let's bring in rachel rubin, and kurt bardella is back with us.ual states. what could tomorrow's election mean for women in wisconsin? >> yes, thank you so much for having me. first off, so the state supreme court in wisconsin has had a majority of conservatives for about 14 years, and so right now there's an open seat, and this open seat is coming just as a lawsuit over an 1849 near total ban on abortion is making its way through the court. and so right now in wisconsin, there is, as you mentioned, democratic governor, democratic attorney general who have said that they would not enforce this law. however, providers have stopped providing abortions because it's on the books. and political observers, people in the abortion rights and antiabortion movements expect this lawsuit to make its way to the wisconsin supreme court in the coming years. >> and kurt, i think it's probably fair to say that across the country, frankly, state supreme court races have gotten little or no attention previously but democrats in wisconsin are describing this race as

joining me now is kurt bardella, democratic strategist and former house oversight committee spokesman, and mara gillespie, former aide to congressman adam kinzinger and house speaker john boehner, and sahil kapur, national reporter for nbc news. welcome to all of you. sahil, what was it like on the hill today, buddy? >> it's quiet right now, michael, but this has been a quite extraordinary start to the new congress. i have covered this place for the last 12 years and i have never seen anything quite so sluggish. i have never seen congress start off so slowly. it wasn't until today that committees were even organized. you had america's most powerful lawmakers sitting around twiddling their thumbs not able to hold hearings. in the senate, you had symbolic votes, multiple symbolic resolutions to take a stand against stalking, to take a stand against modern slavery that had no opposition, could have been passed by unanimous consent, but they held roll call votes for that. and in the house, republicans have a narrow majority. you'll see a lot of fights and drama, because what we won't see

. >> joining me now is democratic strategist kurt bardella and barbara mcquade, former u.s.ey, professor at the university of michigan school of law and msnbc legal analyst. barbara, i'll start with you. i was riveted by that interview because the forewoman seems like somebody who, like, won survivor but she's got to wait a couple month because of the nda, she can't tell you. just from your assessment, what is it like to see a foreman basically say, hey, there are surprises coming but you shouldn't be too surprised? what might that indicate about what the grand jury concluded? >> well, first, jason, as a former prosecutor, i cringe any time you see a grand jury foreperson talking about what happened before the grand jury. the grand jury secrecy rules to protect people who might be under suspicion. now, i think she probably complied with the letter of the rule, which says she's not supposed to talk about the grand jury's deliberations, so she was careful not to say who might be recommended for indictment or how that went down. but boy, she comes awfully close to that. it make
