we know who leader mccarthy actually believes still is the leader of the republican party. that would be mro congresswoman love's point, she's thrilled with this choice, and she mentions marjorie taylor greene, the big trump lie. is senator scott a break from that or just a pause, if you will? >> well, i think he's certainly presents very differently, he's calm, he's reasonable, he doesn't spout a lot of nonsense. but make no mistake about it, john. senator scott is a very, very conservative republican. he voted with donald trump about 90% of the time. i think 91% was the number i saw. and donald trump has already fully endorsed him re-election next year. so tim scott is a trump republican, make no mistake about it. here and there, i think mia love is exactly right, he and there, he has sort of broken with what the party might have expected. a lot of that, though, is local, and it's regional, where he called for, he was an early and important voice calling for confederate flags to come down off of government buildings. that's important. but that's limited. what he's being asked to do now, n

mr. guliani looks like a criminal. first of all, he's an attorney, a former attorney to the president of the united states. andy mccarthy, your take on what happened, what they're after and what happens now. >> well, it certainly is aggressive, martha. if you are a subject of an investigation, you have a lawyer who has been dealing with the government, the only time they do a search warrant that they should do a search warrant is if they think there's a strong possibility that evidence will disappear or be destroyed. otherwise you tell them to surrender what they're looking for. they didn't trust that. the other thing i would say is, i'd be suspicious of the claim that the investigation is basically about a fara violation. i think prior to the mueller investigation where that was used as a pretext for doing what they did, there were about seven prosecutions by the justice department in the half century before the mueller investigation. only three successful. it's a very tough proof if you're going to treat it seriously as a crime. historically the justice department hasn't. they have encouraged people to get with the la
