katie marzullo is live at the scene with the latest. >> reporter: good morning.alled the lead investigator with the atf on this case for insight on how this investigation if -- is going to go i haven't heard back yes -- heard back yet. atf will go through the rubble in just a few hours. their involvement does indicate it is possible they are considering arson as the cause for this fire. of course there is the security guard who was working overnight last thursday when this fire broke out he has told authorities that he saw three people around the back of the building and that one of them may possibly had something in their hand. the oakland fire department is assisting the atf with this investigation. oakland police department will take on a larger role if the cause of this fire is determined to be criminal. this fire forced shutdown of bart between east bay and san francisco almost all day thursday. it did not reopen until 3:45 that afternoon a lot of long lines for buses and crowded ferries. also plenty of traffic on the highway filled with cars who otherwise w

katie marzullo is live at heritage high. >> reporter: as of yesterday, 50 students had been suspended. parents an attorney for some of the families tell us they expect more today because the school has identified more students who were involved through photographs. it is the last day of school at heritage high in brentwood and last chance for some seniors to take finals. >> this morning i called to find out what the story is, because i heard yesterday afternoon that some of the kids that were suspended yesterday did get to come today and take their finals. she was told she could not come, absolutely could not come. >> reporter: this mom was able to get her daughter on to campus today but she isn't sure if the tests will count toward her grade. she admits her daughter participated in the senior prank. but she says the principal's decision to suspend the kids and ban them from commencement is overkill. >> i can appreciate that that he wants to stop anything for the future. other than that, i -- it doesn't make sense. >> reporter: at least a dozen families have hired an attorney to force

katie marzullo is live outside the courthouse. >> reporter: it is a long and detailed story right out of the gate the d.a. related her case against william lynch. then lynch took the stand. right away he admitted that he did hit father jerry lindner. he said, "i don't want to insult the jury." his attorney took him back to 1947 to that camping trying he -- trip he took involving families that where he says he met father jerry as they called him for the first time. he went into graphic testimony about what he says was rape and molestation that happened in father jerry's tent between father jerry and both he and his brother, several times during his testimony he broke down crying with his head in his hands, it was clear it was difficult for him to talk blood pressure. he says father jerry threatened to kill him and his family if he ever told. he says that is why he did not tell until he was in his 20s. he and his brother talked to his parents. will lynch said he decided he needed to do more. he wanted father jerry often streets. he tried to get charges filed, he was told the statute of

katie marzullo is live at santa clara county court in san jose. will the trial continue? >> reporter: it will. it was the defense late last week filed a motion for a mistrial claiming the d.a.'s office put the priest on the stand and allowed him to lie under oath. the defendant will lynch and his attorneys were immediately encircled by supporters activists, friends and family seeking justice for priest molestation victims. will lunch says father jerry lindner sexually assaulted him in the 70s. in 2010 lynch tracked him down and beat him. the d.a. office put father lindner on the stan last week telling jurors he would -- likely lie and deny the molestation the priest did that the defense asked for a mistrial calling the the d.a.'s office argued it was being honest and upfront with the court. the judge agreed. saying the defense could not prove with 100% certainty that father lindner lied because he was never charged nor convicted of molestation. >> if it is a mistrial we are relieved on will's behave. however whichever way the ruling -- ruling goes we'll continue to fight

katie marzullo joins us live from the scene with more on that. >> reporter: we are here at highway 13 the fire department just left they were on scene hosing down the area. they've left now this intersection is open, all roads are open. if you drove by you would never know anything happened. but they are investigating a homicide. police this morning got the call, people driving on to the on-ramp saw the body off into the bushes. they stopped, tried cpr, police arrived, there was nothing anyone could do for this person and she was pronounced dead. we know the victim is a woman. police won't say anything about her age also won't say how she died and whether or not she died here or killed somewhere else and then dumped here. we are just in the very preliminary first few hours of this investigation. we'll check in and see if they've learned anything else. katie marzullo, abc7 news. >>> this morning we are learning more about what suspended sheriff ross mirkarimi tried to do to control the fallout from the domestic violence incident involving his wife. text messages between mirkarimi, his

