let me now go, you know this case of mccloskey. we had on hannity last night vowing that he would pardon the mccloskeys, the missouri homeowners who defended themselves from rioters, criminally charged forward by the radical prosecutor kim gardner. here was a reaction, st. louis homeowner mark mccloskey. i'm sure that made you feel well, your guns were legal. you were threatened, you described on this program. they told you what rooms, i'm going to take that room and your dog is going to die. and yet, this is how you've been treated and now it's going to take a pardon from the governor to get you out of this which he pledged last night. your reaction? >> just hearing what's happening in chicago, st. louis is not a big city but we've had 135 murders in st. louis so far this year, all but 12 of them black victims and the prosecutor chooses to prosecute me for defending myself? not a single person that broke into my neighborhood is being charged with anything even though they are all admitted criminals for having trespassed at a minim

tell us what's happened since she opened an investigation into the mccloskeys? >> good afternoon. brianna, quite simply did what any elected prosecutor would do. opened an investigation to look at two people pointing guns at other and since that time received numerous threats to her life. some vile racist sexist commentary, and it's a real problem that is being exacerbated by the president of the united states. >> tell us how you see that? that he's involving himself in his case? >> well, he recently fwe lly twt something about her and her investigation. which is insane given that this is a state and local matter that should stay a state and local matter, but we see people trying to elevate this for no reason other than to try to intimidate ms. gardner. >> after he tweeted or amplified that, what was the effect when it came to the thetreats? anything you saw? >> receiving threats just at the beginning of the investigation, and since the president's tweet, she received even more threats and even more, really, horrific emails, posts on social media. people are reaching out to her wi

judge jeanine: we all remember the mccloskeys of missouri defending their home from protesters. now authorities have seized the rifle marked lawsky can be seen holding. joining me now is clay county florida sheriff darryl daniels. thank you for being with us. it appears that when you had some protest in your county you actually talked about the peaceful protester by the right you would deputize law-abiding citizens to assist you in handling things. how would that happen in? >> well you know everybody has a right in this country to peaceful protest under the first amendment however stepping out from under the umbrella of the ostentation you become inciting a riot whatever the case may be. criminal misconduct is unacceptable in all states and law enforcement is law enforcement all states and as far as i'm concerned in clay county the people who have the most skin in the game or invested in the success of the county are people who live in the county and have been experiencing across this country are individuals who don't live in a certain area that are going to these areas to manif

going to drop you right there because we don't have a lot of time but we've been looking at the mccloskeys they are on the property and he has an ar-15 and she has a handgun. there was a search warrant where there was a seizure of the ar-15 a deacon see on the screen and apparently the handgun is in possession of the attorney. what do you think prosecutors could be looking at? they are on their property. what do you think is going on there? >> at think maybe from the eyes of the prosecution they are looking at the fact that these two homeowners are they an imminent danger in an peril to their life and were they in a situation where they had to protect their lives? if they pointed their weapons at people were passing by albeit peaceful protesters or even if they were violent protesters if there was no tangible threat that they can articulate they may have some problems in st. louis. judge jeanine: it will be interesting to see because first they said maybe charges and no charges and now they have seize them. sheriff daniels thanks so much for being with us and we hope to have you back soon.
