he's a msnbc legal analyst and host of the podcast courtside, with neal katyal. written and argued 50 cases before the united states supreme court, 50. neil, the collection of briefs that we have now, from the parties and from these amicus briefs, is really quite astonishing. and the historians brief really is like no other i've read. i am sure you've read briefs like it. but, it really surveys, in such an economical way, exactly the history that the court needs to focus on. >> yeah, exactly lawrence. i mean donald trump has tried, criminal defendant donald trump has tried to protect its only lawful live -- who think it should be taken off the ballot with the supreme court case. but brief by brief, we have seen him proven wrong. i mean, these are respected historians, that is the professor of -- that we've been talking to on the show. today, there is also top briefed by top constitutional scholars, briefs by steadfast conservatives like judge luttig. and they all say trump should be disqualified. >> -- i think we've got a problem with neil's connection right now.

with neal katyal, both msnbc legal analyst. and neil, on supreme court nights we go straight to you because you are the supreme court practitioner, here. let's go to the threshold question. the trump lawyers filed a petition for the supreme court to hear the case. will the supreme court grant that petition and hear the case? >> almost certainly, yes. lawrence, we've seen many times, other cases involving trump that the supreme court doesn't take them. they take very few cases a year, about 60. but i suspect that this is one case that the court can't pass up. and indeed, both sides are basically saying to the court, to the supreme court, take this case, we hear this case. i very much suspect that they will. i think they can order a briefing to occur really quickly, and oral argument to take place in a matter of a few weeks. >> andrew weissmann, what stands out to you in the trump petition to the supreme court? >> two things, one is that as a matter of being a lawyer and in the same field that neal is an, the amount that we have

but, neal, to katie phang's point about the jury, i thought this was really remarkable. judge kaplan, the judge in this, case told the jury, my advice to you is that you never disclose that you were on this jury. first of, all neal, how unusual is it for a judge to say something like that to a jury? and if you are a member of the jury, talk to me about how extraordinary that position is in the age of trump. >> in a quarter century of practicing, alex, i've never heard a statement like that from any judge. it just does not exist. and it just demonstrates how far out of the norm donald trump's, and what he does to people who call him, out and hold him liable. and so, e. jean carroll has to fear. the jury has to fear. and this judge is not like some wild eyed lefty judge. this is one of the most respected judges in the country, judge kaplan. i don't think he's considered political in any way, shape or form. and looking for him to say that, i think, it's pretty extraordinary. and then to pick up on a point that katie made, if i were one of trump's criminal attorneys right no

and this is a big one, neal. and that is tell us about the role of precedent on the supreme court and what does the top decision say about this court's attitude toward precedent? it says that they can overrule any precedent any time, anywhere. that is, if you can overrule roe, which is what think every justice at their confirmation hearing called a super precedent. and what justice o'connor, kennedy and souter said was a super precedent. and you can overrule anything. and let's just take, for example, the judge's discussion of chevron. i think chevron is the most cited case by the u.s. supreme court ever. and so this is woven very much into the fabric of the law. congress, when it's been passing statutes since 1984, has passed them in the shadow of chevron. so they understand they don't have to so resolve every ambiguity because the agencies can do it for themselves. well, it now looks like the supreme court is poised to overrule chevron. and i guess i disagree a little bit with the judge. obviously, he does this

i tend to agree with neal in large part on the legal issues here. i have a little bit less confidence than he does that the supreme court will uphold the ruling of the colorado supreme court. i think that they may look for a procedural off ramp that lets them off the hook for deciding here, but joy, what stands out to me is that the supreme court is only being asked to make this decision because republicans in the senate abdicated their duty following the 2020 election to convict donald trump on articles of impeachment. that would have established for all time the issue of whether or not he was eligible to run again, and so we're at this juncture for reasons of political failure. and that's something we should hold on to going into this next election. >> and that is such an important point, neal, because not only that, but you have a president who attempted to strongarm and bribe a foreign official in order to try to undermine joe biden. they let him off the hook on that. this is a president who stole classified documents, put them in his house. rep