katie marzullo is live outside the courthouse. >> reporter: it is a long and detailed story right out of the gate the d.a. related her case against william lynch. then lynch took the stand. right away he admitted that he did hit father jerry lindner. he said, "i don't want to insult the jury." his attorney took him back to 1947 to that camping trying he -- trip he took involving families that where he says he met father jerry as they called him for the first time. he went into graphic testimony about what he says was rape and molestation that happened in father jerry's tent between father jerry and both he and his brother, several times during his testimony he broke down crying with his head in his hands, it was clear it was difficult for him to talk blood pressure. he says father jerry threatened to kill him and his family if he ever told. he says that is why he did not tell until he was in his 20s. he and his brother talked to his parents. will lynch said he decided he needed to do more. he wanted father jerry often streets. he tried to get charges filed, he was told the statute of

katie marzullo is live at santa clara county court in san jose. will the trial continue? >> reporter: it will. it was the defense late last week filed a motion for a mistrial claiming the d.a.'s office put the priest on the stand and allowed him to lie under oath. the defendant will lynch and his attorneys were immediately encircled by supporters, activists, friends and family seeking justice for priest molestation victims. will lunch says father jerry lindner sexually assaulted him in the 70s. in 2010 lynch tracked him down and beat him. the d.a. office put father lindner on the stan last week telling jurors he would -- likely lie and deny the molestation the priest did that the defense asked for a mistrial calling the the d.a.'s office argued it was being honest and upfront with the court. the judge agreed. saying the defense could not prove with 100% certainty that father lindner lied because he was never charged nor convicted of molestation. >> if it is a mistrial we are relieved on will's behave. however, whichever way the ruling -- ruling goes we'll continue to figh

katie marzullo is there. another man was injured, how is he doing? >> reporter: i talked with the battalion chief a few minutes ago she said that second man remains in critical. he was rescued from this burning home at the same time in the same location as the man who died. fire investigators are still looking into what caused this fire. neighbors have their theories. hours after the flames are out oakland firefighters are still working to keep it that way. >> our first units arrived and found heavy smoke and flames from the front of the house. >> reporter: their first priority, look for anyone inside. they found two men. >> they found them on the second floor in bedrooms at which point they were brought out unconscious in critical. >> reporter: neighbors say they are not surprised. they tell me the elderly woman who used to live here died a year ago the house had been foreclosed on and the power off but family members were still coming and going. >> one of her sons stayed here, i haven't seen him in sometime. >> if the utilities were off i wouldn't

katie marzullo was first on the scene. she has video. >> reporter: the body was found by drivers getting on highway 13 northbound on-ramp at joaquin miller road. whether the body whether the woman was killed there or her body was left there neighboring businesses are on edge. abc7 news had only camera after at the scene as the coroner's office removed the body of the woman from the highway 13 on-ramp in the oakland hills. >> witnesses attempted to do cpr, no luck. obviously medical responded and declared the person dead at the scene. >> reporter: that was 1:30 this morning. the woman had been shot not clear if she was killed, where or if her body was left there after the fact. >> we don't get a lot of calls up here if we do it is not similar to this. >> reporter: nearby merchant agree. they were not expecting a homicide steps from their businesses. >> we had minor problems, but not major this is probably the first one which hear something like that and really sorry about that. >> i'm concerned because people work here at o

early morning house fire critically injuries two men. >> katie marzullo has rushed to the scene.at do you have? >> reporter: we are just on scene right in front of the house take a look this is the aftermath. fire broke out 4:30 this morning. crews had it out in about 12 minutes. but, two people still were critically injured. i just talked with the battalion chief lisa baker, she doesn't have an update on their condition. the two men in late 40s or early 50s were taken to the hospital in critical condition. firefighters found them upstairs in the house unconscious presumably due to smoke inhalation. the chief tells me when her crews arrived they found the home engulfed in flames out of the front of the house which is easy to imagine now that you can see the aftermath. as far as the cause, it does not appear electrical and it does not appear to be suspicious that. is two things taken off of the -- taken out of element, they are still investigating. the investigator inside at this time. what they will be looking for are working smoke detectors. when crews first got on the scene did

