justice jackson: yes, please. mr. strawbridge: even -- even -- even g establishes that a holistic admissions process doesn't make the injury go away. justice jackson: but you've said grutter needs to be overruled. so we can't -- i don't think we use that decision as the basis for standing mr. strawbridge: one of the problems with r that i think illustrates this specifically is grutter's suggestion that race can only used as a plus factor and never a minus factor. but, as many of the dissenting opinions in that case obserd -- and cases from --- or opinions from this cove since observed, that makes no sense in a zero sum game. if we are going to consider race and we argue that a racial classification, which , you know, highly disfavored at law because of its necessarily invidious nature, is going to be used -- justice jackson: but -- but wait.'t -- mr. strawbridge: -- then, presumably, it must be doing some work. justice jackson: i actually don't think that that's the way standing ordinarily works, and i'm worried that y

mr. lacourmm. justice jacksonso we already have this idea that there's some probcause we have racial segregation in housing at step 1. tep 2 is asking, do we have a problem in the sense that are voting in racially step 3 is also that kind of dynamic. do we have a situatiwhich you know, majorityro is always voting in the same way? these are really tough things to ish, and, collectively, , the situation that we areral approaching in ttuation. we are talking about a situation in which race has already infue voting system. so can you help me understand why you think that the world of, you know, race-blind redistricting is really the starting point in this situation? mr. lacour: well, let's think about why you have a compactness inquiry in the first place. it's to make sure that no one is being harmed on account of a ckf compactness. and that's why traditio districting principles are part of this inquiry too -- juicjackson: i don't think so. i think it'how that you have racial segregation in housing happening in this s

mrs. jackson way is six plus acre facility within mclaren park. it features a children's playground, clubhouse, two basketball courts a ball field and a pool. this project is being delivered through partnership agreement with sunnydale infrastructure llc which is a project between mercy housing california and related california that is implementing a large scale multiphase development program called hope sf sunnydale neighborhood development plan. the grant agreement between the department was approved by the commission and the board of supervisors in 2021. herz recreation center is a a project in the 2020 health and recovery bond. the concept plan was approved by the commission in march 2021 and we have the full support of key community stakeholder as mentioned in the staff report. due to the funds sources including federal, city and private funds a variety of regulatory requirements apply to the project. this project is covered by the city-wide project labor agreement pla. we anticipate construction to begin in september 2023 and open to the pub

justice jackson: because the cotion tells them -- mr. verrilli: that that's argument. justice jackson: yes. . verrilli: if i could, there's just one last point i would like to make about whose ox is being gored here, which i think is quite important. acally, there's a great deal of sentiment in this country about the probith extreme partisan gerrymandering and this court's opinion in rucho acknowledged it. and states have actually red in nonpartisan ways. i can think of four states, new york, florida, cala and ohio, all of which are in the control ofolitical party where presumably the incentives would havelined up to maximize partisan advantage through the redistricting process, but in all four of those states t through the work of the people to restrict partisan gerrymandering ase provisions have been enforced. i mean, the ion was enforced in new york, of course, just earhis year. and so, i do think it is more than whose ox is being gored. this is a really important issue in this country, and i think it would be an extraordinary thing to say, as my friends on the other

justice jackson: you're saying you need that as a constitutional matter because that's what the 14th amendment requires? mr. lacour: as an evidentiary matter. justice jackson: so we don't have a problem that the constitutioneating. it's as an evidentiary matter, we have to have neutrality. mr. lacour: well, no, your honor. if their evidence is bad, then you n e risk of replacing a neutral plan with a plan drawn on accou orace, which would create its own section 2 viola i think a white republican in mobile or a black republican in gerrymandered into the new district 2 and connected with people on the georgia border ulhave a section 2 claim himself because his vote has be abridged on account of race. so you can't read section 2 that way. equal openness and equal prot need to line up and they don't under plaintiff's approach. and we need a benchmark because obviously we need some clarity in this space. we've offered a benchma i have seen no benchmark in the briefs from the united states the plaintiffs, and -- and maybe they can illuminate that for us in just a moment. chief justice roberts: thank you, counsel
