i'm katie phang. we begin today's show with new signs that the biden administration is working to end a labor strike that is grinding the auto industry to a halt. the white house this morning says advisor gene sperling and acting secretary of labor, julie su, are, quote, working the phones, and planned to be at the negotiating since early in the week. this comes after a third straight day of around 13,000 union workers across three states are off the assembly lines and on the picket lines. as the united auto workers negotiators try to hammer out a deal with gm, ford, and chrysler owner. there is a glimmer of hope. the unions singling other negotiations with ford, calling them, quote, reasonably productive. michigan state senator, valerie -- joins us. now valerie, it's always so good to see. you what are you hearing right now from your constituents in michigan about the strike? >> katie, i gotta tell, you this is energy like we haven't felt in a long time. there were strikes back in 2019 with the uaw,

katie phang, what do you think this says to donald trump? >> it says to donald trump i'd be nervous. not only did donald trump create an environment where these are participants. but he created an environment where now people have been indicted alongside him. because in the january 6th case, you see him standing alone with six unindicted co-conspirators and they had a sigh of relief. but when fani willis brought these charges through this grand jury indictment we saw a few weeks ago, the people that were in his orbit, they got indicted too. they were active co-conspirators that had their own criminal liability. i would be nervous if i'm donald trump because now as i noted, there are a lot of people who are going to be witnesses against him. these are people that have been privy to conversations. so these are people that have been in his inner circle that were a part actively of what he was trying to do, thwart american democracy. lindsey graham hasn't been kicked to the curb yesterday, giuliani is in there. >> flynn. >> exactly. boris epshte

all i'm katie phang. we begin today's show with the government shutdown becoming more likely with each took of the clock. what's becoming even more obvious as the republican house majority doesn't have a game plan to extend government funding passed a critical deadline of midnight tonight. president biden says that gop house speaker, kevin mccarthy, made a terrible bargain to retain power over his caucus. scarred by radical republicans who are hard-line holdouts. as mccarthy tries to get a handle on his own -- he faces political gridlock and failed deals from both chambers. and just about five hours, the senate is expected to take up a vote on a stopgap spending bill to keep the government open to november 17th. that appears to be destined to fail in the house. yesterday, a separate gop stopgap bill filled miserably on the house for. they averted a shutdown and adding federal reports. it's not just those employees, we all will pay the price if the house can't do a job, says president biden. >> the house f

i'm katie phang. we begin this morning with the latest on the catastrophic, 6.8 magnitude earthquake and morocco. as of this morning, officials report more than 2000 people are dead, and more than 1400 are injured, and remain in critical condition. this is the most powerful quake to hit the area and marrakech and more than 120 years, according to the u.s. geological survey. while rescue teams struggle to reach affected areas blocked by debris, president biden says the united states stands ready to provide assistance with relief and recovery efforts. nbc's raf sanchez has more details. >> we are in the mountain village of malay where about 30 miles east of the epicenter here, throughout this village, you can see homes that are either completely destroyed, or, or like the one behind me, partially collapsed, and danger of total collapse, no longer safe for families still live in. this village was home to about 3000 people, but locals say that's some were killed on friday in the first hours of the quick.

legal contributor and host of the katie phang show, and ankush fatory. boy, this was a fascinating couple of hours. into the peeling back the american judicial system, and lisa, unpack some of that for us. what is it that we saw today? and there are so many issues they talked about which are legalease, obviously, but maybe all of us could help dissect what they meant. what's your big takeaway? >> my biggest takeaway, jose, is that the american people are learning by paying attention to the trump proceedings, how different the federal system can be from state judicial systems. they saw that first in the georgia statute that allowed ken chesebro and sidney powell to demand a speedy trial by a time particular. the georgia statute says you can demand that trial within the court term in which you're indicted. in fulton county, court terms are two months long. they had a right to demand a speedy trial by november 3rd or 5th. the next court term starts on the 6th. everyone is in agreement on that. the other thing we saw today was the second way it's really diff

msnbc's katie phang was there. what was your big takeaway, katy? >> the hearing began with all of us wait to go see if jeff clark was going to appear today in federal court behind me. jeff clark did not appear, and that created a snafu at the beginning of the hearing. the judge asking whether or not clark waived his right to appear. his lawyer indicating he didn't realize he had to file the waiver. the defense got up and basically made argument, did not present evidence, and the reason that's critically important for our viewers to understand is because the burden is on the defense when they're attempting to review their case from state court to federal court. it was an evidentiary hearing that was supposed to take place today, and an argument by lawyers is not by definition evidence. the state of georgia getting up and basically presenting their case through the form of assistant attorney general, jodi hunt. you may recognize that name. he was the attorney representing cassidy hutchinson when she secured new counsel to testify before the january 6

