mccloskey he did not activate his lights and sirens. teddy bears still being dropped off at the site where this community lost a 10-year-old boy two weeks ago. 10-year-old matthew and his buddies were in a race two nights after christmas, a fun foot race to a friend's home across delsie drive for a sleepover. but matthew would never make it across the street. prosecutors say frank line township police officer was responding to a misbehaved juvenile, not a priority or emergency call and did not turn on his lights or sirens that rainy night. he also could not brake fast enough to avoid striking matthew. matt's death today ruled accidental and the officer's actions ruled not criminal. today the chief of police told me he is concerned about the discretion given to police officers about their lights sirens and speed, this one traveling 24 miles per hour over the speed limit when matthew was struck. >> the 74 mile-an-hour speed certainly does concern me. especially in a case like this where we had a tragedy and the young man was killed. >> reporter: now the parents who were hosting the sleepover were supervising but the boys decided to race one another to the house.
