. >> maureen kelly. >> the biggest case, with a former bart police officer convicted of the oscar grant. a jury convicted the 28 year-old meserle of involuntary manslaughter. no, he is scheduled to be sentenced, tomorrow. now, he is scheduled to be sentenced, and jonathan?, the judge has a big decision! and a lot of pressure from both sides. at one extreme, the want to show this a tragic accident. and just to give the meserle probation, however, prosecutors want this as an intentional shooting to give him 4-10 years in prison. here are some of the prosecution arguments. they say that oscar grant did nothing to deserve an arrest so should not have been in the handcuffs on the ground and the first place. and he did not pose a threat so he should have never had his gun out. and also, that meserle showed no remorse and did not call to check on his condition. however, they say that he drew his tonguof armed fire arm instead of his taser by mistake. the judge is considering all of this and it expected to hand down a sentence, tomorrow. jonathan blum. >> looming riots, following a protest from
