this is something that is in dph and oewd's means. if we provide you certain fees that we want to look into and you provide the data, how do we then make that a proposal that some 0 -- we shouldn't be paying the same amount of fees with reduction of inventory and that sort of thing. so i think we need to have a serious fee mitigation effort on dph distributed fees. i think we need to talk about flexible retail, bring the office of cannabis into this and talk about how to have accessory use and small business pathway for these types of businesses that are already used to regulatory structure. i know that with enforcement, this is a sensitive issue. there has been two sting operations on my family's business within three months. we're -- for alcohol. so i'm curious, i brought this up several times. for immigrant owned small businesses, we need to be talking about other enforcement bodies. because nonstop enforcement is a scary thing if there is not clarity in it. and i want to make sure that's going to be increased enforcement efforts w

i just want to start by thanking lisa pagan from oewd as well as planning department. they've been instrumental in working with our office and certainly developing this proposal since the applications have been coming forward. this body beginning in early 2017, that i think kind of left this commission kind of unsure how to exercise its discretions relative to this. also bunt to acknowledge the union square business improvement district. they conducted this survey over the summer which is incredible, to have that data informing this policy. and while i think there are still maybe a few little points of disagreement around this policy, i think it mostly boyil down to a collaborative consensus piece of information, and i just want to thank everybody for being at the table. i just want to summarize, the current controls -- and -- the current controls prohibit nonretail sales and services on the ground floor, on the second floor and up. any nonretail services use over 5,000 square foot is subject to conditional use authorization. that conditional use authorization, again,

as part of oewd's process, stakeholders sfpd were contacted about the building in march of 2018. to our surprise, based on the history of the site, we received a copy of the letter from chief scott to the police, to the city that the police would like to consider rehabilitating these issues. this was a conclusion of the nea process. we requested a meeting with chief scott to find out more about the police department's plans to fill it in. on may 1st of this year, the friends of the dogpatch hub board met with chief scott at the new sfpd headquarters down the street on third street from the hub. we were joined by john updike and others and melia cohen of the board. chief scott said the third street site was needed for additional office space in the community pete -- policing division. we discussed to build a community center on behalf of the neighborhood as well as a pop or its -- possibility of working together. sfpd did not have a feasibility study of the site. chief scott promised a final decision plan that could roll out not by the end of the year. >> will you be wrapping up n

in the summer of 2017, oewd invested funds to conduct an naa , called a neighborhood activation asset process. the probable outcome for the public buildings as an r.f.p. for the site. to prepare for the anticipated r.f.p., we hired architecture partners and race $45,000 for predevelopment costs and began the design of these schematics. data from our online community survey, with over 250,000 responses plus public outreach meetings drove programming plans to best serve a growing population and neighborhood -- in a neighborhood undergoing massive change. the population is on track to triple by 2020 and triple again to over 18,000 people by 2030. the idea of a community center is not just to save these buildings but it is equally fuelled by the fact that the dogpatch has not one public serving facility despite nonstop development. as part of the n.a.a. process, sfpd was contacted about the buildings. in march of 2018, chief scott sent a letter to the city stating the police were considering use for the station. this was a conclusion of the n.a.a. process. on may 1st, 2018, the friends of

this as a learning experience, but respectfully to the development community and more particularly to oewd, don't leave that much stuff on the table. bring us a deal -- 'cause i don't like sitting in my office and hearing this is the maximum feasible thing. you've got to take it over leave it, and over the course of two weeks, the developer comes in and says yeah, we can bring it down from an average of 110 to have a lower ceiling on affordability, and yes, we can pay the higher in lieu fee, and we can phase the project so you get the affordable housing when you're supposed to get affordable housing so -- pardon my language -- so you don't get screwed in the end. let's have this to the board of supervisors doesn't have the role what additional benefits the project can actually sustain, so that's what i wanted to say. >> president cohen: thank you for those general comments. i'd like to circulate the amendments at this time. i believe the city attorney has them to be circulated so that we are all on the same page. and as these amendments are being circulated, i'm going to pivot to ann topia

i believe we have oewd also carline grobe. >> good afternoon, supervisors. again, project manager at office the economic and workforce development. as shared by the supervisor tang, i believe she's staffing the mayor so she won't join us for this hearing. the item before you today is an ordinance introduced by mayor breed to amend the housing ordinance, section 415.3b of the planning code. the ordinance modifies the date by which a grandfathered project must obtain a site in order to include the rates. as you may know, in june of 2016, voters passed prop c, which allowed the city to increase rates on private development. the board of supervisors amended ordinance for application prior to january 12th of 2016, to grant fathegrandfather their rae them until december 7th of 2018 to secure their site permit. the biggest issue with that is that not all-pro jets wer all pd at the same time. creating a ability to reach this key milestone. while many projects grandfathered have been able to secure their site permit, there's still 34 projects that have yet to secure
