kennedy. kathleen kennedy townsend, thank you very much for being with us here on c-span. >> good to be with you, steve. >> joining us here in washington is michael cohen, the author of the book "american maelstrom: the 1968 election and the politics of division." coming out in paperback later this year. let me begin with you. president lyndon johnson, a key political figure in what we're talking about. what was his standing as the year began? >> johnson was in a tough political position, the war in vietnam had become a stalemate. there was a growing opposition to the war within his own party and also on capitol hill. in general, popular support for the war had dipped. so he was in a tough position. he was facing a primary challenge within his own party for the nomination. for renomination of eugene mccarthy and then at the end of january, the tet offensive occurred. that's a moment, the end of johnson's presidency in some respects politically. it showed that the administration was lying about

>> i was always surprised given that justin kennedy -- justice kennedy was so long on the bench. i thought that the time i was there he would have had his opinion set. i was surprised that he would read closely these amicus briefs. the court could get 10 or 20 or 50 briefs. would show up and say, did you see what's so it is so 16 of this break. i would say, justice i have not gotten to these brief set. -- briefs yet. not bestly would controlled by any sources but i think he thought they were all ballot to look at. the court received a lot on this next case. -- the court ruled that detainees have the right to appear in front of a judge and know what they are being to pain for -- chief among these are freedom from arbitrary and unlawful restraint and the personal liberty that is secured by here is to the separation of powers. it is from these principles that our opinion does not undermine the executive's powers as commander-in-chief. the exercise of those powers as indicated -- vindicated, not eroded, when confirmed by the judicial branch. within the constitution's separation-of-po

you engage with justice kennedy. justice kennedy was not into long memos. i would just like to sit and talk about the cases, and we would do a memo, but just a brief, two-page memo of everything justice kennedy had read. and he just wanted to talk about what the principles were, what the president -- what the precedent was set on them, what had been done in recent years. and justice kennedy was interested in these big, teutonic like -- titanic like cases, what was this fact, what was that fact during trial. so i would go through with him and discuss at length, and it was just an incredible experience. i would have justice kennedy in mynto an easy chair chambers, and i would have to pinch myself, my gosh, i am talking to justice kennedy about this case. it was just an incredible experience. host: why do you think it mattered to him to know the details of particular cases? ishan: when the case is reached the supreme court. it is really on the individual case. that frames that particular -- that frames justice for that particular person. and justice kennedy wa

that is where justice kennedy came out. it was not easy to get there, from the government perspective. i was there at the time. we are about guantanamo bay, not within the u.s. aboutare often questions how the constitutional provisions provide outside the u.s. do they provide outside -- do they provide outside the u.s. at all? we have military bases in cuba and everyone admits that cuba is sovereign over the territory. how do we say that the risk of habeas corpus applies? justice kennedy wrote this opinion that was pragmatic to say that maybe not as a de jure matter, but as a de facto matter, the u.s. has control over when time obey -- one time guantanamo bay and it was a critical point at where we were in the war on terror and the government perspective. abilityt recognized the to challenge detentions and it can't change the cases we would see to come in the d.c. circuit. eventually coming back to the supreme court. this is going to be something where the court would make clear it was going to play a role. >> your thoughts

kennedy: shrapnel. i hope they are wearing eye wear. >> a lot of people are going to give up in the middle of it. when i was a kid, i hated putting together models. i used to do the planet of the apes models. even i got bored doing it. i had my dad do all my models which is kind of sad. putting 3d in front of something makes something seem so much different. and fascinating and scary. kennedy: people will go to king kinko's. they said we'll sue you and we'll win. this is a first amendment issue. we have every right to put this out. >> the instructions to make an actually competent gun are already out there. i think even "reason" magazine ran an article on how to make your own gun. it was in their last issue. they used readily available materials off the internet. kennedy: your book is fantastic. monologue from "the five." there were parts of the monologues you didn't like and you left them in there and you aided some notes. >> there is more commentary in this book than monologues. i look at some of the

kennedy: how do we do it? it's better for us, it's better for them, it's better for the world, it's better for peace if their government is overthrown. we don't want regime change and another theater opening in the middle east. how do you do it other than wishing and hoping? >> i want regime change. i just don't want regime change at the point of one of our guns. but i would love it if there was a revolution from within that overthrew the mullahs and the revolutionary guard. i would love it if they had a democratic popular uprising to get back to being a regular country. you delegitimize the regime by not cooperating with them to continue on the path of exporting terror over their neighborhood. if they lived up to the deal becoming a normal country, you wouldn't see runaway inflation and all of these protests. kennedy: what have we learned not to do with north korea and iran? what are some of the lessons. here is what not to do. applying those lessons to north korea. meaning is it imperative that we do not eas

to me, anyhow, bobby kennedy was not jack kennedy. he didn't have the charm, the charisma, the centrism. he had moved to the left, was anti-war, very sharp endged. i always felt that even after california when bobby kennedy won, that when they got to chicago, that humphrey would take it, that humphrey -- he had the machine put together for him, he had the president behind him, conlnolly and all these folks. i did not know that he was that apprehensive that he could not beat robert kennedy. >> it's a what-if, we know. >> when bobby kennedy died on june 6th, hubert humphrey had already amassed over 500 delegates, robert kennedy 393, eugene mccarthy 258. humphrey had labor, he had the rank and file of the party. it's unlikely that even if robert kennedy had lived, he certainly would have been beaten gene mccarthy at the convention. also remember how devastated he was that johnson wasn't going to run. i understand that meeting after johnson announced, johnson went before he announced and went to that apartment to tell him, he was in tears

so had john kennedy. we brought him into new hampshire for two days, maybe three days, and then fly to key biscayne where he could relax, and then take it easy and go into wisconsin. we paced him very well. we knew it was a marathon. it was just tremendously well advanced. we were up there whipping everybody to come out and look how many came out voluntarily, et cetera. we had a terrific crowd, 3,000 people, and that was the kind of event nixon wanted to do. >> and barbara perry, that exchange, by the way, with a world war i veteran, and he makes mention of vietnam. clearly that was the driving issue of 1968. can you explain what was going on here in this country, how americans were viewing the war and why they were turning against president johnson? >> we mentioned the tet offensive. that was in january of 1968. i'm glad, actually, there are no videos of me from 1968, but i will say that i was a 12-year-old in the sixth grade. my brother was ten years older than i and graduating from college, small catho
