welcome back, marcia. >> thanks, judy. >> woodruff: tell us first the facts of the case. >> okay. the police and the f.b.i. attached a g.p.s. tracking device to the undercarriage of antoine jones's car. jones was a suspected drug dealer. they didn't have a warrant. they monitored the movement of the car 24 hours per day for 28 days. some of the information gathered was used to convict him of conspiracy to deal drugs. a federal appellate court later reversed his conviction finding that the use of the g.p.s. device without a warrant violated the fourth amendment. >> woodruff: what is then the question before the justices? >> judy, as you know, the fourth amendment protects us from unreasonable searches and seizures. the supreme court has said in determining whether a search or seizure was unreasonable you have to look at the individual's expectation of privacy. was that expectation reasonable in itself? so the question here is,... was there a reasonable expectation of privacy on the part of jones that the police could not use the g.p.s. tracking device. >> woodruff: how is new techn

so, marcia, your reaction to today's sentencing? >> i have to say, it's no surprise.uld max out, conrad murray, at the top term of four years. and also because of the realignment sentencing laws now, he's not going to go to state prison because he's not considered a violent felon under the laws that have now been enacted. so he's remanded to the custody of the sheriff which means l.a. county jail and perhaps house arrest. >> is that just? >> that's it. that's all that we can really do. and of course, don't forget, involuntary manslaughter only carries four years. and it always has been allowed to be given what we call halftime, good time work time credit of 50%. in that sense the sentence is exactly what the charge is, you can't ask for more than that. but the actual place he does the time, that's because california's prisons are bursting at the seams. >> you can hear the anger in the judge's voice. he was angry about the recording the doctor made when he was barely conscious. do you think this was a fair ruling? do you think he should have received the maximum senten

he's not going to get probation. >> marcia clark, do you agree with that? >> i think it's very likely mark is right. how much time he actually winds up doing, anderson, that's a different story. first of all, i think he had to remand him. i don't think any judge that wants to be the guy that lets conrad murray skip out and wind up in guam somewhere. i think it was a pretty much a foregone conclusion he would get no bail. but how much of that time he actually does given the problem we have with jail overcrowding here in california, very debatable. even the possibility of house arrest is a very strong one given our new sentencing laws. >> even if he's given the max of four years he could get house arrest or probation -- not house arrest but probation. >> it's possible. yeah, i know what you're saying. anything is possible right now. we have new alignment loss. steve referred to that today during a press conference, and it's true. they're now saving the beds for the most violent and dangerous criminals. and conrad murray does not qualify in that class of crimi
