he goes back to mar-a-lago. he's immediately to mar-a-lago and coordinates with carlos de oliveira. you have carlos de oliveira walking around in the tunnels with a flashlight, trying to locate the surveillance cameras. they know they have a real problem now, because the government knows about the cameras, and there's going to be footage of people moving documents and boxes of documents in an effort to conceal them. so, they embark upon, if you, know the cover-up is always worse than the crime. and that is exactly what seems to happen here. i should point out, also, employee for an employee five, i, mean these are people who are clearly providing substantial testimony to the government already. employee for, his conversation with carlos de oliveira, is laid out in the indictment. he has testified to that, that testimony is in the book, it will likely come up at trial. the very expensive efforts that the fbi has conducted here to interview everyone, associate with mar-a-lago, that work has paid off for them. they have uncovered some dip very damaging witnesses. >> what we really see

federal prosecutors subpoenaed mar-a-lago security

he is head of maintenance at mar-a-lago. how did he get wrapped up in all this? >> the boss wanted something done, right? what is so unique about this investigation is that, through our reporting, we have seen that pretty much every single employee at mar-a-lago has had to talk with special counsel investigators at one point. but there were a few who really stood out to us as possibly having criminal exposure, walt nauta being the first. we know he was pressed to flip and he did not do that. and here we have carlos de oliveira. as you noted, his job is in maintenance. but he came to our attention because we learned that he was also seen on the surveillance footage moving boxes with walt nauta. now, this surveillance footage was handed over to investigators, and one particular piece of surveillance footage that stood out is when he helped nauta move boxes out of a storage closet right before one of trump's lawyers was searching that same closet for classified materials. now, we know that carlos has spoken with investigators, we also know that his phone was seized.

we'll get to that in just a moment but let's start first with the new charges in the mar-a-lago case. with us now is paula reed. this is really extraordinary. in some ways we've been talking to lawyers for weeks. many did not necessarily expect more coming for trump in particular but not only is it more, but so much more detail here as well. >> that's right. not only new charges but also a new co-defendant. here they're adding a one count of willful retention of national defense information and then two additional counts of obstruction because these prosecutors allege the former president and two of his employees tried to destroy surveillance footage. now, that surveillance footage has really been at the center of this investigation not only as evidence for prosecutors as they try to piece together where these boxes containing classified information moved throughout the property but we also know they've been pressing witnesses about whether anyone tried to prevent them from obtaining the surveillance footage or if anyone tried to destroy it. but it was interesting when we got the firs

this goes back now to the mar-a-lago documents case. for our viewers, what is a superseding indictment, number one, and what do you read into the content of it? >> sure. number one, a superseding indictment is simply additional charges on an existing indictment. the first indictment of mr. trump and mr. nauta at mar-a-lago for mishandling classified documents and obstructing the investigation was unsealed about a month ago or so, willie. they have now added charges to it. they've added another defendant, mr. de oliveira. that supersedes the first indictment, it replaces it. it has additional charges, and we call it a superseding indictment. what do i make of it? well, you know, it's sort of sad in a way. when i was a federal prosecutor, there were always lower level individuals. i can tell you, quite frankly, i didn't get any joy out of prosecuting them. my goal was always to enlist their cooperation, to have them tell the truth. you know, each of them come to a fork in the road where they can either tell the truth or they can lie. if t

lawyers for trump argued the trial over mishandling of classified documents at mar-a-lago, that trialbe pushed until after the 2024 election. federal prosecutors, on the other hand, want the trial to start this december. now, judge cannon did not make a decision on all that today, and we are gonna have much more on that story coming up. but even if judge cannon decides to delay this trial for these federal charges, for these federal charges, there is a good chance that no matter what, donald trump will be standing in trial for at least some of federal charges before the end of this year. and that is because today, we learned that special counsel jack smith has made one of the most important and consequential decisions to date. it appears as if he is ready to charge donald trump in his attempt to overturn the 2020 election. now, getting to this point, getting to this decision, to pursue trump for his alleged criminal behavior, is the culmination of an extensive federal investigation, an investigation that was arguably kicked into high gear thanks to a decision made by speaker nancy pel

nauta makes an unscheduled trip to mar-a-lago. he wasn't meant to be there. according to the indictment, he speaks to de oliveira, and they walk together and scope out the locations of the various surveillance cameras and then two days later, de oliveira is in a conversation with a fourth person, described as employee number 4, and he says the infamous words, the boss wnts the server deleted. now, there's no allegation or description in the super supers indictment that anything was delayed. but they received footage from mar-a-lago, people in trump's orbit were worried about de oliveira's loyalty, and they could about it, and there was some assurances made that he would get a lawyer. now he's a codefendant. he's face ago separate false statements charge on his own. this is somebody the government would like to flip. he alone knows the conversations between him and the former president were about this alleged obstruction of justice scheme. >> right. he's the connector really there. before we kind of get into the nitty-gritty with lisa rub in, i want to go to v

one of the few things that he has said is that he wants a speedy trial in the mar-a-lago case, and he also wants a speedy trial here before the election, and if he wants that, he has to move quickly. another choice he is making is to allow the former president to really tell the story here, and he did that with the mar-a-lago case, and a lot of the breaking news of the indictments has come from truth social, the former president releasing it himself and really able to tell the story, and that, jack smith could do that by releasing the indictment, but that is a strategic choice, and there is pressure on him to move it along quickly. >> paula, i know this is a third or the second time that we are talking about the special counsel and if and when an indictment does come down, but remind folks that all of this is happening behind the closed door, and closed door proceedings, and how are people going to learn of indictment, and what are people going to see. >> well, that is a great question, because initially, there was a lot of pressure on the special counsel from reporters not to let us
