marla? >> reporter: brent, in just a moment i'll explain what the family is doing to get the word out this morning, but first i do want to give you an update on 18-year-old erika luna. she is here at regional medical center of san what save in critical condition this morning. she has a broken pelvis and internal injuries after being hit and then dragged for hundreds of feet. now, this hit-and-run happened early sunday morning about 2:30 when her family tells us she was crossing the street at tiena buena drive and fontane road near 101 and tulle road. she was hit and dragged for more than 700 feet. the driver of what's described as a silver minivan or suv just took off. meanwhile, doctors tell the luna family because of her injuries she may never walk again. her older brother jose is desperate for justice. >> he didn't hear my sister screaming or something? there's no reason not to stop. it is not -- you are not a human if you don't stop. >> reporter: now here's how that luna family is taking

live in san francisco, marla tellez, "today in the bay." >>> thank you, marla. now the state attorney general is dropping all charges zbens one of the suspects in a high-profile south bay murder. prosecutors say they do not have enough evidence to charge 29-year-old or a 29-year-old man. the mercury news reports that the decision comes after a public defender discovered flaws in the information, including an informant who admitted to being motivated by the $90,000 reward money and cell phone records that indicate that the suspect was not in the area at the time of the killing. also, there's dna evidence found in the getaway car that was not linked to the suspect. >>> a bay area man is now admitting he threw the punch to kill a teenager giant fan outside at&t park a few years ago. taylor buckley is pleading guilty to charges of involuntary manslaughter. as part of the flee deal he'll go to jail for one year and serve five years probation. he punched anthony injure ordo back in may of 2008. he fell hitting his head on the concrete and died the next day. >>> change

marla tellez is in walnut creek with how the boys are being remembered today. marla?yes, school starts at 8:00 this morning, so when students start arriving in the next hour or so they will have the option of meeting with grief counselors. counselors are scheduled to be on hand here at this school this morning to help students deal with the heart-breaking loss of their classmates, 16-year-old matthew miller and 17-year-old gavin powell. they were juniors at this high school. they were also best friends. a memorial this morning is building where the boys launched their inflatable raft and entered the creek on saturday. it is actually just a mile from the high school. friends are posting their thoughts and leaving behind flowers. much of the creek is fenced off. and it is not meant to be accessed by the public. this morning autopsy results confirm the teens drowned. they were wearing helmets but were not wearing life jackets. as students head back to class this morning after the long holiday weekend it is safe to say they will do so with heavy hearts. >> i am shocked. i

live in santa clara this morning, marla tellez, "today in the bay." >>> thank you, marla. 5:36 rightt teachers and school district leaders are not seeing eye to eye in new contract negotiations. they are set to meet thursday on a new three-year contract. teachers have not had a pay increase in three years and they want a raise to help cover rising health insurance costs. last week the district released a list of negotiation priorities including a salary decrease because of a huge los of funding over the past three years. the district also wants more power to evaluate and layoff teachers. >>> ac transit drivers now say that something needs to be done to protect them better on the job. after a shooting in north richmond drivers say they are often confronted with angry rider who is sometimes becoming threatening. as we reported earlier this month, somebody shot the back window of a bus at third street and grove avenue in north richmond. the union representing ac transit drivers and mechanics now plans to push for better safety standards. ac transit says it plans to put more cameras on b

marla tellez is live near the summit to show us. good morning. it is pretty soggy out there. >> reporter: good morning, laura. it is getting nasty out here. the rain is coming down. it is windy. it is pretty foggy, too, up at the summit. traffic seems to be moving along without any problems. let me step out of the way and you can see northbound highway 17 traffic. it is moving along. we have made our way up and down. we haven't seen any problems. no accidents just yet, so that's good news. i actually just hung up with the national weather service and they tell me the santa cruz mountains are expected to get as much as 3/4 an inch of rain today. this has caltrans crews monitoring the roadways this morning. we have gone down to scotts valley along 17 and talked to early morning drives there. one guy who lives in capitola is on his way to san jose and tells me he's from michigan. this is not a whole lot to deal with for him, but still he is driving defensively this morning. that's good advice for all drivers. and last weekend the santa cruz mountain

