let's hear from our next speaker, mr. chiu >>> thank you, president chiu. good afternoon, supervisors. my named is alex chu. i am the president of the american association of cpa firms, council of american business association. i'm here to talk about a couple of items that have been raised. first one is the need for an antiretaliation legislation. there have been many instances of city department heads and project managers retaliating against minority owned lbe firms for simply making inquiries into how decisions are made with respect to contract awards or making inquiries as to whether or not the lbe ordinance has been properly apply. in many retaliations, it has resulted in loss of income to firms and owners. also, such retaliations have resulted in cutbacks in employees. because of the prevailance of such retaliation, individuals are afraid to speak up about the lack of opportunity. people are afraid to report the failures and refusal to apply the lbe ordinance on the part of department heads and project managers for fear of retaliation. people have even

herrera and mr. chiu may want to address and that's on page 13 of the ordinance with definition of a non-profit organization which is based on the word active refers to any entity that within the past 2 years has attempted to influence city legislator administrative action. on the other hand at the subsequently there is a reference to any non-profit organization to whom it should be to which, a developer has made cumulative donations of $5,000 or more since the date 1 year and before an application for environmental review occurs. i maybe missing something, but it seems to be an inconsistency between the two 2 years and the 1 years and i'm sure that's easily curable. finally i want to comment and commend the sponsor and the author for attempting to get a handle on the conduct of attorneys. attorneys historically have been able to hide behind attorney-client privilege while lobbying like a non-attorney does at city government. i think that's a major recognizable effort to face the fact that attorneys are n

municipal transportation agency to implement a market on the move pilot project. >> president chiu. >> thank you, mr. chair. colleagues, we have in front of us resolution to urge the san francisco municipal transportation agency to implement and market on the move pilot project with private vehicle diversions and other efforts to help improve our streets for transit riders, cyclists and pedestrians. this has been a several year conversation, in fact, in 2011 we unanimously approved a similar resolution to begin pilot studies of innovative transit policies on market street. and i know there have been a lot of community frustrations with the lack of progress in this area, which is why i have been asked by numerous transit advocates to move this forward. colleagues, i think we all share a vision of market street as being one of the world's greatest boulevards and i think we know that in order to get there we have to try new things, particularly as we are thinking about a completely new way of how we travel on market street. so, i do hope that you'll be able to support this and ask for your support. >>
