again, a verdict reached is legal analyst michael cardoza. michael, really a pleasure to see you.u. here we are, a verdict after seven days of deliberations. does the time suggest anything to you? >> i've done this over 40 years. absolutely not. you never, ever know what a jury is going to do. i remember when i was a prosecutor in alameda county. jury stayed out for 3 or 4 days on a murder trial. i was prosecuted, and for the life of me, i couldn't figure out why are they out so long? and then they would ask questions indicating they were going for a not guilty verdict. and i was just beside myself. they come back with a guilty verdict, and i learned that only one juror had a lot of questions, and it took the other 11 to be very patient and asked the question, so you can't tell where they're going. it's really difficult. >> okay, so nothing to read into the seven days of deliberations, but the jury did notify the court around 4 p.m. today that they had reached a verdict. correct. so as i mentioned, it's going to be read tomorrow. do we think that decision to sort of postpone the p

but again, as michael cardoza, our legal analyst, rightly pointed out, they have to figure out whereney would come from if there's a settlement or it goes to trial, because obviously mr. mcenany arguably be penniless. and you have to make sure that there is something in it. if you pursue that route. >> henry, you know, we hear from the defense attorneys quite a bit during the six weeks of this trial here. have you been able to talk to them at any length about about the verdict itself and what they plan to do next? >> well, we did hear from tony brass again. he says he does plan to appeal. now, the other attorneys we did see zoe aaron, who's based in la, in person here, the other attorneys who are from miami, piped in through zoom. but again, tony brass told us that they will have to take a look at the entirety of this case, sit down in a calm fashion, look at the transcripts, review some of the judicial decisions that were made in arguing for perhaps a new trial, or to find some kind of reason to argue that this conviction should be overturned. so a lot of work still has to be donend

we have our legal expert, michael cardoza here. pick whole thing apart. well, see thank you. so surprised by the verdict. no, i thought. >> to my mind, it was a they're coming back. involuntary manslaughter or second-degree a first-degree would have surprised me because i don't think there was quite enough to get to the willful, deliberate and premeditated part of it. it seemed to me it was more a little bit spontaneous and then not guilty. what of absolutely florida bay. so no, it doesn't surprise you'd indicated that the prosecution didn't seem prepared. >> to handle the defense claim that bob lee had the knife and was doing cocaine off the knife. what do you make of of what impact that may have had on the trial? well, i'm sure the jurors talked about that and apparently at some point. >> they were satisfied that was untrue. and i was on the right thing now. remember, none of us saw that video where there was coping and snort it off the ledge at night many said bob lee had. and remember the family because you pull out the color. her not right. i remember ground pull those c

we want to dig a little bit deeper into the verdict that came out today with our legal analyst michael cardoza. michael, thank you for being here. took 17 for the jury to reach a verdict from what you've heard today, reach the right conclusion. >> i think they did reach the right conclusion with the facts that presented to them with the jury instruction with the time they took a bet that this evidence very carefully and they did come to the right decision. >> and they rejected the defendant's claim that he acted in self-defense. that was really the crux of the issue here. >> that that's correct. the jury had a choice. i'll be their first degree. which would have many. 25 to live. plus use of the night. so 26th to live second-degree murder is 15 to life with the use of the night's most extend the life voluntary were involuntary manslaughter and that cups down to a top or 12 years, which i think 2 or 3 at the bottom so they had to vet all that. although the jury is instructed do not. deal with punishment. that's not your job. as a juror they wouldn't know unless they knew in their private life.

joining me now live to discuss this is our ktvu legal analyst, michael cardoza. chael, always a pleasure to see you. this video was included in evidence but not shown to the jury until now. what's the defense's strategy here? >> well, what they're going to show is if it's true, if he was bob lee was snorting coke from something that looked like a knife. it's going to bolster their theory that bob lee brought that knife to that argument under the bay bridge. so the one thing that comes to me, heather, though, is you know, this tape was in evidence. did the district attorney think that they wouldn't point this out? why didn't they address this earlier in the trial, or did they not notice this? i mean, this is a surprise to me that the da didn't answer or address that earlier in the trial or an argument. >> do you think then, that this this helps the defense? >> oh, absolutely. it helps the defense because remember they're saying they didn't bring the knife that bob lee brought the knife. if this video does show lee snorting cocaine from a tip of a knife, it in effec

