kcbs radio's matt bigler explains what happens next. he joins with us more in san jose. matt, good morning. >> reporter: hi, frank. good morning. let me tell you what we know about this shooting that happened sunday afternoon. officers responded to an area in east san jose to reports of a man waving a gun. when they got there, they found the suspects behind the wheel of a stolen car. according to officers that suspect proceeded to ram one of their patrol cars. two officers then fired their tasers at the suspect. and then according to officers they thought he was pulling a gun. he was going for some sort of a weapon. that's when a third officer fired three shots at the suspect killing him. he has been identified as 32- year-old [ foreign name ]. his family has filed a complaints alleging officer miss conducts and excessive force. that complaints went to the independent police auditor ladoris cordell. judge cordell told kcbs this morning that all these allegations of officer miss conducts are investigated promptly. >> these complaints are investigated by the internal affai

let's check in with jason brooks with kcbs and cbsmoneywatch.com.opefully customers too, right, jason? >> reporter: good morning. i think netflix got the message that subscribers, investors, pretty much everybody out there wasn't too pleased with the company announcing it was splitting off its dvd rental business from its streaming bills. the dvd rental business was going to be called qwikster bundy netflix is going to kill that business and keep things the same. netflix got the message when it rolled back the hikes to subscriber fees for the combination fees which went up 60% at the beginning of september. netflix' shares in just the past month have lost almost half of their value. in fact, they are down about $200 in the past three months. so they really need something to get going in the right direction. netflix shares right now as i look at my screen are up a little over 6% so that's a good move for the company. >>> a bit of an underwhelming response to the apple iphone announcement last week. most were looking for an iphone 5 featuring new hard

so jason brooks with kcbs and cbsmoneywatch.com is breaking it all down for us. jason, big rally. >> reporter: they reached a deal in europe so there is a big party on wall street as a result. we showed that you graph, the dow over 12,000. hasn't been over 12,000 since august 1. it's on pace for its best month of october ever for the blue chips. it's up 11% for the month so far. that would best a 10.7% gain back in 1982. all about europe today. european leaders coming together and coming up with a rather large plan to attack the ever worsening sovereign debt crisis there getting banks to accept 50% losses on their greek debt holdings while also inflating a special bailout fund in europe to $1.5 trillion. this is a near term solution. there are some fundamental issues facing europe going forward over the next several years. first off, these various governments in greece, portugal, ireland, italy and spain, they have to encourage their people to go along with these deep austerity moves and cuts. that's going to be a challenge politically going forward. on top of th

here to talk about it jason brooks with kcbs and cbsmoneywatch.com.uess the market is responding. >> i think there's no other way to put it. the market is absolutely enthused that european leaders basically came up with a bazooka to tackle the ever worsening debt crisis in europe. private investors on greek debt will take 50% losses to help greece restructure itself. they are expanding the bailout fund in europe to 1.5 trillion dollars to handle the issue going forward. this is just a near-term solution maybe giving europe a couple of years of breathing room. still some fundamental changes need to occur to ensure this won't continue down the road but nevertheless the markets very excited about that. also getting some help from of all things the u.s. economy. turns out that the economy grew by 2.5% in the 3rd quarter. nearly doubling the pace from the 2nd quarter. and tripling the pace for the first half of the year. consumer spending helped out. rising about 2.5%. that also tripling the pace of what it did in the 1st quarter. let's look at the stock m
