mcconnell doesn't have the 60 votes. up the filibuster to get it done if the republicans took back the senate. so what is it? >> well, this is mitch mcconnell, so we have to kind of look at what he is saying and then look at what he is doing. and we also need to remember that the person who blew up the filibuster for streaupreme cour justices was mitch mcconnell. so while he is saying that he would always protect the filibuster, he has done more to undermine it. and i think that we have to assume that there aren't the votes for blow up the filibuster. democrats have tried do it, they were unable, republicans will be even more unwilling to do it. and we also have to look at the votes themselves. it doesn't look like that there are 50 votes for the democrats proposal to codify roe v. wade into law. and by the same token because there are several republicans who describe themselves as pro-choice, there aren't the votes, 50 votes, to do the opposite. to put a nationwide ban. so i think that we're stuck where we are at least