let's bring inegal analyst michael cardoza. michael good to see obviously. yeah.the had a number of ways they could have gone here when they this decision. why do you jury landed when they looked at the first. that's ns you had an intent to kill the willf the premetated. the jury looked at a i came to the conclusion. no, this was more of a reaction to what was going between the sister and everyone, and he not premeditated. there was something that happened more at the scene of the murder that set mo many off. that's why the not guilty on the first. as for the second that's premeditate no willful, no delibere, premeditated. but the malice aforethought for the second, the intent to kill. and that means when they get to the second, they said, there's no excuse for this killing. there is no voluntary meaning you did it in the heat of passion. that would take it from a second, because both are intent to kill. you have an intent to kill for the second an intent to kill for the voli/untary. butçu to get itad to be i of passion. they said it wasn't that kind of passion. t

michael cardoza, our legal analyst. thanks for being here. michael. >> you're welcome. so we just heard from the defense team that they were surprised it wasn't a lesser verdict for many. are you surprised? >> now, i'm not surprised at all. i thought the jury came to a good verdict. the second degree as well reasoned certainly based on the evidence and by the amount of time that the jury spent out, they certainly carefully dissected invented the evidence. so it's not a surprise. anything less to me would have been a surprise. >> and 7 days of deliberations in comparison to other criminal defense cases that have been a part of was this averages. this was this a lot of time for the jury. not a lot of time for the jury. >> i'll tell you why. we turner's got together and you try to speculate as to how long a jury will be out. we can never do that. i've had very seriously a misdemeanor case. i tried. they came back within 5 minutes. i've had murder trials out for as much as 8 or 9 days. so nothing surprises me in this case, it appeared to be an appropriate amount of time tha

joining us now to break down the verdict is our legal analyst michael cardoza. thanks for being here. certainly. so there was this defense claim that got rejected by the jury today where some other possible for dick's that they could have come with other than second-degree murder. >> the side second great. you start with the first degree they found not guilty of that. as you know, they went guilty on the second degree. the other possibilities were a voluntary manslaughter. they didn't get to that because they found him guilty of a second or involuntary manslaughter. i think get to that because they found him guilty of a second degree or they could said not guilty because he was defending himself. in other words, if they came back not guilty and that sons, they would be saying we believe that he thought his life was in danger or is in danger of great bodily harm. and that is taking the life of bob lee was in self-defense. they didn't get there. they got to the second degree. >> i also want to ask about something we heard from bob these ex-wife or she was saying s

ktvu legal analyst michael cardoza says nothing is predictable with juries when it comes to trying to speculate how long it will take to reach a verdict. >> in my career, i've had a jury stay out literally five minutes, albeit that was on a misdemeanor and on felony cases. stay out over a week, so there's no telling how long this jury will stay out. >> another veteran prosecutor said an unofficial estimate of how long a jury could be out can sometimes be predicted by calculating one day for every week of testimony, and the mini trial has lasted for six weeks. jurors are set to return tomorrow to continue deliberations. one person was killed in a solo vehicle crash in san jose this morning. sky fox was overhead shortly after that crash that happened near snell avenue and truckee lane. police say that is a 1989 white mustang. it was traveling southbound on snell avenue when that car veered off the road. and as you can see there, it crashed right into a tree. now, the man at the wheel was killed. police say this is the 47th fatal collision in san jose. this year. ktvu legal analyst michael cardoza says there are a number of possibilities for the verdict. >> the fact that the jury has come back and said they have a verdict means that they've reached a verdict. they are not hung. they have unanimously come to a conclusion. now, is that conclusion slash verdict a not guilty verdict, or is it guilty if it's guilty, is it guilty of a first degree murder or a second degree murder, or a voluntary or involuntary manslaughter? we have to wait until that verdict is read tomorrow morning. >> so clearly, there's a lot of activity behind the scenes. but out in the hallways it was fairly quiet. we did see the two prosecutors and one defense attorney going to department 28. again, fairly quiet, but it will not be quiet. it will be very busy tomorrow. we expect a full house, mike. >> you bet. indeed. you said you saw some of the jurors leave. could you get a sense of their demeanor as they were exiting the hall of justice? >> there no way to tell. we've been fooled before, you know, some certain specks of emotion. but we cannot read the tea leaves and read anyth
