lofgren: i have just a couple of questions. article one says the times, places and manners will be in each state. every state has decided to have elections, all 50 states decided they're going to decide this by the vote. some have suggested that if you took the extreme independent legislature theory to the maximum amount, that it could empower state legislatures to essentially decide otherwise. you have a vote, you don't like the result, the legislature appoints who they want. so professor, i would like you to comment on that assertion and some state legislatures did indeed suggest that during the last presidential election. and your comment, whether reform of the electoral count act could play a role in remedying such a threat to the right of americans to select their government? >> thank you for the question. so first, even as things stand today, congress decides the data on which electors have to be appointed, that's a constitutional power congress has. it means the state legislatures cannot after election day suddenly decid

i want to go now to democratic congresswoman zoey lofgren, who is investigating january 6th. congresswoman, i want to get to your committee's work in just one moment. but, first, what is your interpretation of this new reporting of evan's about donald trump's secret court fight to block witnesses from testifying before a federal grand jury? >> well, all i know about that is what i've heard in the news that the committee has no information about it. but, clearly, the ex-president attempted to overthrow the government, at least one federal judge in the eastman case found that it was more likely than not that mr. eastman and mr. trump violated federal laws. and obviously the attorney/client privilege is defeated if the consultation is in furtherance of a crime, which is what that judge found with the eastman case. but i don't have any information more than what you've just given, it sounds like, the former president is up to his knees in trouble. >> so your colleague jamie raskin just said that the select committee has more to reveal specifically about roger stone's connection w

lofgren. the speaker pro tempore: the gentlewoman is recognized. ms. lofgren: mr. speaker, i rise in opposition to this bill. and i do so reluctantly because title 1, raising the fees for enforcement, i'm for that. as a matter of fact, i'm a co-sponsor of that bill. and title 2, the foreign measure, i'm for that. but title 3 is going to create a problem. this has been advanced as if it's noncontroversial. that is not the case. it's complicated. let me try and be very simple. in 1968, congress enacted a provision where if there was a multiplicity of antitrust lawsuits filed by state a.g.'s who have concurrent jurisdiction, a senior panel could consolidate the cases so you wouldn't have inconsistent discovery, inconsistent decisions outside of the various regions. now, you don't need that with the department of justice because they do the consolidation when they bring the case, but that's why it worked for the a.g. and it's worked very well for a long time. contrary to what some said, this is not a tech change. this is a venue change for all businesses, which is why

david, when we hear that reaction from zoe lofgren saying trump's continued attacks could amount to incitementl danger for him corrected to that rhetoric? >> yeah, there is if people take action based on his words. that's a lot of what the january 6th committee is investigating regarding that incident. but if there are people inspired directly by this and cite this as a reason why they take action, for example, some violence against the fbi as we saw in ohio a few weeks ago, then there is a potential threat. the bigger threat is just the overall political environment. at a time when the former president should be explaining how it's possible there were all these classified information documents inside his residence, instead of explaining that, he is going on the offensive and taking on people like he calls the radical left leadership of the fbi, forgetting he appointed the director himself. that's a losing argument for him politically except with a very small base. it does put him in some legal jeopardy but i think the bigger fear at this point is simply that he is not bothering to defend hims