, former florida prosecutor, msnbc legal contributor, and host of the katie phang show right hereuo. we like to bring you together. let's start talking about this attempt to get a stay. mark meadows playing for time. how likely is it that he'll get a stay? >> it's very unlikely because he does not have a case. he's trying to get the case moved from state court to federal court. and he's trying to get it dismissed. so he gets it removed if he can prove that he was carrying out federal responsibilities and that's the subject of the criminal charge. last week, a trial judge told him in no uncertain terms he had no federal business in georgia. under the constitution, administering elections, that's a state responsibility. president trump had nothing to do with that. that didn't stop him, as we all know. trump threatened those election workers. and these motions, again, it's really donald trump who is being implicated. fani willis loves the part of this where the defendants are demonstrating it's every woman and man for themselves. it's not like 19 people versus fani willis. they're al

. >> with us to talk about all of this, katie phang, msnbc legal contributor and host of "the katie phang show," and garrett haake. kenneth chesebro and sidney powell got their speedy trial, but were unable to separate their cases. what could that potentially mean for all the other defendants? >> well, to your point, jose, kenneth chesebro was desperately trying to convince judge mcafee yesterday to make sure he didn't have to sit next to sidney powell during his trial that will begin on october 23rd, both filing demands for speedy trials. the judge was required to set the them as quickly as he did, but what do you do with the remaining 17? as you look at the screen, there is 19 in total, the other 17 have not filed demands for speedy trial. some of them have filed motions to sever, however, donald trump included, saying he does not want to go to trial with any of the speedy trial defendants, again, only being kenneth chesebro and sidney powell. you did play some of the sound from the judge yesterday and it was important to note that the judge said logistically speaking there is not enoug

with us now to talk about all of this, katie phang, msnbc legal analyst and host of the katie phang show, and nbc news justice and intelligence correspondent ken dilanian and dave aaronburg, state attorney for palm beach county, florida. what are we expecting in court this afternoon? >> so, jose, at 1:00 the presiding judge scott mcafee has asked that the d.a. fani willis appear to be able to give a good faith estimate of the amount of time it would take to try all 19 co-defendants together in the fulton county rico indictment. now, let's note, there is currently six defendants who filed motions to sever their cases. some of whom don't want to actually be tried alongside any of the co-defendants and then there are a few that demanded a speedy trial. kenneth chesebro and sidney powell. kenneth chesebro has a trial date of october 23rd, the first to go at that. the judge also asking fani willis, please come prepared to describe the witnesses and the exhibits, the amount of time it would take if we were to break off and try some of the defendants separate and apart from the group in total.

katie phang joins us in a moment to explain what she heard and why it was likely a bad idea that clark didn't show up in person. >>> we are waiting for news out of d.c. judge tanya chutkan will be ruling whether to impose a gag order on the former president of the united states. special counsel jack smith's team says it's necessary because donald trump just won't stop saying quote the defendant's relentless public posts marshaling anger and mistrust in the justice system, the court and prosecutors have already influenced the public. the specific post smith is referring to in a moment, but let us start on the ground in georgia. joining us now as promised from atlanta, nbc news legal contributor, and msnbc anchor, katie phang, msnbc legal analyst, and former u.s. attorney, barbara mcquade joins us, along with msnbc legal analyst, lisa rubin, a lot of smart people starting us off. katie, you were inside the courtroom, the judge had thoughts about jeffrey clark's request. walk me through what he said and what you take from it? >> so we were all waiting to see if jeffrey clark was going to

