san jose mayor matt mahan says 47 went too far, so he went to the state capitol, joining with other localizan leaders, pushing prop 36, which increases prison time for certain drug related crimes. make certain drug offenses treatment mandated felonies, all with the idea that drug use, especially fentanyl, leads to other crimes. mahan says the key is targeting repeat offenders and focusing on treatment that there has to be accountability. there has to be there have to be consequences for committing crimes. but those consequences can be humane. they can be uplifting. they can get people who desperately need treatment into treatment. we can go from an era of mass incarceration to an era of mass treatment. governor newsom is among those who have come out against 36, calling it drug reform that will only continue to fuel the state's prison overcrowding crisis. a community watchdog group, silicon valley debug, reluctantly agrees with the governor, saying prop 36 would take away savings garnered from 47 that funds the varied treatment programs people arrested would need. we know the real issues

the debate is now pitting san jose's mayor, matt mahan, against governor newsom. it involves a ballot measure that you'll have an opportunity to vote on this november. prop 36. if approved, the measure would increase penalties for some crimes, including drug offenders and retail thefts. it's being sold as a partial rollback of prop 47, which was passed back in 2014. the ballot initiative changed a lot of nonviolent felonies to misdemeanors. it would also force some drug offenders into mandated treatment. today, mayor mehan joined local leaders in sacramento campaigning, campaigning for prop 36. he says after talking with community members, it's clear that our current policies are not working. this puts him at odds with governor newsom, who is against prop 36. the governor says it will continue to fuel our prison overcrowding and would be too costly. mayor mehan spoke to nbc's robert honda on his way back from sacramento, just a short while ago, saying prop 36 is actually meant to force people into treatment. what do you think was the worst unintended consequence o
