marla tellez joins us live with more on the story. good morning, marla. >> reporter: laura, good morning. this is a beverage distributing company in san jose. you can see the bud light truck headed out. they distribute beer, water, energy drinks. he is a part of the 1%. talking to employees as they arrive. hi name is mike fox sr. he's 75 years old. he's leaving bank of america. he's going to pull out funds from his personal account to show support for the occupy movement. we're talking millions of dollars. this is a prominent south bay businessman and well known philanthropist. they have $8 million with bank of america. he's going to yank that. he's going to transfer several hundred thousand dollars. where will he put that money? he tells the san jose mercury news he's not sure just yet. it could land in a local bank. now this morning his employees like what he's hearing. >> he shows he's really caring and supporting of the company. >> now fox's decision to do this comes just before what is being dubbed bank transfer day. november 5th.

marla tellez is live at the oakland coliseum station with more on this story. good morning, marla. >> reporter: jon, good morning, this time around mezerli is not the only defendant in the case. mezerli and four other bart officers are accused in the alleged beating that happened right here in oakland. this is just six weeks before the controversial shooting death of officer grant. it was in november of 2008 that kenneth caruthers of oakland. he heard e mim say the officers were lazy. four other officers piled on top of him and began punching and kicking him. he was taken to the hospital and treated for his injuries. they filed the civil suit two months after he shot and killed oscar grant at the fruitvale bart station. the negotiations have been unsuccessful. today jury selection begins. opening statements could happen as early as tomorrow. now mezerli is expected to testify in the trial. keep in mind he was just released from jail five months ago after serving one year of a two-year sentence for the shooting death of oscar grant. this morning i have reached ou

marla tellez is live with more. good morning, marla. >> laura, good morning. what is so disturbing about this attempted abduction is, one, it happened in broad daylight. and two, it happened right here on lark avenue at one of entrances to the wildly popular los gatos creek trail. this is a haven for runners and walkers. it was about 4:15 sunday afternoon when the man drove up to the 17-year-old girl as she was walking on lark avenue. asked if she wanted a ride. when she said no, he got out of his car, grabbed her and tried picking her up. she was able to fight him off by punching him in the face and the groin. we have a suspect description this morning. police say he's a hispanic man, about 45 years old. 5'6" with a slim build and slicked back black hair. he was wearing dirty blue jeans splattered with paint. his car, possiblily a mid-1980s volkswagen jetta. the girl told police it was covered with several splotches of dark blue or black paint. essentially patch work for some rusty spots on that car. now if you've seen this car, or if you know anything about

marla tellez is joining us live from san jose toics plain all. good morning, marla. >> jon, good morning. we know balancing our own budget can be tough. imagine if you're a school district facing more state education cuts, you're forced to get creative. take for instance this one here. this is franklin mckinley school district in san jose. it's taking out short-term loans to make it through the school year. this is according to san jose mercury news. this elementary school district is borrowing on the market. mid year is february 1st. it's estimated the state will cut $4 billion that officials say that will force almost all of the state's 1,000 districts to make more cuts. this breaks down to roughly $180 per student. now i mentioned potentially more furloughs, but as far as layoffs, a state law stops districts for laying off teachers ahead of mid-year cuts. so teaching positions are relatively stable at this point. but it's a new story here in san jose. it's comprised of 17 elementary schools. they may have to cut the school year by three days. i

marla tellez is live in san jose with the details. orning, marla. >> reporter: jon, good morning. they are officially filing suit in san francisco this morning. we're here in san jose because the city has more than 100 medical marijuana dispensaries. advocates are banning together to stop the crackdown by the obama administration. it involves patients, landlords and representatives from medical co-ops. they'll announce the specifics today. this is what they want. an immediate halt to the statewide crackdown. and businesses that support them. recently the u.s. department of justice announced they will shut down what u.s. attorneys attorneys are calling a profit making industry. many clinics statewide received a threatening letter from federal prosecutors saying they are violating federal law and now subject to possible prosecution. the suit will be brought in each of the four federal districts in california. that is where a press conference will be held this morning to announce the details surrounding the lawsuit. that press conference

