. very likely, i say that because trump gets that target letter. that's not something the justice department does lightly at all, and so now we wait. the grand jury could return an indictment really at a

katelyn polantz, outside of the courthouse watching it for us. >> and now house speaker, kevin mccarthy made the most latest impeachment threat against president biden telling fox that president biden's alleged business dealings with his son are rising to the level of impeachment. manu raju, and this language was inching very close. what are you hearing? >> yes, an implicit implication, and it is not to be taken lightly. three have been impeached and donald trump was impeached twice, and if president biden were to be impeached, he would be the fourth. and kevin mccarthy is saying that an impeachment inquiry could be launch and this is the first step to go ahead to charging a president with high crimes and misdemeanors here, and the allegation is that president biden was involved with his son while he was vice president after the allegations of an fbi informant that he was involved in a bribery scandal. the white house has dismissed this and saying that the president was not involved with his son's business dealings, and they are pushing forward with what they are calling a political stu

katelyn polantz is outside the courthouse. as we wait, there are two very important pieces of news breaking here at cnn. can you walk us through it. >> we are learning essentially avenues that the special counsel's office is pursuing and getting information that really weren't the focus of that massive story that the house select committee laid out that over a series of different events on the the hill where they explained what happened on january 6th and the 2020 election. the stories that we're hearing now that the special counsel was looking into, on one side, they are looking into a briefing that donald trump sethed as president in 2020. this wasn't something that was a focus of that house investigation, but it was a briefing that there has been testimony given to the special counsel about how donald trump received word that the election was going to be secure and he should be comfortable with that. he was receptive to that information. he wanted a press conference to tell the american public that the lerks would be secure

katelyn polantz is outside the courthouse in washington, d.c. for us. and also with us is election lawyer ben ginsburg. katelyn, what did we learn about this meeting between trump's attorneys and jack smith? >> reporter: we're getting a little bit more detail about what happened in that meeting. according to kaitlan collins, the attorneys for donald trump, who went to that meet ing after receiving that warning from the justice department that donald trump was very likely to be indicted, they went in there not to argue with special counsel jack myth about the facts that he has gathered or to learn about the facts or to argue the case itself, but rather a broader idea of presenting an argument about indicting a f former president of the united states. someone that they believe, if he is facing an indictment now, could cause turmoil in the political environment across the country. and so that is one of the things that was coming out of this meeting. another thing coming out of this meeting is there wasn't a clear indication given to the trump defense lawye

katelyn polantz, thank you outside of that courthouse. i want to bring in paula reid, because what do we know about what the trump attorneys plan to hear? >> they are going to hear that he going to be indicted. he had the opportunity to go before the grand jury, and these are all of the steps that precede an indictment, and highly unlikely given all of the time and resources that has gone into the investigation that his lawyers are going to be changing the hearts and minds of these prose prosecutors. if the former president is charged either today or next week when the grand jury is back, these defense attorneys are going to be coming up with a strategy to defend their client while he continues to campaign for the presidency. what we have seen in the other criminal case brought by the special counsel down in florida, the mar-a-lago case, the trump team is in the mind to delay, delay, delay until after the 2024 election and it is unclear if it is successful, and clearly a trial on the calendar for next year and unlikely for the date to hol

katelyn polantz live in washington, thank you. boris? if you're not an avid federal court watcher, this can all be a bit confusing. we want to dig deeper now and sort how all of this works. a grand jury is kind of like a normal trial jury. it's made up of people from the general population called up through jury duty, but unlike a trial jury, the grand jury does not decide on guilt or innocence. their purpose is to look at all the evidence investigators have collected and decide if there's enough there there to bring charges to indict, and that means they have a lower burden of proof. the grand jury also operates in. that's to protect from tampering, and it also protects potential targets like from reputational damage if the grand jury decides not to indict. why do grand jurys exist in the first place? they were created as a check on government power to protect against baseless prosecution and ensure that only cases with ample evidence go to trial, which then brings us to today. we know the grand jury is meeting right now at the federal

more now from katelyn polantz in washington. >> reporter: former president trump received a clear sign from justice department prosecutors that he is very likely to be indicted in the january 6, 2020 election investigation, a criminal investigation that has been led out of washington, d.c. by the office of special counsel jack smith. and trump believes that he may be indicted here, that he may be arrested because he was told on sunday in a letter to his lawyers from the justice department from smith's prosecutors that he is the target of this investigation. we don't at this time know of anyone else who has been identified as a target or at least told by prosecutors that they are likely to be charged. but this is the sort of signal that the justice department gives at the end of an investigation. and this has been a sprawling probe from the justice department, from the special counsel. it is separate from the documents case that donald trump has already been charged in in florida. and this is an investigation that has looked at knowledge that donald trump had, that he lost the election,

and katelyn polantz has the latest for us.e'll get to that in a moment because that was a significant moment in the interview that kaitlan collins did with him, but first what happens today in the courthouse with walt nauta? >> so this is the mar-a-lago documents case, this charge. donald trump and his co-defendant walt nauta. but walt nauta still has to plead not guilty. it has been about a month since the indictment, but he has had this dragged out for a couple different reasons about couldn't make his last appearance and he also needed to find a florida lawyer. so we're watching whether or not walt nauta shows up in person today, he doesn't absolutely have to. we think he may be there in person. for the first time by himself really in court without donald trump by his side, the man that he is traveling with quite consistently as his plal aide. and we're also watching to see who shows up as walt thnauts na lawyer. this is the spotlight on him as co-defendant, as that man that was known by the justice department last year bef

