kevin mccarthy is grasping with two major challenges. one is theon immediate physical threat to himself and his members, and the possibility of more violence in the u.s. capitol and he's worried his own members may incite more violence. the other challenge is a political one. it is how do i rescue my party from what is going to be a huge challenge to us going forward, namely our outgoing president being blamed for an insurrection. hearing his voice in real-time kind to grapplewi with both of those threats and in doing so he's throwing all kinds of ideas including is there a way we can get the president removed from office before january 20? does that mean having him resign? does that mean invoking the 25th amendment? does it mean impeachment and conviction? how do we get this done? it's a window into the panic in the hours and days after january 6th. >> host: let's play a portion of some of the audio conversation that kevin mccarthy had like five days after january 6th and then alex burns will get your comment on it as well. >> later aft

what's more are you trying to obtain from kevin mccarthy through testimony? >> well, you're right, we do know a lot about this. but most of what we know, much of what we know, we are here secondhand. and of course, no one would be better position to testify about conversations that he had with donald trump than kevin mccarthy. and indeed, he's making reference there to what he would tell the president. what's in fact did he say over the phone with the president? what was the president saying to him on january 6th, we are hearing from other members as we did earlier from -- butler that the president irritated with mccarthy when mccarthy was begging to call it off said these people who are attacking the capitol apparently care more about the election than he does. or worse to that effect. so there is a lot we would like to ask mccarthy. these other members we subpoena today, some allegedly involved or were involved in seeking pardons. why do they think parties would be necessary? or were involved in an effort to overturn the election that they -- judge of calif

if i had the chance to question kevin mccarthy, the first question i would ask is wrong and atrociousg in this is why kevin should testify. he's not been subpoenaed by the january 6 committee. they asked him for his testimony. he's declined preponderance of the evidence unless and until they subpoena, we likely woepts hear from kevin mccarthy. he had an obligation to testify, as a minimum, as a witness. he had a clear vision of donald trump's conduct. >> another recording. we hear him talking with an aids who brings up invoking the 25th amendment against trump. watch. >> i think the options ta have been cited by the democrats so far are the 25th amendment which is not elegant solution here. >> that takes too long too. >> correct. if the president were to submit a letter over ruling the cabinet, it's kind of in our -- impeachment has been discussed. i think they want him to resign which i don't see happening either. >> the 25th amendment was under serious consideration. his only consideration is it would take too long. sd >> the 25th amendment provides for temporary removal of a presid

kevin mccarthy, for example, told republicans privately that donald trump had actually admitted someesponsibility for the attack and it's obviously very different than what we heard publicly. but, look, none of them have said whether they would comply yet with the subpoenas, i think they have offered some hints, they've called this a witch-hunt, illegitimate. let me read you what kevin mccarthy told us yesterday, he said my view on the committee has not changed, they are not conducting a legitimate investigation, they just want to go after their political opponents. so it seemed pretty unlikely that they're going to comply and the question becomes how does the committee enforce these subpoenas? they could refer it to the doj for a criminal referral, this he could make a referral to the ethics committee which doesn't have a lot of teeth, but so far the committee is keeping a tight lip about what the next steps are. >> that seems it would take some time to have that fight, we are six months out from the midterm election so that obviously is a factor. that definitely does not sound like

republican leader, paul kevin mccarthy, will defy a subpoena to testify before them. mittee is not legal or constitutional valid, despite this argument having been rejected by numerous courts. mccarthy has acknowledged that he spoke with trump on the day of the insurrection. the committee must now decide whether to refer him to the doj for contempt charges. whatever happens will affect how the other gop lawmakers will respond to their subpoenas. all this comes as political reports then chief of staff, mark meadows, a burned papers in his office after meeting with a house republican who is working to challenge the 2020 election. this is according to a former employee who spoke to the committee. for more and all of this, we're joined by legal analyst, kirschner, who host a podcast called justice matters. it is a treat to have you again. let's start with the mccarthy news. it seems hardly surprising that mccarthy will say he will likely defy the subpoena from the january six committee. should the committee and will the committee, refer him to the doj for criminal prosecut

