mark meadows has some details potentially, but that needs to be worked out with the committee. my sense is he doesn't want to get ahead of bennie thompsonteve bannon as someone they are pursuing criminally to make the case for mark meadows, you better be forthcoming. if there are things you think are privileged, maybe there is some oaccommodation that can be made, but lots of things that mark meadows heard, saw or communicated are clearly not in the privilege. >> and they are clearly important to getting to the bottom of january 6. that is the question i have been wrestling with for some time now is executive privilege, executive privilege every time no matter what. might the courts look at january 6 and see something so extraordinary that executive privilege rights don't go as far, that they don't carry the same weight when we're investigating something as important as an attempted coup in our country? >> i think that's a great way of putting it and a great way of framing it. and executive branch officials themselves will look at what is the necessity of the investigation, what is the material? as you may know, as an initial matter, th

mark meadows, who has been subpoenaed by the committee. shortly before air time we learned that chairman bennie thompson sent his attorney a letter demandinger documents and sit for a deposition or be held in contempt. yesterday you'll recall his attorney said meadows would not cooperate until the courts decide the privilege question. joining us now is cnn political analyst and "new york times" washington correspondent maggie haberman. also cnn legal analyst jeffrey toobin. so, jeff, what exactly does the move by the court of appeals mean for the house investigation? because yesterday you were saying it all boiled down to what judges or what mix of judges got the -- needed to make the ruling on this. >> right. and what these three judges decided was to put the matter on hold briefly. they set a very aggressive briefing schedule. they basically decided if they didn't grant the stay they would have effectively decided the case because the documents would have had to have been turned over. so this case is going to be argued on november 30th. this is unquestionably a victory for the trump team in the short term. but what's i think the most sig

the evening before mark meadows was supposed to give a deposition to the committee, to the select committee, that the committee head, bennie thompson, issued a statement essentially he had anticipated a meadows no show, saying that if he didn't show up, it would be considered willful noncompliance and he went on to say that would force the select committee to consider invoking contempt of congress procedures. so the question is, pam, whether or not they move forward with that and how quickly. the select committee feels very emboldened by bannon's indictment. they feel it would give meadow more incentive to actually cooperate. this committee has complained meadows has failed to give even basic information, whether or not he used a private cell phone or where his texts came from on january 6th. as for meadows, he says he's been trying really hard to work with this committee. and one of the few republicans who actually voted for that criminal contempt in bannon's case, that being representative fred upton, says that he thinks that meadows' case could be different than bannon's because at least they're talking to his lawyers. on the ot

mark meadows. >> months and months. manu, what is the committee going to do about this? kara read the statement from bennie thompson. do you really see them going the way of steve bannon? >> reporter: they're making that clear that is something they may do. bennie thompson has said for weeks he will not put up with any stall tactics, that they would move the way they did with steve bannon, to refer him to the justice department for criminal contempt charges. the problem is they don't know exactly what the justice department is going to do. we have not gotten any indication about whether merrick garland, the attorney general, would move forward with criminal contempt charges for steve bannon. that if they decide not to, that could make it easier for witnesses not to comply, point to the onkwoing court cases and defy the subpoenas. nevertheless, the committee said they would not semaccept what m meadows' reason for not showing up. they're still planning to move ahead, may move forward to refer him for criminal contempt charges. we do expect a statement from the committee soon in the aftermath of meadows' decision not

as a warning to folks like mark meadows who failed to appear yesterday before his scheduled deposition. the bipartisan chair and vice chair of that committee, benny thompson and liz cheney, issuing statements immediately after bannon's indictment, saying in part, quote, bannon's indictment should send a clear message to anyone who thinks they can ignore the select committee or try to stonewall or investigation. they said meadow's actions will force the select kpee to consider pursuing contempt in order to enforce that subpoena. meadow's lawyer is saying he's waiting to see how they settle the privilege claims and here's where the case is different from bannon. meadows was president trump's final chief of staff. he was around him in the days leading up to january 6th and of course on that day as well in the white house. and that's exactly where the committee is focusing their purview on this investigation and that's why they want to hear from mark meadows. let's listen to one member of that panel, zoe lofgren, she was on msnbc yesterday. let's hear what she has to say. >> it seems to me you've got to take action, you can't allow individuals who have inform

former chief of staff mark meadows now cooperating with the congressional committee investigating the january 6th riot at the capitol, with the chairman bennie thompsoning, meadows has produced records to the committee and will soon appear for a deposition. this means meadows may escape what another reluctant reference, jeffrey clark, is headed toward, a contempt vote. all of it as a hearing today could pave the way for the release of any records from former president trump's time in the white house related to the insurrection. he's been in a legal battle for months to keep that stuff secret. i want to bring in pete williams and garrett haake. garrett, let me start with you. walk us through what we know about meadows level of cooperation. any indication that the threat of a contempt referral may be what sparked this from him? >> reporter: by parsing the experience from the committee's chairman announcing the cooperation from meadows and the attorney, it's clear he is cooperating a little bit but not as much as the committee would like. the committee tells us that meadows has handed over some documents. he'll sit for an initial deposition soon. but th

mark meadows failed to appear before the committee for a deposition. his attorney issued a statement yesterday claiming meadows is immune from congressional testimony based on previous justice department opinions. bernie thompson is threatening to seek criminal contempt charges against meadows if he fails to cooperate. and while the committee and full house of representatives has already made good on a similar threat against steve bannon, it's still not clear if the justice department will pursue criminal charges against the trump confidant. at the same time, the committee's attempts to obtain white house records regarding what was happening on the other side of pennsylvania avenue as the attack unfolded at the capitol are on hold for now. an appeals court granted former president trump's request to temporarily block the national archives from handing over the records. arguments in that case are set for november 30th. regardless of what the documents or any witnesses tell the committee, the former president has already made clear his opinion on january 6th, releasing statements that claim the real insurrection happened on election day. and a newly released audio from an interview with jonathan karl in march, f

chairman bennie thompson said on tuesday that the committee won't rush the effort to make it clear that it has given the former north carolina congressman, marktempt, but they will not rush that. what is your sense of where those efforts stand? >> i think meadows will delay as well but i agree with dan. this is -- it's up to these judges. it's up to the circuit court that's now considering the records case and the national archives has to release these documents. i believe there are hundreds of pages of documents, you know, trump's schedule that day, certain emails and communications and documents don't lie. happy that people leak to the press but you know, dan might agree, the best source for a reporter or an investigator is a document, and so that's the central case here, and i hope that moves quickly forward through the court system and there's a quick and clear verdict that results in the release of those documents. that's the most important evidence, i think, at this point, of all. >> we'll stay on it. david, thank you so much for starting us off this hour. john heilemann and dan goldman are not going anywhere. when we come back, we'll a