marla tellez is live with more on the decision, including the response from several school districts. >> right now more than 400 students, k through third graders atent discovery prep. it's one of fife rocket education charter schools in santa clara county. soon there could be more. last night the board of education approved three more schools to open in san jose next year. they oversee innovative charter schools designed for poor and latino children. the achievement gap separates the disadvantaged children from those more fortunate. this is how the principal of discovery prep seeing it. >> this is the first time that i've actually seen kids invested in their learning and driving their own learning independently. our kids know exactly what reading level they're at. one school will open in the allen rock district. two more within san jose unified next august. not everyone is excited. superintendents of sunnyvale, montana pleasant and santa clara school districts are threatening to sue. the thought is they should approach each school district individually to see if this is something the

marla tellez is live in the newsroom with an update on this.e campaign for safe cosmetics wants you to boycott the signature baby shampoo. they say it still contains two harmful chemicals that could be hurting your baby. today the group released a new report titled baby's tub is still toxic. the report says they are still listed as ingredients in johnson's baby shampoo. both are known as potent aler gins to trigger rashes and other skin problems including exema. they are selling shampoo free of the harmful chemicals in more than a dozen countries. but the united states isn't one of them. >> we looked at the baby shampoo in 13 countries around the world to determine that they are not using a formaldehyde from servetive in several country. so obviously it's possible to do that. we're saying you need to get them out of the baby shampoos that you sell in all the markets that you serve. >> in response johnson & jn son released a statement saying it's gradually taking the chemicals out of the baby products. but says they are safe and approved by regu

i'm marla tellez. >> and i'm jon kelley. lot to get to today. we start you out on campus. u.c. regents are getting an earful at a special meeting this morning. meeting in four sites, and communicating via teleconference. damian trujillo joins us live. >> reporter: they were expecting protesters here at the campus. they reserved this driveway behind me for the overflow crowd. right now, there are more cops than protesters here. let me take you inside the meeting. students and supporters held up signs during the meeting, telling the regents the banks should be paying for higher education. the regents were scattered among the four campuses and each university took turns addressing the board. mayor gavin newsom is on that board. newsom says regents probably deserve to get an earful from students and one grad student says the wealthy need to pitch in. >> i don't think taxes are the only way, but the way they've been doing it so far, which is cutting down on budgets and also, you know, relying on various revenue streams that do not touch the people that, you know -- who very manifest

i'm marla tellez. >> pg&e working to repair its image and, equally important, its gas lines. >> crews are preparing to patch up the line where it ruptured in wo woodside near interstate 280. >> that's where bob redell joins us live from. we understand at this point, this is the very same line that exploded about 13 months ago in san bruno. >> reporter: yes, line 132 that runs south from milpitas north along the peninsula. we're on northbound 280 at farm hills boulevard. pg&e is trying to figure out how to replace the section that ruptured yesterday. the hillside on one side and up there it's limited space that backs up to homes and private property. it's really an issue of access and how to get the equipment up there to make the repair. they're hoping to maybe do something this afternoon. this is line 132, the same one that erupted in san bruno last september, killing eight people. pg&e was safety testing this line with high water pressure when it burst yesterday afternoon, throwing rock and mud on to northbound 280, shutting it down for a short time. right now, speaking -- after spea

marla tellez live in morgan hill with an update. good morning. >> reporter: jon and laura, good morning. this is really hitting this community hard here. that is why the city of morgan hill is hosting a community meeting. it's going to be happening right here where we are this morning, the morgan hill community and cultural center. now, according to the flier that went out about this event, this meeting is to address any questions or concerns people may have regarding the drive-by shooting that left a young girl dead. 14-year-old tara romero of morgan hill was shot and killed in the senseless shooting that happened friday night near cosmo and del monte avenue. romero's father says the teens were simply waiting for a ride home. he says they were sitting innocently outside an apartment complex when gunfire rang out. police say the five suspects are gang members. one was on probation. they range in age from 17 to 23 years old. three are from morgan hill, one from san jose, the other from gilroy. today all five are scheduled to be arr
