kris? >> reporter: hi, marcus. the suspect did not have to appear in court today as the judge set that next date for november 28th. so pushing it out, the suspect waived his right to appear in person. this is jeffrey martinez. he is now in custody awatting trial, also charges of sexual assault of a 7-year-old little girl. it took 27 years for clues to lead to his arrest, and it happened because of a public genealogy database. the department of public safety investigators arrested martinez back in july, and since then, at least two more victims have come forward. when i was in the courtroom, his niece told me she and other families were there not to show support for martinez but to show support for his alleged victims. he is charged with six felonies including a v-8ed sexual assault and four counts of lewd or lascivious acts with a child under the age of 14. there could be more victims in the area of orchard neighborhood, cherry orchard neighborhood, in sunnyvale near matilda. the law allows victims to file suit unt

kris sanchez is in the south bay looking at the impact many are likely to see.st we want to start with meteorologist kari hall because you've been monitoring conditions. >> we are seeing smoke drift around parts of the bay area with some of the worst of the air quality settling into the south bay, and some valleys may continue to see a lot of smoke, especially this morning in santa rosa we are seeing unhealthy readings as well. anything over 150 is in the unhealthy range for everyone, but people who are especially sensitive to particulate matter, if you have breathing problems, you should limit your time outside. we are also seeing some of the numbers measuring really high for the south bay, with san jose seeing the measure of particulate matter at 189, which, once again, is in the unhealthy range. then we take a look at the weather setup, what brought in all of that smoke. we had an area of low pressure off to our north and east, and with this counterclockwise wind flow, it is pushing the smoke directly into the bay area from some fires that are burning farther

. >> kris sanchez joins us now. how is that conversation going? >> we've been listening in all morning long from long beach where students are planning to protest. we know at least one high-profile california state trustee came out against the tuition increase, tony thurman, who said this would be a setback for families and students facing inflation and rising homing costs. but they'd have to consider what would be the second tuition increase in 12 years in order to put the university in the black. he says csu plans more to run its 23-school system than it brings in. according to csu, 60% of students either get assistance with their tuition or have it waived all together, so it wouldn't affect them. trustee julia lopez points out that the real affordability issue goes beyond tuition. >> tuition accounts for proportionately 27% of the total cost of attendance. it's substantial, but they're not necessarily paying.it the o attending college, as we've often said, that are the really big hurdles. it's the housing, the transportation, it's the food. we

nbc bay area's kris sanchez tells us, this could set up for an interesting council meeting in a few hours. >> the san jose city council is holding its regular meeting today, so nothing on the agenda related to this incident. but as you may know, people can show up during public comment to address anything that they want. the downtown city worker is the one who witnessed what happened, and though she didn't want to be identified, she did capture it on video. that woman shared it with the local news outlet san jose spotlight first. it shows san jose city councilman arjun batra at the scene of the alleged crash. that was at san fernando and 4th street last wednesday. that's not too far from city hall, which is at east santa clara and 4th. the woman says he recognized the council member as the one out of his car talking with that man and then pulling out his wallet, offering money. now, we also have a picture of that man's bike, and not that it matters, but the man is unhoused. you see the rear wheel is bent. the council member denies hitting the man's bike but said he did have a close call w
