let's go to nick valencia. he joins me. what more are you learning about the passenger and this rescue? >> reporter: this is a remarkable story and all the more remarkable here when you consider this 28-year-old man could have been floating alone in the gulf of mexico for more than 12 hours, perhaps 15 hours. realistically, it could have been up to 20 hours. we just got the timeline from the coast guard. they tell us he was a passenger on the cruiseship, the carnival "valor." they had left bound for mexico on a five-day cruise. he was at the bar with his sister. she says he at one point said he was going to bathroom, and he never came back. she goes to bed, wakes up, notifies the crew that he's missing. they check the vessel, and it's two hours later that the carnival cruise notified the coast guard. search and rescue was launched. the boat stopped and retraced its route trying to contribute to the search and rescue operation. he was spotted floating in the water by a boat carrier. listen to a lieutenant from the u.s. coast

for a closer look on what happens next, here is nick valencia in atlanta. a surprise weather. >> we can expect this to be drawn owl in court. robert mcburnie, here issuing his opinion. it was almost immediately after that the tomorrow said they're going to file a notice of appeal. as of right now, effective immediately, the procedure is now legal up to 20 weeks. this ruling, by judge mcburny was in responsible to a lawsuit by a pgroup -- it's officially known as the life act. it bans, with some exceptions, abortion when early cardiac activity could be detected, which is as early as six weeks, at a time when many women do not know they're pregnant. the judge say when it was enacted, it was unconstitutional, because the law of the land protect ed previability of abortion. here's part of his quote, every it was unequivocally unconstitutional for federal, state or local to ban abortions before viability. if the courts have spoken clearly and directly as to what the law is, as to what is and is not constitutional, legislatures and legislators are not at liberty

cnn's nick valencia is following this story.tal of three executions in alabama that have failed or were botched within the last few months. what do we know about them? >> reporter: and cnn has been reporting about these issues for years. we take you back to 2018 when con vicked murderer, doyle ham was sentenced to be put to death by lethal injection and his execution had to be abandoned after officials failed to find a vein. fast forward to this year where there's one or two failed executions or botched execution in july. the death penalty information said said joe james had a botched execution after three hours, his death was delayed for three hours with issues with his execution. al lan eugene miller had his execution abandoned. and last week, kenneth smith had his execution abandoned because of last minute legal challenges. governor kay ivey is saying she wants a top to bottom investigation of what's going on in the alabama department of corrections but she made up her mind that officials and law enforcement officers are not

nick valencia joining us live from atlanta.rate general robert e. lee and a state law that dates back to 2016 that says there is no voting on a saturday following state holidays on thursday or friday. so that week we have thanksgiving and also a holiday that formally commemorates the birthday of robert e. lee a confederate general. they're saying they can't vote on this day. warnock and the democratic party of georgia are arguing they are at a serious disadvantage if this day is taken away from early voting, arguing it's democrats who would use that day to vote. warnock and the democratic party pointed in this lawsuit to comments made by secretary of state brad raffensperger and gabe sterling in the immediate after matt of the midterms in which they said that early voting could be as early as november 26. we reported that, in fact, here on cnn. since those comments were made secretary of state raffensperger has issued a memo to counties saying that that 2016 law prohibits them from voting on saturday. warnock is saying that tha

cnn's nick valencia is in atlanta with the latest., and though we don't know exactly whether or not they are going to officially declare a runoff today, it seems that for the second consecutive election cycle, georgia feels like the center of the political universe, and we did check in with the secretary of state's office. we know there's a small number of ballots left to be counted some including provisional ballots. we don't have an exact number. they did tell us last night, though, they are not so quietly preparing for the likelihood of a runoff. meanwhile, the warnock and walker campaigns, they aren't waiting for the official declaration. they are making plans to prepare for campaigning this next month. one of the biggest take aways, an and anderson, from tuesday were the ballot splitters. he outperformed herschel walker by 163,000 votes. that's a lot of votes here, and how that's going fo factor into the runoff on december 6th i'm sure is concerning to republicans even though they're not voicing that just yet publicly. but at lea

let's go to cnn's nick valencia in canton, georgia, both candidates held first public events today sincek and herschel walker. it was walker who kicked off his campaign alongside republican senator ted cruz the first in what will no doubt be a cavalry of republican leaders to come down to the state over the course of the next four weeks. a source tells me they kicked off in canton deliberately. part of the their strategy is to get out the vote in red counties where they underperform when compared to incumbent republican governor brian kemp who won his midterm election and avoided a runoff. at the rally both kruz and walker boldly predicted a win in the runoff. it was after the rally was over that we caught up with senator cruz and asked him if we thought it was a good for former president trump to stump alongside him as well. >> we're in overtime. that means we've got a runoff. hey, i was built for this. i was built for this. god prepared me for this moment right here. >> made clear he will welcome the support if president trump, who's supporting him, he would welcome the support of ron

let's go back to georgia now because nick valencia is at a voting location in atlanta, georgia, the biggest city there. you have new information from the secretary of state's office. >> reporter: that's right. i want to start, they just closed up shop here. it's 7:00 p.m. the polls officially closed in georgia for most of the precincts here where we are in fulton county, they just started to take away those "vote here" placards. it is quiet here. so quiet you can really hear the hum of the street lights. i have of a registered 3,005 voters, 361 cast their votes in person. i did ask the election supervisor how many of those registered voters perhaps voted early. she said she didn't have that information. but we'd find in just a matter of how manies. there's 2,600 polling locations across the state of georgia. six of them have been ordered by the courts to stay open past that 7:00 p.m. deadline. two of them in cobb county. another two in dekalb county. secretary of state's office also making some news earlier at a press conference saying that we should get results earlier than expected, credi