katelyn polantz has the latest for us. and we'll get to that in a minute, but first we're coming up on walt nauta's hearing this morning. what should we know? >> he is accused of obstruction and making false statements. he is set to be in court this morning. short and sweet is what we expect this proceeding to be. he needs to enter his pleading of not guilty, that has been expected for a long time now. and finally today he think that that will be happening where there will be a lawyer showing up with nauta, a possibility nauta is there himself. but this proceeding, it puts the focus on this co-defendant of donald trump, a man who is so aligned with him that they are rarely seen apart whenever trump is traveling for political reasons. trump is not going to be there at the hearing today. but this is really highlighting how walt nauta is a defendant on his own and so he will kick off this proceeding entering that pleading. but also these two men are so aligned, they both want to go to trial sources are telling me, that is the

cnn's katelyn polantz joins us. with what could this mean?> reporter: any time the federal grand jury looking into january 6th, any time they gather in the courthouse, at this time they could be asked to approve an indictment specifically one against the former president, donald trump. that's because 11 days ago, donald trump got the target letter from the justice department indicating to him that he was likely to be charged. you're right, the grand jury was not in earlier this week they met a couple on times last week and saw a couple different witnesses that they had spoken to throughout the day who gave them testimony. but now we are waiting to see what happened. our own casey gannon is over there watching the courthouse. she has seen not only the grand juries coming in to that secret proceeding convening this morning but also seen a person working with the special counsel's office over there at the courthouse. so now we watch to see what else might come today. will there be other witnesses? who else could the special counsel's office want

cnn's katelyn polantz is outside the courthouse where the jury is expected to meet.developments have there been from the special counsel's office? >> reporter: well, boris, after months and months of this grand jury coming in tuesdays and thursdays, working diligently hearing from witnesses and having other information brought to them coming in, in documents, they do not appear to have convened today. however, that doesn't mean the special counsel's office is not busy at work. and the primary thing that we know that they have now that they didn't have before, that no investigator had before, were all of these documents that bernie kerik, a close associate of rudy giuliani had, as he was working with giuliani and others after the election. working for the trump campaign. essentially there were -- it's a collection of lawyers led by giuliani, who were trying to gather information about voter fraud. they didn't find evidence of widespread fraud. but they have lots of communications between one another, and those documents that bernie kerik had, into the hundreds, they h

katelyn, we've now got these details. what happens now?, now we watch the grand jury in the federal court, the grand jury that has been at work for many months, even before the appointment of special counsel jack smith to lead this investigation around donald trump and others related to the 2020 election. that grand jury, we expect to be back tomorrow. they have more work to do. we know of at least one witness, a personal aide to trump who also worked in the white house is scheduled to come in. scheduled to testify as well as potentially others and there have been so many pieces of this investigation that prosecutors can work for whenever they're carving out exactly in this indictment if it is approved by the grand jury and that, in front of you, is a list of some of the people that they've spoken to investigators and not the full list at all. that doesn't even include state officials and there on that board is some of the closest advisers to donald trump and the west wing. his own vice president mike pence all having spoken to the special

cnn's senior crime and justice reporter katelyn polantz is tracking the story for us.lawsuit has been going on for a bit of time where these election workers are accusing rudy giuliani of defamation, but what's happening now is that they have gone to court and said we've got some pretty interesting text messages from december of 2020. at that time top trump lower boris epstein had written a text message to giuliani and others saying that they didn't need to have proof of election fraud. they just needed some things that could help them make the case to voters to undermine the election. he wrote urgent potus request, need best examples of election fraud that we've alleged that's super easy to explain. doesn't necessarily have to be proven, but does need to be easy to understand. is there any sort of greatest hits clearinghouse that anyone has? rudy giuliani responded three minutes later to that text message, yes, look at the security footage in atlanta of the votes being counted. something that he was digging into at that time and falsely saying there were votes being s

what's the latest you hear, katelyn, about the news we're not going to get an indictment today?porter: yeah, so what we are hearing today just that there was a grand jury in. we know that, we know that there was special counsel's office prosecutors right here in the courthouse in secret proceedings. they hadn't been in earlier this week. they had a flurry of witnesses last week. as the afternoon wore on, typically in the afternoons, that's when the grand juries meeting here on a daily basis looking at cases make their returns. they have approved indictments, and those indictments go to a judge for sign off and get into the court system. there were no indictments handed out today from the grand jury to any judge in the courthouse. and there are none expected to happen today. that is something that was told to us by a court official who was inside the building and came out, was waiting to see if that proceeding happened. and then came out and told myself and several other members of the press that was indeed what was happening here. so, we just don't know what this means. you know

joining us now is cnn's katelyn polantz.ers to complete this task. what's going on? >> well, the lawyers did tell the judge that they are essentially on track to start looking at classified material. they've submitted pretty much all the forms that they need to submit to get some sort of level of security clearance to start looking at classified information. the only thing that has left to be done is that one of the trump attorneys, chris kise based in florida still has to submit fingerprints to get that process moving, but all of this is in service of the this hearing, share ration that is lined up for tomorrow in this case. pretty important hearing on a couple of months. it's the first time that the defense team and special counsel's office will be before judge aileen cannon, the federal judge that will oversea this case to trial. there's been a lot of arguments on both sides about when the trial should take place, could it take place at the end of this year or should it be postponed essentially indefinitely even after the
