how distant was the officer actually from mr. brown when the shot started and when they ended.e ground. how tall is the officer and the height of the muzzle when he is pointing it. so all of these are data points, allç of this is information that we still don't have. and that should be presented in order to get a more nuanced picture, a more complete picture of what happened here. >> woodruff: you have obviously dealt with a numberç of-- many cases over the course of your career. is it possible to say from this what the grand jury would take away from this? >> at this point, we can't say what the grand jury is going to do. and it's going to depend on what they see. and they are sequesters. they are going to be seeing evidence that we done see. all we have been given is what was apparently leaked. so it's not a complete picture by any means. and their determination is going to be based on the complete set of data, not on just snippets of what we are seeing here. >> woodruff: . >> woodruff: last question, michael brown's family said that they do not accept the results of this a

namely, what was the position of mr. brown when he was shot by officer wilson? was he lunging towards officer wilson, posing a threat, or was he falling after having been shot, and then he sustained those shots to the head and the chest as he was falling downward? >> and in your view? >> well, i can't be certain. the shots in the arms with the slightly upward direction would fit with the arms somewhat flexed like this. so that he's falling and the bullets come in and they hit one in the upper arm, slightly upward, one in the forearm slightly upward. that would fit then with the position of hands up. >> can two pa thotions look at the same -- pathologists look at the same body and interpret two different ways? >> you see the same thing, you make the measurements in an objective precise fashion. can they interpret it differently? yes. while it's surely professional and reasonably contemplated, that doesn't mean that we are free of bias just because we're million examiners. so there is a tendency, not because of some preconceived and known bias, but because it's --

mr. brown is facing three murder counts in the state of washington and one in new jersey.hat do we gain if he is charged with a federal charge on top of it? >> not a whole lot and the possibility that if they can tie all of that together and make it murderers in aid of terrorism he could get the death penalty in a federal court but it's the effort, given what's gone on until now wouldn't be worth it. >> it's interesting. the american people really want terrorism charged on this even though he is facing these four murder counts and the terrorism wouldn't give us much. but the american people seem to want a federal terrorism charge in these cases. >> it walks like a duck, quacks like a duck is it terrorism. you have a motive that is idea lod ideologically driven. if we don't treat it as a terrorism case are we giving free passes to future cases? >> if we had unlimited resources i would be with you on that. but a judge will tell you a lot of the prosecutors and agents are so taxed that we don't have the luxury of going after them. >> i don't disagree with that but it's the de

officers wilson said mr. brown punched and scratched him repeatedly leaving swelling on his face and cuts on his neck. wilson shot brown to death later outside of the car. so joining me now, joey jackson and also here mike o'mara. let's just begin with you, joey. my first question is why? why are we hearing about these leaks from this police officer from the first time in "the new york times"? are they preparing the public for something major like a nonindictment? >> it's a fabulous question and one i can't answer. why? because you and i both know about grand juries. the integrity of proceedings. they are secretive and that way for a reason to present the evidence and present the information to that panel. remember, there are 12 people on that panel and standard is low. probable cause to believe that a crime was committed and that darren wilson committed it. why this information is being released to us is the open question. >> why, same question to you. >> i keep saying we should not do this piecemeal because it al