katie marzullo is there live.this is day number five >> reporter: day number five, and status quo for this protest. if you take a look behind us, you will see the signage covering the fence around the school and the parents are sleeping in tents just beyond that signage. other signs read, 4 p.m. rally today this group, based on signs and what they've told me are moving ahead. here's what it looked like yesterday. a lot of parents gathered here, protesting the fact that the district is closing this and four other schools turning one into a charter school. they accused the district superintendent tony smith of mismanaging the money. one of signs out here reads, tony smith reopen or resign. the district says there are not enough students to fill these schools and closures will save two million dollars a year more than two million dollars a year. the district has asked parents to leave. they say this camp out will have to end that is not what the parents are saying. >> we are pointed how the district is handling all o

katie marzullo has been on the scene all morning. >> reporter: we just learned from investigators that there were heat detectors inside this home. we don't know if those were functioning at the time of the fire. take a look at this house as investigators look for the cause you can't see much damage from the front most is around the back there were eight young dumbs in this home when the house -- young adults in this home when the house caught fire one woman did not make it out alive. >> maybe the flames were 50 feet, i don't know there were embers flying through my house and the next house. >> reporter: smoke rises from the roof the fire just extinguished flames claimed the life of a young woman who was on the third floor in the attic space. >> they were able to retrieve her out and bring her out to the air. once she was out of the structure she was being assessed, cpr was initiated. sometime later the patient was determined to have passed. >> reporter: an ambulance rushed two others to the hospital with burn injuries and smoke inhalation. five others made it out okay. survivors sat sa

katie marzullo is there live. this is the fifth day?> reporter: correct fifth day and they promise more of the same. right now it is quiet there are a couple of protesters one parent awake. most of the tents, all of the tends are behind the signage on campus and across the street there are two police officers parked in a strip mall parking lot across the street making sure there is no trouble here keeping quiet. i saw one parent speaking with the officers he says they are friends and all is well here this morning. as far as what you can expect later today we have video of the protests that happened yesterday. a lot of signage, dozens of parents, at issue not only the closing of this school but four other schools and turning a fifth into a chart are school. parents contend that is due to mismanagement and they could keep the schools open if they wanted to. the district says there aren't enough students to support having all these schools there's been declining enrollment and they are in the case of lake view going to use the campus for a

katie marzullo is live at the scene. >> reporter: i just got off the phone with fire dispatch. it is out, contained it is here at stern grow. video, decent flames out here, 2 a.m. the fire department got a call there was a fire. when the crew arrived they realized they were going to need more help. the fire was burning in a canyon closer to the what know that -- winona side of stern grow. fire department not giving specifics there was a homeless encampment nearby. firefighters did tell the cameraman on the scene they were looking for someone they wanted to make sure that someone was okay. certainly sounds like they believe a human was at the center of this fire and they were looking for that person. they did not find that person. you can see flames in the leaves, stayed on the ground did not get up to the trees. one acre was burned. take a look at this, last week stern grove launched its free outdoor summer concert series that just kicked off, celebrating 75 years they have a lot of performances in the outdoor ampitheater. 14,000 people typically show up for those events. that

i'm katie marzullo in for eric thomas. >>> and i'm kristen sze. parents of an oakland elementary school are camped out now determined to force the district to reopen their school this fall. sue thompson is live at lake view elementary. >> reporter: good morning. this protest is now entering into its fourth day here at lake view elementary parents are not happy with the district. been camping out for the last four days 20 or so tents continues on people angry that oakland elementary school has been shutdown. demands of parents took center stage over the weekend with a rally. they say their request is simple, reopen lake view. they say they will not go away until that happens. the district says the school and four others were shutdown because of budget cuts and declining enrollment. lakeview elementary the district says is slated to become administrative offices. parents say that won't happen without a fight. families say the money is in the district. they have the money to keep the school open and they feel they are targeted because the school cons
