lilly ledbetter is a woman of grace and grit. ledbetter, it is great to have you back on the show tonight. thank you for being with us. >> thank you, rachel, for having me. i'm excited to be here to talk about my thoughts about the paycheck fairness act. >> you fought for equal pay at goodyear after you learned that men doing your same job were being paid more than you were being paid. you write about it with emotion and in a very moving way in your book. the paycheck fairness act addresses that specific issue, the issue of how people find out what they're making vis-a-vis their coworkers, literally how you discover you are being discriminated against. do you see it as sort of a companion bill to the bill that bears your name? >> i do. in fact, i've heard someone from the american association of women described it as the hammer for the nail that the ledbetter bill was. the two go together. but i really believe had this been the law back in my day, had this been an act that had been on the books, i could have found out from cowork

didn't we solve these issues in lilly ledbetter?well, paycheck fairness was a down payment, a down payment on this, because it kept the courthouse door open. paycheck fairness makes it harder to discriminate in the first place. right now, as i said, employers have the ability to retaliate against workers who share salary information. ledbetter did not address this issue. paycheck fairness does. women can now, under paycheck fairness, would be able to sue for punitive damages. lilly ledbetter did not address this. this would deal with that. there are a variety of things that i can elaborate on be, but i note that one of the real champions for justice, civil rights, and the empowerment -- especially the economic empowerment -- of women is my colleague from michigan, senator stabenow. i now yield senator stabenow seven minutes and thank her for her long-standing advocacy and the way she's raised her voice for hos those who don't often ha voice in positions of high power. ms. stabenow: mr. president, first let me say thank you to the ch

and in 2009, the senate took another step by passing the lilly ledbetter fair pay act to reverse the goodyear case which had made it almost impossible for our workers who suffered from discrimination to seek justice. and love we have made progress since we passed the equal pay act almost 50 years ago, pay skreuplgts has not gone -- skreuplgts has not gone away. women in washington still earn 70 cents on the dollar, a pay gap that averages 11,834 in lost earnings each year. that is 179 tanks of of gasoline. to most women cross america that is not a manufactured issue. it is very real. and, mr. president, this comes at a time when more and more families rely on women's wages to put food on the table or stay in their homes or build a nest egg for their retirement or pay for their children's education. the importance of women in the workplace has never been as critical as today and this has become even more evident in this tough economy. mr. president, the fact is that women are now participating in the work force at higher rates than ever before in history, according to the bureau of lab

the lilly ledbetter action comes up a lot.f lilly ledbetter. >> it addresses different aspects of the disparity between men and women's pay. so it is not like just a repeated vote on the same bill. it is like a different aspect of equal pay. so with lilly ledbetter the bill addressed the timeframe that you're allowed to go back and re-claim -- >> bill: file a lawsuit. >> it broaden the statute of limitations on how long you can go back. the new bill has a different piece to it. it prevents employers from retaliating against say female employees who want to talk about their pay openly with their coworkers. it also broadens the definition of where it counts as your workspace. is this office we're in here today or all of the building that this company that we work in, is it the whole building as our space? it is different aspects of pay discrimination that are addressed here. so the bill has its own merits from a policy stand point. not just for political talking points. it has real weight to it. >> bill: it has some substance, i

look at what it took us to get the lilly ledbetter law enacted in order to report discrepancies in pay, when a women discovers that her male counterpart is earning more than she is earning. that took a major effort in congress and a new president to expend fairly significant new capital in order to get this legislation passed. so we really do have a struggle. i think that the big part of the reason for women not joining together and marching in the streets against what should be a no-brainer is that there is a perception that "it's just me. maybe it's in my mind." >> hinojosa: well, isn't it because women are never talking about this? it's not like we're sitting there and saying... >> and we don't talk about violence against us. it's the great... there's a great stigma, a great secret that women keep to themselves. they don't acknowledge it until often it's too late, and their physical being is threatened or in some cases actually killed. >> hinojosa: so is it about women who just, at that moment when they're talking with their boss about the raise, that they just don't know how to...

it's designed to fill in any loopholes from previous equal pay laws previous laws include the lilly ledbetter fair pay act of two thousand and nine thousand acted to ensure that females can fight for their right to equal pay and gave women a time frame to sue their employer for pay discrimination but there is still a lot of gaps that companies could use to keep the salary gap the way that it's been for decades and so that's where the paycheck fairness act comes in to plug all of these holes and it was drafted to ensure that women can investigate when they're being discriminated against discriminated against in the workplace it would force stronger penalties on employers to prevent them from violating those equal pay laws and would make it easier for women to sue their employers if they can prove that they've been a victim of pay discrimination it would also protect workers from getting canned if they discussed wagers with wages with their coworkers something that's already protected in federal law but obviously isn't always followed so all of those things seem pretty legitimate and logical ri