think they want him to resign, which i don't see that happening either. >> just a reminder that kevin mccarthyt mar-a-lago this week, right? trump calls him speaker mccarthy. what we're seeing is this two different kevin mccarthys and i wonder if he gets away with it. >> well, clearly he does. trump has forgiven him for now, part of the reason is because since that moment, kevin mccarthy has done everything to get back in trump's good graces. but that audio is really striking to me because he is shooting down the idea of the 25th amendment, not because he doesn't think trump doesn't deserve it, he says it would take too long. the same with impeachment. in audio, he talks about how he doesn't think impeachment is the right option, it would be too divisive for the country. he says what trump did was absolutely atrocious. very different than the kevin mccarthy we hear today. >> the audio indicates he's already moving on, he's moving on to president biden who is about to be inaugurated. he says in the audio he hopes for a smooth transition of power to president biden. so is there any sense of any

kevin mccarthy is going to try next. the larger issue is trying to govern a caucus that's ungovernable as we get the book, which is out tuesday. this is a party now which is just very difficult to contain, and trump obviously is a huge driver of that. >> there's also just such a difference between being house speaker, and being a powerful house speaker there's no telling right now whether he is for sure going to be able to continue -- you know, maintain the support that he seems to have now, become a house speaker eventually if republicans take the house. but there are real questions about what kind of power will he have as the leader of the conference. he's going to be potentially more be-holden to donald trump, than he has been in the past. he might also feel like he owes certain things to members of his own conference. and then i think, not to be, you know, underreported, is sort of the dynamic that this -- all of this reporting has created between mccarthy, and members of the media that cover him day and and day out

and if kevin mccarthy was ever speaker of the house, there is no backstop. there's no integrity that would check against him going all in with the next coup attempt. >> congressman, you were at the capitol on january 6th. what questions do you want answered during the committee's public hearings next month? >> there's a real gap around what donald trump knew, as far as potential violence, and the days leading up to it. we know that he incited that violence because he said just 20 or so days before the attack, that it will be wild. and yet, you have to come fight for your country. you won't have a country anymore. but what's requested he receive about warning of the proud boys and the oath keepers and the other violent groups. what's funding that he and his allies provide? and of course, during the attack, what did he know, and what did he not do that could have saved more officers from the injuries they suffered, and our democracy from nearly losing everything? >> congressman, what do you see as the stakes of these hearings, both for democrats, republicans,

minority leader kevin mccarthy of california. and of course, that is the guy who is poised to become speaker of the house, should republicans win the house in the midterm elections. they also issued subpoenas for four of his colleagues, and in fact, their colleagues. jim jordan of ohio, mel brooks of alabama, andy biggs of arizona, and scott perry of pennsylvania. the latter four in particular are largely believed to have been key players in the ex presidents plot to overturn the 2020 election. in case it is not clear, this is obviously a really, really big deal. we sort of dug back through the history here as far as we can tell, this appears to be the first time a member serving in congress has been subpoenaed by congress outside of an ethics investigation. let alone the man gearing up to be speaker. and for months and months, house democrats have been trying everything to avoid getting too precise at this point. which is why it is worth looking back at just how we got here. in the days after the insurrection, it really seemed l

i think especially for mccarthy in the wake of the tape made public of kevin mccarthy talking about possibly after january 6th. i think mccarthy is going to have to dig in here in his mind. he clearly knows a lot and he doesn't want to talk about it and i don't expect a lot of voluntary cooperation. >> this certainly does put congress in some uncharted territory as jamie just said. it's unprecedented what they're doing. will the select committee have to make some very tough choices about how hard to pursue their testimony? >> i think they will, wolf. i think they're going to have to, you know, look at whether they want to try to keep fighting if these guys resist these subpoenas. it's the likeliest outcome. if these guys decide to dig in and not comply with subpoenas from their own colleagues, the own body they serve in, then the committee is going to have to decide how hard they want to push it. as jamie said, this was not a decision that was reached lightly. it took the committee a long time to get here, but i think you're seeing across several fronts, this committee as well as the departm

it is very important to note kevin mccarthy has been heard on tape talk about how to get trump out of office shortly after the riot. he then ran off to mar-a-lago and meet up with trump. today, mccarthy was on the hill feeling questions about these new subpoenas. he and a few other republican targets were defiant and dismissive. >> my view on the committee has not changed. they're not conducting a legitimate investigation. it seems as though they just want to go after -- >> the fact that they sent it to the press before they sent it to the members is just prove that it's about headlines. >> i think this is an illegitimate committee and they do not really have the authority to issue subpoenas in my opinion. so we do not want to dignify what they are doing. this has been a witch hunt from day one. >> in my opinion. several federal judges have already ruled on the committee's legitimacy, and today the chairman and his colleagues made it very clear that they have the right to resort to subpoenas. >> i think the committee believes that we have the authority. and we felt comfortable enough
