kpix 5's kiet do joins us live from the bay point with the very latest on that fire. good morning, kiet. >> reporter: good morning. still a very active emotional scene here on anchor drive in bay point. a lot of people evacuated now. many of their homes damaged. people in tears trying to figure out and worry about what they will do next out here in bay point. now, this all began at 1:00 a.m. when a minivan caught fire in a driveway off anchor drive. witnesses reported hearing explosions and at that late hour, firefighters think it burned for quite some time before anybody noticed. the fire then jumped to a house and then heavily damaged it and then spread to three more houses. a lot of folks are in bed and by the time they tried to escape, there was a lot of smoke and flames. many of them had to run past the house that was fully engulfed and had smoke inhalation. one man had burns to his back and went to the hospital. all injuries are minor at this point. contra costa county fire marshal robert marshall says the high cost of bay area housing might be a factor in all of

kpix 5's kiet do is live this morning with more on possible new regulations. kiet. >> yes. good morning. later today the state will vote and likely pass these new fuel standards. the governor says when it comes to fighting climate change what we need is historic virtual. if it passes it will be the first of its kind in the nation requiring a 10% cut in carbon emissions on transportation fuel sold in the state. it must happen by 2020. here's the rub to the oil industry. not only does that 10% cut have to happen with the fuel but it applies to the factories and oil rigs. it even applies to the tanker trucks used to deliver the fuel to gas stations everywhere. it's dubbed as a cut that applies from the, quote, wheel to the well. oil companies that fall below the baseline can sell credit to other companies. the idea is to encourage greater use of biofuels and electric vehicles. all of this of course will likely raise gas prices for drivers by a few cents per gallon. that amounts to roughly a extra 5 to $21 a year by the 2017. and by 2020 you will be paying an extra 12 to $48 a

kpix 5's kiet do joins us live with that new proposal. hi kiet, good morning. >> reporter: yes, good morning. san jose rent has skyrocketed. it has gone up by $1,000 or 77% in just the span of six years alone. the average rent for a one bed one bath now starts in san jose at $2,300. a month. and so today the san jose city council will begin studying ways to try and slow that down dramatically. with a proposed apartment rent ordinance. now among the ideas, reduce allowable rent increases to just 4% a year. also, they're looking at a good cause eviction rule to try and protect tenants. now rising rent has forced people to move out of san jose and into outlying areas and make the commutes really long. landlords and property owners however argued that it reduces money for them for maintenance and upkeep and also discourages new development. now the current city ordinance does not allow rent control in any building built after 1979. >> rent control is one of many different ideas being looked at right now. as a way of making sure that people can

kpix 5's kiet do reports from san jose where the arraignment happens today. >>> reporter: good morning. those three deputies will be bused into court today from alameda county where they have been held in protective custody because it is simply too dangerous for them to stay here at the jail where they work. later on today we get a first look at the three men as they have arraigned. the sheriff has recommended murder charges. but that decision ultimately is up to the district attorney. the three, rafael rodriguez, jereh lubin and matthew farris, only rodriguez gave an interview telling the "mercury news" he didn't do it and doesn't know how the inmate was killed. james tyree was found dead on august 27. he had lacerations to the spleen and liver and died of internal bleeding. the deputies were conducting a routine clothing search with the other inmates locked in for the night. sources say the deputies became violent when tyree refused to take his medication. investigators say there is surveillance video showing the three deputies entering tyree's cell about an hour before he was found.