marla is live with more on the story. good morning, marla. >> reporter: good morning. no surprise the berkeley peace and justice commission is behind this latest controversial move. the commission has drafted a resolution that essentially invites a couple of detainees to come to berkeley to live. in all, 38 detainees have been cleared of the crimes they were held for. of those, the resolution invites two of them to live here in berkeley. the first is a russian ballet dancer who converted to islam while serving in the russian army. he was arrested in pakistan while trying to hide from the kgb. the other invited a former algerian chef. after his work visa was not renewed he moved to canada but was not granted asylum. he was arrested trying to make his way from afghanistan into pakistan. neither man was ever charged with a crime but both were tortures while at guantanamo bay according to the center for constitutional rights. this could fall through because president obama recently signed an act that prohibits the u.s. from funding the relocation of cleared detainees. the

marla tellez is following the story for us.s joining us with more on the latest developments today. >> reporter: today is his own preliminary hearing, and today could be the day will lynch and his supporters have been waiting for. a judge could dismiss the case meaning lynch won't have to stand trial. you'll recall lynch is accused of beating father gerald lindor at a los gatos retirement campus last year for alleged sexual abuse that happened back in the 1970s. but because lynch waited about 20 years to report it the priest cannot be prosecuted because of the statute of limitations. a courtroom bombshell yesterday could be the key to lynch's defense. a church employee testified that the catholic church keeps a list of alleged molesters and houses many of them at the same campus in los gatos where the alleged beatings happened. and that father gerald lindor is on the list. it turned out lindor was a no-show yesterday. >> i found it fascinating that the man kept repeatedly saying to police officers and everyone on the list that

target marla. >> reporter: good morning. we're inside the town and country village parking lot. many of you are probably familiar with this location along el camino. it's filled with eateries and local businesses, and it's shopping center lots like this that police say these latest auto burglaries are taking place. police say specifically they are happening in the stanford shopping center parking lot and other similar lots, all along el camino, though. it's not happening when you might think it would happen. that's after hours or in the dark. it is happening in broad daylight and into the early evening hours so probably when you would least suspect something like this. these thieves know what they want. they are burglarizing cars that have lap tops, gps units and things in plain sight. police are telling you to take your lap top, gps, anything expensive, sunglasses, take it out of your car if that is feasible. if not at the least tuck it away in the trunk so it's not in plain sight. at the end of last year police say they sa

next, an in memoriam for sherriff deputy marla denzer. she died earlier in january. she joined the department in june 1994. after completing the core course, she was assigned to county jail 7. she graduated from the santa rosa trading center and return to county jail 7, after which she embarked on a varied career. county jail no. 9 in the transportation unit here at the time of her death, she was assigned to county jail one. she was well respected by her fellow deputies for the team spirit and work ethic, and i know the loss is devastating to many in the department. next is somebody that many of us knew through his tireless activism. it was quite a shock because he was here at the swearing in of board members just recently of his unexpected passing. james howard pi, jr. he lived his life as an engineer in the net states navy and community activist. he was a strong servant of god, to his family, his church, his community, and the city of san francisco. he was a resident of the fillmore for over seven years, a member of the uptown church of christ. he is survived by si

marla is live in berkeley to explain what cal faces. >> reporter: good morning, brent. it's the fourth quarter, 30 seconds to go and on the line five sports programs at cal. the men's baseball team, men's and women's gymnastics, women's lacrosse, and men's rugby, all face elimination. if they are not saved they would be gone after this school year. like most moves these days, it all comes down to money and saving money. reducing the number of intercollegiate teams from 29 to 24 would save the university about $4 million a year. but eliminating two women's teams, gymnastics and lacrosse women's teams, would put cal in violation of title 9 which calls for genter equity. it is a federal law so that is a big element that the chancellor is taking into consideration. the chancellor is facing his decision on two main criteria. that $25 million is raised to pay for the operating expenses for the program for five to 10 years, two, that the university has a plan to build an endowment to fund the program long term. supporters have formed a group called save cal sports which report
