. >> abc7 news reporter lyanne melendez joins us live along the embarcadero with more on what's next for neighbors. lyanne? >> well, you've heard this before. it ain't o over. now those who oppose this navigation center really are -- have a number of arguments, but one of them is that, of course, that they want to stop this construction now right this second. they were not successful in court. they will be back in court very soon now to argue that this time that this city, the city cannot build on this site. the alleged attack on a woman by a homeless man last month left many neighbors along the embarcadero adamantly opposed to the construction of this 200-bed navigation center. today they asked a judge to grant a temporary restraining order to immediately stop its construction. they argued that it does irreparable harm to residents. >> i really don't have any showing of irreparable harm here. >> the judge denied the request because none of the homeless people who occupy the center have moved in. the city says the center would open in late november or early december. those behind the

. >> let's check in with lyanne melendez live from the courthouse where the prosecution made a brief statement after the announcement of the verdict. lyanne? >> reporter: yeah. it was very brief. keep in mind that the prosecution came out warning us that they were very limited in what they could say because part of the verdict, as we have been reporting, resulted in a hung jury. again, they said we can't really go into any details. in fact, we're not going to take any questions. remember, again, there will be another trial possibly another trial for derick almena. the d.a.'s office say they respect the decision of the members of the jury. they said we really respect them in that they worked so hard during this trial. they left their loved ones, they left their work. so we're grateful to them. now, the prosecution also said that since the beginning, since the beginning of this trial, their hearts have been with the families of these people, the people who died in this terrible tragedy. that's what the prosecution told us. now, it will continue to be, they said the focus moving forward.

lyanne melendez spoke to athletes at cal, and we'll have their reaction coming up on abc7 news at 5:00. >>> tonight federal prosecutors are revealing detailses of a bay area spy case complete with secret drop-offs and double agents. officials unveiled the espionage complaint against xuehua peng, a tour operator from hayward accused of spying for china. evidence includes alleged drop-offs of which peng is accused of leaving cash hidden in hotel rooms in exchange for sd memory cards filled with classified information. they say the information on the cards was provided to peng by a double agent who is cooperating with investigators. >> there are six dead drops in total that are alleged in the complaint. during these dead drops, peng would rent and then occupy a hotel room, tape an envelope containing cash to the underside of a dresser drawer in the hotel room, and then leave the room key at the front desk. the double agent would remove, would retrieve the key, retrieve the cash and tape the sd card to the same place where the money had been left. >> agents claim peng ultimately delivered