kpix 5 reporter kiet do joins us in san jose with more on the state's brand-new program. good morning, kiet. >> reporter: good morning. it's called ticket amnesty designed to help people who are have fines and penalties that are spiraling out of control. 5million people have had their licenses suspended because they got a traffic ticket they couldn't pay and hundreds of thousands of court files on top of that. the amount of unpaid traffic tickets in california is more than $10 billion. legal aid has been calling it a civil rights issue because it affects poor minority drivers. critics say it's a vicious cycle because without a license, offenders can't get to work to earn money to pay off the fines which result in more fines. >> people have parking tickets and i know that it's like overwhelming because some of them don't have jobs. with that, i mean, it helps out a lot. >> reporter: the amnesty parameter only applies to tickets before 2015. all fines will be reduced by 50%. if you can prove you are low income then fines are reduced up to 80%. this does "not" apply to reckle

kiet do is in santa clara, where the sheriff is expected to hold a briefing. kiet. >> reporter: sheriff lori smith expected to hold a press briefing at 2 p.m. and do something never done before for the history of the agency and that's recommend murder charges against three of her own correctional deputies. we are hearing that one of the deputies self surrendered here at the headquarters through a back door. the others were arrested at home. sources say at least one of the deputies had a history of using excessive force. last thursday, 31-year-old michael james tyree, a white man transient was found dead in his cell. the sources say the sheriff's investigators became suspicious when the coroner revealed the inmade had died of massive internal bleeding consistent with being beaten. the following day the sheriff's office wasn't releasing much information but there were many election to reporters from anonymous sources and as a result, watchdog groups began to pressure the agency and calling for more transparency. >> the slow information is creating tension and dis

kiet do reports from sunnyvale. >> reporter: this controversial plan to reduce el camino real down fromhas cleared a major hurdle. an audit is done and it says surprisingly doing so will not delay drivers on el camino real itself. the vta has some computer animation that it released a couple of years showing what the 17-mile stretch would look like from palo alto to san jose. they would install dedicated express bus lanes going right down the middle of the road. passengers would board on medians and bike lanes would be added in each direction. now, planners say it could cut bus travel time in half thereby encouraging more people to ride it. the audit found about 900 vehicles per lane would find somewhere else to go. mostly diverting on to page mill road at oregon expressway, alma avenue in palo alto and san tomas expressway in santa clara. yes, traffic will get worse in those areas. but the report said people will adapt by traveling at less congested hours or maybe even ride a bike or take the bus. the study now advances to a policy advisory group. if it wins approval there it could be

kpix 5's kiet do on the text messages that were used against the officers. >> reporter: the judge set the bail for each guard at $1.5 million saying the prosecutor did not prove they were a threat to public safety. we finally got our first look in public of these three guards today in court. rafael rodriguez, jereh lubin and matthew farris appeared in shackles and jail uniforms that said alameda county. that's where they are being held in protective custody. they all face murder charged for allegedly beating a mentally ill inmate to death last month. michael tyree was found unconscious an hour after surveillance cameras captured the three deputies entering his cell. the coroner said tyree died of massive internal bleeding. the district attorney's office asked for a $10 million bail. each saying that the guards posed a threat to public safety because of some incriminating text messages sent about a month before the inmate's death: >> we don't know what the context was, what text messages came before though, after those or whether in fact they are actually even texts that trace directly

kiet do has more on the new program that could save you money. >> reporter: the governor signed this into law to help people out of what he called a hell hole of desperation under a mountain of penalties and fines. there are nearly 5 million people in california with suspended licenses because they got a traffic ticket they couldn't afford to pay and then hundreds of thousands of court fines on top of that. it's estimated that the amount of unpaid traffic tickets in the state is more than $10 billion. legal aid groups have been pushing for this calling it a civil rights issue because it affects mostly poor minority drivers. critics say it's a vicious cycle because offenders can't get to work to money to pay off the fine which results in more fines. >> sounds like a win-win. it sounds like great way to get your name off the list. it gives the state the money it probably needs for roads and bridges. so sounds like a good idea. >> reporter: the amnesty program applies to tickets only before 2013. all fines will be reduced by at least 50%. if you can prove you're low income, then fines c

