liz kreutz joins us. liz, what more do we know?reporter: well, lester, it is now essentially impossible that the menendez brothers will be out of prison by christmas as their attorneys were hoping for. that's because the judge here has postponed their key resentencing hearing until next year, krielting in part respect for the new district attorney who takes office next week and said he wants to make his own recommendation in this case which could differ from the outgoing das. now, here at the status hearing today, two of the menendez brothers' elderly aunts gave emotional testimony in support of the brothers. ultimately though it will come down to whether or not a judge believes the brothers were sexually abused and, if so, whether or not he believes they should get a lighter sentence. the original prosecutor on the case maintained the alleged abuse does not jest phi the murders. now, here in court we had expected to see erik and lyle come virtually from prison, appear virtually from prison by zoom. that didn't end up happening bec

that's where we find correspondent liz kreutz, who joins us now live from phoenix. ough what these changes actually mean. i mean, how is this ballot initiative ultimately expanding the state's reproductive rights? >> reporter: yeah, hey, morgan. hey, vicky. so this is a big win for abortion access advocates here in the state. this is proposition 139. it passed pretty handily. it will enshrine abortion rights into the state constitution here. and it will expand abortion access. currently abortion is banned after 15 weeks. this will allow abortion up to fetal viability, about 23 or 24 weeks, or even beyond that based on the health of the mother. essentially, it brings the law here in arizona back to what it was before the overturning of roe vs. wade. and this is a really popular measure. it got more than 800,000 signatures to even get it on the ballot. more than any other proposition has gotten in arizona state history. there was a lot of bipartisan support here among democrats, independents and republicans. and it's interesting. i think democrats were hoping that this

joining us from phoenixes nbc news correspondent liz kreutz inside the fortress, and said the maricopa county tabulation and election center. behind her officials are doing what's called adjudication of the ballots which means they're checking for potential problems before the ballots are processed for tabulation. it's great to have you with us. tell us what you have been seeing and what's going on? >> reporter: we made it inside. it took layers of security and i'm sure you remember this view very well from 2020. we are looking inside the bella processing center right now. what is happening right here is two peers of election workers, one republican and one democrat, they work together to go over any ballot irregularities. they come to a consensus and we are told they become friends through this process. it's a snapshot of america. you can see there counting the ballots. it's interesting that anyone around the world can watch on a livestream what is happening in this room. since 2020, they added even more camas and livestreams so you can watch the step-by-step process of how it works.

liz kreutz for us there in idaho.egal correspondent lara jaret. it's supposed to start at the end of next summer. so what happens between now and then? >> i think people at home might be wondering what is taking so long? they have to go through the forensic evidence and there's quite a lot that the defense will have to keep up and the prosecution has its work cut out for it because it has to prepare the witnesses including the two surviving roommates who will have to get on the stand and tell their story. one of the roommates saying she saw a masked man and she'll be cross examined about that and it will be gruelling and they have to prepare for that. >> kohberger's team trying to get that off the table. how realistic is that possibility? >> i would be shocked if that's a winner mostly because it's a settled point of law at this point. it definitely is not used that frequently in idaho. it's only been three times since the 1970s and that's mostly because they can't get the drugs for lethal injection not because there

. >> joining us now from arizona is nbc's liz kreutz. good morning.ate race between gallego and lake still not called. what's the latest there? >> reporter: yeah, hey, guys. right now it's still too close to call but we have 63% of the results posted right now and it is giving a slight edge and lead to the democratic candidate, ruben gallego, running against republican kari lake, the former tv news anchor who won for government two years ago here and lost. notably, gallego is up about 2.8 points in the statewide contest, but here in maricopa county it's a wider margin, up by nearly 6 points. it's hinting at that rural/urban divide. and in maricopa county, trump is winning the presidential contest right now. still close to call, but it's what people were expecting might happen, there could be people who went out to vote for trump but then just didn't like carey lake and decided to vote for gallego or left the senate contest blank. kari lake is considered an unpopular candidate here. and gallego has run a strong campaign. a congressman who has leaned in

liz kreutz in maricopa county. really long ballots in arizona. ent items on their ballots. seriously. but while we were checking in with liz, we got the first big batch of votes out of georgia. steve, what do we got? >> as we said, we expect a ton to come in here. and what's supposed to happen is all of the early vote, that includes vote by mail and in-person early voting going on the last few weeks, all of that needs to be reported out by all of these counties in the first hour. what we're seeing so far is it may be in some of these counties they're going to report that incrementally because it's varying what we're getting. i talked about if you were watching earlier what i call at least the blue blob, which is the immediate atlanta metro area, and two counties there. this is where democrats are just trying to run up the score. two counties here have substantial vote in right now. one of them right here is douglas county. you can see here, this is about three-quarters of the vote. again, that is probably all of the early vote that was cast here.
