mary mccormick served as the acting assistant attorney general for national security and justice and is cost of the msnbc podcast muted prosecuting donald trump." she joins me now. mary, i found this really quite striking, because you and i had a discussion precisely about this, about mentorship, about trial experience, about the complexities of trial like this vs. a judge who has only done a few criminal trials. what was your reaction to this? >> i thought of that very conversation, chris, because i said, she sits in a courthouse along with no other more senior judges, and in the district where i practiced for so much of my career the department of justice, even still, there is such a wonderful group of senior judges who take a new judges under their wing and help them to understand how to manage a big, obligated case, how to understand classified information, seizures, and might have urged -- as it appears from this article -- that a chief judge down in florida might have urged her to not take this case, given the previous rulings she had made and been reversed on by the 11th circuit related to, essentially, halting the government's review

judge marie sean gag order balancing trump is allowed to attack judge chutkan, allowed to tag judge merchan, but protect law enforcement personnel doesn't look like that's happening here. >> it was interesting special counsel, prosecutor, and it was very sensitive. have to apologize to judge cannon for being, quote unprofessional during today's hearing can address down the prosecutor twice today. this is a potential misstep. how big of a misstep is this? >> well you never want to have to be in that situation of having to apologize of crossing the line. i thought it was vigorous advocacy that got a little too hot that happens. but again, judge cannon is a special case. normally, judges will countenance a bit more of that back-and-forths. so i think the apology in the end was the right thing to do and whatever she may do on the gag order, they can't afford to have a rule against the legality of smith's appointment. >> there was interesting, judge cannon, as you know, at least heard arguments today targeting the special counsel, jack smith's illegality and doing what he's doing. she asked many

. >> so i want to dig into some of the numbers in this newhs maris poll of ohio, which shows trump leadingan the margin of error. inflation and preserving democracy were tied as the most importantie issues, 59% say the and59 their families were bette off while trump was president, including 13% of democrats. so how much urgency does that telegraphdo for biden? >> a lot. it tells them that he -- like i said, he should be running out of -- he's running out of that time. you know, one thing that they feel like democrats and liberals haveat talked to them about is like finding an enemy, right? because they can't be the bad guys. so they have to be able to tell voters who the bad guy is, and so you look at the kinds of thingsin they're doing on junk fees when it comes to airlines, concerts and those kinds of things. they're trying to tin get voter someone to be angry at, and then they, theat knights in shining armor are fighting those enemies. that'sse something they are tryg to do. that's probably the best they can do. they are workinge on things li housing because they -- and talking about th

trump knows he cannot win. joining me now is barbara mcquade, former u.s. attorney, professor at the university of michigan law school, and msnbc legal analyst. and mary mccord, former acting assistant attorney general for national security and cohost of the prosecuting donald trump podcast. thank you, ladies, both for being here. i'm going to start with you mary at the table. is there any world in which that search warrant is invalid, and can you imagine why a judge would hold an entire hearing on that question? >> i don't think there's any world based on the arguments that were made, and actually some of the reporting out of the courtroom does seem that judge cannon actually was also skeptical of trump's arguments. he made arguments in two flavors. one was that he was entitled to what's called a frapg's hearing named after a case called franks v. delaware which says if there are recklessly misleading information or omissions in search warrant, and if without those, there would not have been probable cause, then the entire -- the evidence seized pursue nlt to the search warrant could be suppressed. he wanted to have a hearing and hear from agents abo

our chief white house correspondent mary bruce and rachel scott, who's following the trump campaign, king the very latest. mary, we'll start with you. president biden has been hunkered down at camp david practicing for the big showdown. what can you tell us? >> reporter: that intense prep continues today. the final day for him to prepare. the president is doing 90 minute mock debates at camp david. his personal attorney, bob bore, filling in, playing the role of donald trump. while the president remains behind closed doors, his campaign is continuing to give us a preview of what's to come tomorrow night. they are hammering trump where they feel he is most vulnerable. arguing he is a danger to democracy. today they're getting backup from a republican former congressman adam kinzinger. he is officially endorsing the president, citing trump's role in the january 6th attack on the capitol. kinzinger has been a vocal critic of the former president. he said while he doesn't agree with president biden on everything and as a live long conservative he never thought he would see himself endorsi

ann-marie you still think five is going to win this election. you do right trumpis own issues as well. what is going to be his biggest test? >> frankly, not going off the rails and coming into hot. the joke around washington last week while you were eating gelato was trump comes to washington and all of a sudden he is sounding reasonable in meetings with business leaders, house republicans and where did they put the other trump guy? his major problems are twofold. the republican is split, as you can see from the nikki haley vote in the primary and trump hoarding haley, and that he is not doing that great with independent. he needs to do both, consolidate the republican party, appeal to more independents. he's going to have to calibrate himself in that way and not worry too much about making biden jumpy or feel worse. anne-marie: if it is sunday, it is trump vp day and you see a lot of potential except the airwaves yesterday. where do you see the shortlist right now for the trump camp? >> honestly, where it should be. i have no personal idea what trump is thinking.