kpix 5's kiet do tells us three officers have been arrested and accused of killing him. >> i want to express my profound sorrow. >> reporter: at an emotional news conference the sheriff conveyed her condolences to the family of inmate michael james tyree and condemned what she called a violent and cowardly act by three correctional deputies. matthew farris, jereh lubrin and rafael rodriguez were all arrested yesterday on suspicion of murdering tyree in his jail cell. >> each accused murderer was booked, fingerprinted and photographed at the santa clara county main jail, the very same jail where they are accused of taking the life of an inmate they swore to protect. >> reporter: tyree was found dead in his cell last thursday naked and lying in his own feces and vomit. a coroner report detailed multiple blunt force injuries. sources say video evidence showed the three correctional deputies entering tyree's cell where they are accused of beating him to death reportedly over his refusal to take his medicine. tyree was in jail for petty theft and drug charges. he was due to be released to

kiet do reports the family just moved into the home. >> reporter: it was a raging single home house fire that quickly went to two alarms here in the east foothills of san jose. take a look at some of the video shot by some neighbors on their cell phones. it shows a fire started somewhere in the front part of the house, possibly the garage area. the homeowners moved in a week ago and were doing renovations. at first they thought the commotion was a burglar so they called 911 only to find out the fire had engulfed the front part of the house. all four family members got out safely. the fire got into the attic and started making a run to the rest of the house but firefighters were able to cut it off. however, it looks like a good portion of the home is heavily damaged. here's the san jose fire captain to explain why they called a second alarm. >> we were trying to protect the houses around it. when the first engine got on scene, the house was fully involved. that means there was fire coming out of every opening in the house, and some openings were made by the fire. >> reporter: san jose fir

kpix 5's kiet do is live in san jose a city that struggled for years to figure out how to regulate marijuanakiet. >>> reporter: good morning. it looks like the haze may be lifting on statewide regulations on medical marijuana. there was a flurry of activity last night with lawmakers as they struck deals on a wide range of bills to try to rein in that industry. first off, they created what's called a bureau of medical marijuana regulation to oversee every aspect of the industry from cultivation to retail distribution. next, cities and counties still have the right to ban medical marijuana businesses. individuals will have the right to grow it themselves. the deal also addresses some of the environmental damage done by outdoor crops that steal water and pollute forests are chemicals. all these measures will be up for a vote today when lawmakers adjourn for the year. also up for a vote the "end of life option" act otherwise known as the "right to die" or wsisted suicide.

kpix 5's kiet do reports from san jose with this unusual legal case. >>> reporter: this case has gotten national attention and it has sharply divided a neighborhood in sunnyvale. if the judge rules in the plaintiffs' favor it could set a major precedent. neighbors are suing the family of an autistic boy to try to rule that boy a public nuisance. they say he hit, slapped and kicked their younger children when parents or sitters weren't around and the problem worsened over the six years the family lived there. the neighbors tried to work with the 11-year-old boy's parents who make sure he is properly supervised. one of the plaintiffs said it's not about autism. it's about public safety. >> a neighbor boy who has continually attacked small children including our own culminating in a brutal and vicious attack on my son's fourth birthday. >> reporter: the suit is seeking unspecified damages and an injunction to prevent future incidents. what's moshes the family has moved -- what's more, the family has moved out. neighbors are not dropping the lawsuit because they say the family can return at

kpix 5's kiet do joins us live out of san jose with the latest on that suspect. good morning. >> reporter: the suspect is duane guerro and is now behind bars here at the main jail in downtown san jose. not a whole lot of details yet about how and where it all went down. all we know is that aguero was arrested in san jose on august 27. it was made public yesterday. surveillance video caught the murder of christopher wrenn last month on lundy avenue. it appears the victim was surrendering with his hands up. he was killed execution-style. friends and family are expressing relief. >> i don't believe anybody should be able to murder somebody and get away with it. he was a good man. he didn't deserve tore murdered. >> reporter: the two other suspects in the case are both dead. each was fatally shot by police last month in separate