and katie feng, msnbc legal contributor and host of the katie phang show. she was a former florida state prosecutor into counties with an extensive felony trial experience. that makes her a good one to ask these questions to. i will go fast -- meadows has already appealed, and help us break down the judges decision. >> look, just or judge steve jones did exactly that. in hours of testimony, meadows trying to plead his case to have him move out of fulton county, where he likely thinks a more friendly jury pulled that of the mostly democratic jurors in fulton county. he failed to prove that the work that he was allegedly doing, that words that he was indicted, i'm trying to pressure state officials to overturn the election results in favor of the former president, including a call that he was on with brad raffensperger, the top election official in that state with his former boss. and he failed to prove that he did that, and according to his job description as a white house chief of staff. he did admit, according to the judge, plenty of times that he did this

let's go right to nbc's katie phang who was in the courtroom and is joining us now from atlanta. march was the original start date proposed by the district attorney, but that bumped up to october when chesebro and powell asked for a speedy trial. as of now, does this october 23rd trial start still stand? >> reporter: oh, absolutely, ana, under georgia state law when a demand for speedy trial is made by a criminal defendant, it has to be honored by the court. there's a very tight window of time in which the trial can commence. trial commencing means we bring the jury in. we go through the process of jury selection. this isn't just let me set the date and maybe get to it later on. the real challenge for scott mcafee is going to be the balance of those defendants. let's be clear, it's not going to take a lot of tea leaf reading to say you're not going to see all 19 defendants going to trial on october 23rd. it's let's get the kenneth chesebro, sidney powell trial started, but what do you do with the remaining 17? and the concerns you heard and that you played for your audience durin

correspondent garrett haake, and outside the fulton county courthouse for us, nbc legal contributor, katie phang. i was surprised how quickly he denied the motion to sever from kenneth chesebro. >> reporter: we were pleasantly surprised to see how quickly judge mcafee ruled. ruling from the bench not that often but especially in a case like this. he's under a quick time line. october 23rd, a little bit over five weeks away and as the judge indicated in court today there's a lot of stuff that has to get done. pretrial motions, et cetera, not to mention the fact that he's awaiting a ruling from federal judge steve jones in terms of whether or not the removal defendants specifically mark meadows is going to actually go to federal court, and that dove tails with one of the biggest questions that was asked of all counsel, specifically, the state indicating we're ready to go to trial with all 19 defendants, your honor, if you're inclined to sever just chesebro and powell, it's the same amount of time, four months. it's the same number of witnesses, 150. why? because they said quote, evidence against o

katie phang, we're going to start with you. you're down there in atlanta. know, the judge is basically saying, hey, i appreciate the effort. i don't think you're going to be able to do this. what are some of the potential roadblocks here? i think it's reasonable to say that trying 17 people at the same time could be tough. what are the concerns from a legal standpoint about that? does he feel that the case would get jumbled? does he feel that people who are guilty would end up getting off? what's the real concern there? >> reporter: yeah. so jason, that's a real good question and actually didn't get that deep. it was kind of interesting exchange that was happening between judge scott mcafee at the state of georgia as well as defense attorneys for kenneth chesebro and sidney powell. it was kind of who is going to blink first? i got to give credit to da fani willis' team put the best of the best that she could in front of judge today to basically say, judge, we're ready to go. we're prepared to do all 19 defendants at one time with more than 150 witnesses. it

. >> i want to bring in msnbc host and legal analyst, katie phang who was inside the courtroom for the entire hearing. she just got to a camera. we all saw what happened. it's different being inside the room, feeling it, being able to watch all of the people. give us your impressionings, first of all, being in the room as well as your legal take aways, katie. >> reporter: it was an impressive show of force. the state of georgia being represented by eight attorneys, four of which sat in the first row of the courtroom, four of which sat at counsel's table. one is a gentleman by the name as john floyd, known as being an expert in rico. he did not make any of the oral arguments but you can bet your bottom dollar he had insight as well as a part in the preparation for today's hearing at counsel for the defense, you had two lawyers on behalf of kenneth chesebro, they tried, they as in the defense attorneys, tried to put together, as much as they could, but trying to keep themselves apart in terms of their interest, an argument to the court, to make sure that their cases were tried separate f
