let's hear from our next speaker, mr. chiu >>> thank you, president chiu. good afternoon, supervisors. my named is alex chu. i am the president of the american association of cpa firms, council of american business association. i'm here to talk about a couple of items that have been raised. first one is the need for an antiretaliation legislation. there have been many instances of city department heads and project managers retaliating against minority owned lbe firms for simply making inquiries into how decisions are made with respect to contract awards or making inquiries as to whether or not the lbe ordinance has been properly apply. in many retaliations, it has resulted in loss of income to firms and owners. also, such retaliations have resulted in cutbacks in employees. because of the prevailance of such retaliation, individuals are afraid to speak up about the lack of opportunity. people are afraid to report the failures and refusal to apply the lbe ordinance on the part of department heads and project managers for fear of retaliation. people have even

herrera and mr. chiu may want to address and that's on page 13 of the ordinance with definition of a non-profit organization which is based on the word active refers to any entity that within the past 2 years has attempted to influence city legislator administrative action. on the other hand at the subsequently there is a reference to any non-profit organization to whom it should be to which, a developer has made cumulative donations of $5,000 or more since the date 1 year and before an application for environmental review occurs. i maybe missing something, but it seems to be an inconsistency between the two 2 years and the 1 years and i'm sure that's easily curable. finally i want to comment and commend the sponsor and the author for attempting to get a handle on the conduct of attorneys. attorneys historically have been able to hide behind attorney-client privilege while lobbying like a non-attorney does at city government. i think that's a major recognizable effort to face the fact that attorneys are n

mr. chairman, members of the committee, president chiu. on page 14 of our report we note that according to the rpd coit tower llc is estimated to pay percentage rent to rpd, a million 2 24,500. that would be in the first year of operation. and that is ~ 3 28,43 2 or 26.8% more than the renovate [speaker not understood] paid in 12-13 under the prior lease ~. revenues projected to increase 1,508,272 in the fifth and final year of the lease agreement and that's shown in table 5 on page 14. so, you'll note on table 5 over the five-year term of the lease of the initial term of the lease, the projected total revenues are 6,5 58,87 2. on page 15 of our report, we state that because the city is responsible for maintenance of coit tower under the proposed lease, we recommend that you amend the proposed resolution to state that the maintenance needs of coit tower will be included in the city's ten-year capital plan. we recommend that you approve the proposed resolution as amended. and again, i'd be happy to respond to questions. >> president chiu? >

president chiu. >> i want to thank mr. zew for the work you put in with the working group. i look forward as that process comes to a close figuring out the allocation of fund here. clearly there is a need and we've got to figure out both where the revenues are going to help us meet this need as well as where the monies can be best used. thank you, thank you. >> supervisor mar. >> thank you, mr. zew, especially for the work that pulled that working group together. i did have a question from harvey rose and the budget analyst report. in 2000 there was 1.5 million supplemental from the general fund reserve for art organizations and a $3 million allocation for nonprofits with 500,000 for rent subsidies. and i'm just wondering why there's no mention about the arts organizations, california lawyers for the arts, 500 million, and $500,000 of the 3 million for the rent subsidies. why is there no information on that? >> well, in terms of the $500,000 to the rental subsidy n 5,000, before i joined the department. but in terms of examining the use of that fund, as far as i can determi

municipal transportation agency to implement a market on the move pilot project. >> president chiu. >> thank you, mr. chair. colleagues, we have in front of us resolution to urge the san francisco municipal transportation agency to implement and market on the move pilot project with private vehicle diversions and other efforts to help improve our streets for transit riders, cyclists and pedestrians. this has been a several year conversation, in fact, in 2011 we unanimously approved a similar resolution to begin pilot studies of innovative transit policies on market street. and i know there have been a lot of community frustrations with the lack of progress in this area, which is why i have been asked by numerous transit advocates to move this forward. colleagues, i think we all share a vision of market street as being one of the world's greatest boulevards and i think we know that in order to get there we have to try new things, particularly as we are thinking about a completely new way of how we travel on market street. so, i do hope that you'll be able to support this and ask for your support. >>

so, i'll turn it over to president chiu. >> thank you, mr. chair, colleague, thank you for your patience as well as the patience of the members of the public that have been waiting for this item. colleagues, i have asked for this hearing on the implementation of chapter 14b of administrative code otherwise known as local business enterprise and nondiscrimination and contracting ordinance. as some of you may know, three decades ago, this board of supervisors passed chapter 14b after acknowledging the history of passive and sometimes active discrimination in our city's contracting policies. in order to fulfill san francisco's commitment to economic development for all of our diverse communities, this is a law that over the years has had to foster a vibrant network of small and micro diverse businesses throughout san francisco. now, there are three reasons why i called for this hearing. first and foremost we wanted to get a status update on chapter 14b. in 2012 mayor lee by executive order moved our city's contracting compliance staff from the h

mr. zew. >> good afternoon, supervisors, brian chu [speaker not understood]. as supervisor chiu and kim mentioned, our office has been convening a working group composed of representatives at city departments as well as members of the community, but not only through our office, it includes the mayor's office of public policy and finance, oewd, hsa, dpr, dcyf real estate division, planning department, controller's office, and about 11 or 12 community based organizations. we've had two formal meetings so far, one in december and the second one in january. we plan to have two more meetings. one in february and one more in march. our hope is to deliver the final report beginning in april to comply with requirements put forth in the working group sponsored by supervisors mar, kim, and cohen. you'll see in the budget analyst report that we did not give a full recommendation as to how the 2.515 will be allocated so far. in speaking with the
