katie phang. katie, fills to you as a former prosecutor. this prosecutor wants to put a lid on this and gag order essentially on the autopsy report. do you agree or not? >> where's the transparency? as a former prosecutor, if you have nothing to hide and frankly because it's a criminal case, you have to show everything. so the fact that she is not releasing this autopsy report suggests that there is something about the medical results that came from the m.e.'s office that would actually support the defense's case. i think it's better for her to just release it. let the public see what happened to freddie gray and then let the evidence lead to the ultimate conclusion as to whether or not there is guilt on behalf of the officers or not. >> well, you know, wait a minute. let's try to remember. this was a prosecutor who rushed to judgment. now, she said that she will not be baited to litigate this case through the media. but guess what, she has already litigated through the media. >> that's an eye roller. when she said that people rolled their eyes. clearly that's what she did. what about putting a lid on the autopsy report? >> i don't think that a lid should be put on it i think that again that autopsy report should be out there in the public domain. i think that there is something in that autopsy report that is now suspicious and suspect. >> all right. now, i don't know what the marilyn rules are. but if the marilyn rules are that autopsy reports released at this point she better release that one right now consistent with the rules. the one thing i will say that sometimes people will get protective orders from releasing autopsy photographs, and judges will oftentimes wait until trial before those are disclosed. >> exactly. >> if the routine is to release this report. if those are the rules she better follow those rules. katie, let me ask you another question, indicatey. she also is pry trying to prevent the officers the defense from seeing the knife that freddie gray had. >> outrageous. >> now that is outrageous. >> that's unbelievable. >> but the police say the knife was an illegal one justifying the arrest. she says that it was a legal knife, saying that the arrest was a bad arrest. now she is holding the knife and won't let the police or apparently their lawyers to see it? >> she is not letting the lawyers on behalf of the officers have access to the evidence in this case. if this is not the clearest case of prosecutorial misconduct i don't know what is. because at this point they need to be able to look at this night. the knife was the basis of the arrest. she has gone on the record, no pun intended, in front of the media and public and stating that the knife was a legal knife therefore justifying the prosecution. so she needs to move out of the way. she needs to let another prosecutor handle this case

on the identity to be policy confirmed by the coroner's office. so at this point they're asking for any potential witnesses to come forward. anyone who may have seen this victim before the shooting. because at this point they don't know if it was targeted or if it was a road rage incident. the witnesses are asked to call the sheriff's office. mary smith saw massive backup on eastbound highway 4 as she approached pittsburg. >> it was like a parking lot. >> reporter: she pulled over before reaching the closure at san marcos boulevard. >> there was a shooting on the freeway. >> it sounds like they were on the right side of the highway and the victim went across all lanes and hit the center median. >> reporter: shortly after 3:00 people called 911 after the shooting. chp shut down the highway and the male driver was pronounced dead on scene. >> it was just not moving -- it moved like a couple of inches every few minutes. it was just terrible. >> reporter: it took her two hours to travel three miles. many people lost their patience. >> they were getting aggressive and using the shoulder. >> reporter: the lieutenant said the bullet casings were scattered. there was no choice but to shut down all four lane. >> so we're getting all that cleaned up and packaging the evidence so that we can do justice for the victim's family. >> reporter: the highway opened around 9:00 some six hours later. at this point the police don't have a description of the shooter or the shooter's vehicle. in pittsburg. >>> in oakland, a search for answers, police want to know more about the deadly shooting of a man by an armed security guard happening after two men got into a fight at international boulevard and high street late last night. the trouble may have started when the guard asked the man to leave the station. detectives have been questioning the guard. >>> new at 11:00, one person died, another went to the hospital after a light rail train plowed into a car this evening, happening around 7:40 p.m. investigators believe the car turned into the train as it headed southbound into the median at capital avenue. >> the vehicle had made an illegal left turn at madden avenue. and in the area there is not even a left turn pocket to make that turn. >> the car's driver died at the scene. the other person in the car was alert when they were taken to a trauma center. nobody on board katy zachry is live in center city. how are you doing, katy? >> reporter: i'm actually doing pretty good vai. the sprinklersç are on here at logan circle we're getting some of the mist. this is a pleasant time of day, probably the only time of day you can describe it as pleasant. leading into today we're xpebing high heat and humidity. i spoke at length with the city's health commissioner. he was expecting to learn if there would be a heat advisory or warning around 4:00 this morning. that word came early from the national weather service. unfortunately scenes like this hot and humid scenes are not too far off in our future. a heat advisory is in effect for philadelphia between 11:00 a.m. and 6:00 p.m. today. the city's health department when they're expecting extreme temperatures like this they are in close contact with the national weather service. that agency assesses the conditions and determines if an advisory or warning is needed. an advisory is less severe than a warning. we've not had a warning all year. we had an advisory one other time in early june. when there's a heat warning, a number of additional city services are offered to keep people cool and inside. you are not being told to stay off the street because of your health in these extreme conditions but you are being advised to stay inside during the heat of the day. now, earlier and later when the sun isn't so harsh, there are great places in philadelphia where you can go and stay cool. i checked in with visit philadelphia for that and i'll have more tips on how to stay cool if you're visiting the city or want to get outside a little bit. that's coming up in the next half hour. reporting live in center city katyzachry, nbc 10 news. >> watch that sprinkler hen you, katy. although it does look inviting right about now. >>> the latest forecast and severe weather alerts sent straight to your phone with the nbc 10 news app. download it now. >>> and jessica boyington with your first alert traffic this morning. we're out on the roosevelt boulevard around fox street. you can see that we're moving along just fine in both directions, southbound towards the schuylkill. northbound doing just fine as well. and out in north coventry, still watching that accident scene on 422 on the westbound side. that's still closed due to an earlier accident between route 100 and 662. on the freeway, we're doing okay there as well. a five-minute trip headed northbound from 55 up towards the walt whitman bridge. no problems on the walt whitman bridge as well. the rest of area bridges are free and in the clear. no problems on the ben or the tacony palmyra. >>> the philadelphia delegation in rome may have the opportunity to
