i'm maria medina. >> hi, everyone. i'm frank mallicoat. it is nearly 5:00 on this wednesday. >>> berkeley is taking action to prevent future disasters like last month's deadly balcony collapse. kpix 5's christian hartnett joins us live in berkeley where the city council has approved tougher building regulations. good morning. >> reporter: good morning. a lot of people were at that meeting last night to voice their opinions and after a lot of discussion with the city council, they finally made a decision to tighten up regulations so that a tragedy like this one never happens again. the city council passed the new inspection laws unanimously. other regulations will still need to be decided upon such as the use of steel reinforcement in all balconies constructed in berkeley. for now in the next six months, all balconies and weather exposed elements on all properties in the city will need to be inspected. a follow-up inspection will happen every three years after that. the proposal initially called for the follow-up inspection to happen every

i'm maria medina. >> i'm brian hackney. it's 5:00. police have traced the gun used to kill a young woman on a san francisco pier back to a federal agent. the gun was stolen last month during a car burglary downtown. anne makovec has more on these new developments including claims that the suspect simply found the gun and fired it by accident. anne. >> reporter: we do not know right now if the murder suspect who is here in the san francisco county jail is the one that sold that gun from downtown san francisco. -- stole that gun from downtown san francisco last month. the gun recovered in the bay near pier 14 after that shooting which was one week ago today. forensic technicians traced the serial number of that gun back to a federal agent. we don't know which agency yet but the gun had been stolen during a car burglary in downtown san francisco last month and then it appears it was used last wednesday to kill 32-year-old kate steinle on pier 14 as she was walking with her dad. now, sanchez, the suspect in the case, says that he found th

i'm maria medina. >>> the fbi says vallejo police made a mistake when they called a kidnapping a hoax. the feds say several men did force their way into a home and abduct a woman in march. kpix 5's christian hartnett is at vallejo police headquarters to explain the about-face in the case. good morning. >> reporter: good morning. well, vallejo police have been quiet about this turn of events nearly four months after calling -- basically writing off this kidnapping as a hoax. the u.s. attorneys criminal complaint says back in march matthew muller broke into a couple's mare island home and kidnapped denise huskins. they say he and three accomplices were wearing wet suits, covered their eyes with swim goggles after tying them up, stole a car and threw a drugged huskins in the trunk. >> the deed is done. you can't unwind the trauma and say, you know, whoops, we made a mistake. that's not acceptable. that's not good enough. >> reporter: the complaint includes photos muller and company allegedly sent to the "chronicle" showing the items they used to kidnap huskins. police caught up with mull

good afternoon, i'm maria medina. >> i'm brian hackney. frank is off today. kpix 5's anne makovec reports the controversy over who was responsible for the murder suspect's release is growing more inflammatory. >> reporter: the federal bureau of land management confirms that gun did belong to one of its agents. and while theories about how it ended up in the killer's hands run rampant, the man accused of pulling the trigger sits here in the san francisco jail his bond set at $5 million. the gun used in the murder of 32-year-old kate steinle was recovered in the bay near pier 14 where she was shot while walking with her father a week ago. forensics traced the serial number to a federal agent. it had been stolen from the agent's car during a street burglary in downtown san francisco. the suspect in kate's murder juan francisco sanchez says he found the gun on the pier wrapped in a shirt and that it went off accidentally in his hand. he pleaded not guilty to murder. >> we can confirm that mr. sanchez did not know kate steinle and he had no reason to want her to b
