that same day, trump called de oliveira and told de oliveira that trump would get de oliveira an attorney. joining me now is devlin barrett who covers the fbi in justice department for the washington post. a lot of us have been focused on washington d.c., obviously things have been happening with that grand jury in florida. what has changed in the intervening weeks to result in this new superseding indictment as far as the doj is concerned? >> i think what you are seeing here is the culmination of issues we've reported about before and have finally come to a head. specifically, what was ken dilanian -- carlos de oliveira's role in this. there is legal strategy here as well because remember, wealth not his lawyer signaled he wanted to get out of the case with trump. he wants a separate trial. but what this new indictment does is that it ties wealth not at much closely to trump. and it creates an allegation that not it is essentially going on a secret mission for the former president. i think that dynamic will serve among other things, under cut any efforts by it will not add to get out of

de oliveira's attorney was not loyal to mr. de oliveira and in fact loyal to trump. we have no reason to believe that's the case. john irving is a well-respected lawyer. i know him personally. that is the fear, right? we've seen in the past, for example, when cassidy hutchinson was represented, being paid for by the trump organization, she was much more reluctant to speak with the house select committee. when she got other counsel, she then began to be cooperative. i think the concern here, frankly, and this would not be an issue of legal ethics. this would just be a feeling of coercion that mr. de oliveira may feel. he may himself feel loyalty to mr. trump because he's worked for him for decades, as i understand it. that has been his source of income. he's been elevated within mar-a-lago. so he may want to cooperate for those reasons. that's not a legal ethical conflict. and it remain to be seen if there is. >> i'm wondering how that conversation goes. if the attorney being paid for by the former president of the united states, and this defense fund find it is in th

de oliveira, and again, potentially mr. taveras, were deeply engaged in trying to hide these documents. so it's one of the explanations for certainly why we're just getting the superseding indictment now. and it's also not a surprise then that we're seeing this very explicit nature of this statement about donald trump paying the legal fees for people who otherwise might have a lot more incentive to flip if they were hanging out there by himself, themselves. it's the way of his pac to provide incentive for them not to do that. i would argue that's perhaps not in the best personal interests, given the evidence that suggests that we're going to see. nonetheless, that seems to also be something that leans in favor of trying to put more pressure on them to do what might be in their best legal interests. >> buying people's silence is definitively, i think, a trump m.o., one we've seen before. we have a superseding indictment filed. what can we expect during de oliveira's arraignment on monday? >> he'll plead not guilty, he'll hav

a lawyer for de oliveira, declined to comment. he's facing his third indictment as a former president. the result is them trying to throw over the very government he was presiding over. we are waiting from the d.c. grand jury. just today, down the street, two of trump's lawyers met with special councils in jack smith's office. it was at that meeting that donald trump's lawyers were to expect an indictment against the claimant. this is according to two sources near the nomination. smith, was present towards the meeting. as was according to sources familiar with the matter. nbc news has not confirmed with that. that is the last step before any potential indictment would come down. a chance for donald trump's lawyers to make one more attempt at convincing prosecutors not to bring charges. neither donald trump or his lawyers are speaking out about what is happening. that did not stop donald trump from providing his take. cotton meetings are not productive. they didn't give any indication of what was pending during the indictment. law

and what do we know about the charges that are up against de oliveira?these are pretty serious charges, sara, all relating to allegations that de oliveira was part of the plot to erase this security camera footage of which showing the boxes of documents at mar-a-lago, and some of them found to be classified. part of it is obstructing justice and making false statements and concealing or destroying evidence. part of it is that he did tell an i.t. worker at mar-a-lago that the boss wants rv deleted and aly asked the i.t. worker how long the v footage would stay on the server, and so these are part of the allegations against him. and we know that at center of the allegations which include de oliveira and the former president is the i.t. worker known as employee number four whose name we have learned is usyuscil taveras. and these charges are stemming from what taveras has told investigators and the fbi. we know that he has not been charged with anything, but that the person that de oliveira has met in the audio closet to discuss the security footage, sara.

there are a number of, tax not only between nauta and de oliveira, but between de oliveira and others, reflecting the fact that they got some helpful evidence from de oliveira's phone, they might have gotten some helpful evidence from de oliveira himself, there's an allegation, for example, that at one point in the narrative, trump calls de oliveira after ensuring that he is going to be loyal through another employee. and offers him counsel and, indeed, secures council for de oliveira from john irving. who is someone also under stood to be a representative of multiple others in the trump universe. i do think there are hopes that were high, ultimately they felt they had no choice after he lied to them and resisted their treaties. and to indict, them to see where the trips of. all but nauta we, de oliveira may have made the calculus that he can wait and see how long the case is gonna go on with the hopes that trump will be president again, and can either pardon him and or stop this criminal matter from going forward. >> and, scott this is exactly the conversation you and i had. in washi

do you think de oliveira simply couldn't find legal counsel? is it more part of a legal strategy to delay the trial whether it works or not? what do you think is going on here? >> chris, this is the second defendant we've seen in this case use precisely the same tactic, i can't find a local lawyer. america is getting this wonderful education in the federal legal process. i don't view to have a lawyer barred in the southern district of florida. people are sometimes indicted and do have to find a local lawyer. but both of these defendants, de oliveira and walt nauta, they're residents in this judicial district. they have lawyers from washington, d.c. that's not the situation that you normally see with people who reside in the district where the court is located. they have better access to local lawyers. so with the repetition of this, it does begin to look maybe less like a strategy and more like a tactic because we know trump's legal team's tactic is delay. there is no factual defense that trump has offered to these charges. he's acknowledged he

carlos de oliveira as we said is his name and he is the property manager at mar-a-lago.e was previously a valet there. we know that he's 56 years old and he's now accused of helping move boxes of documents after the justice department first subpoenaed the former president, this happened in may of last year. de oliveira spoke with the fbi earlier this year in january and that's when investigators say he lied about helping or knowing about moving the boxes. well, he has now been charged with conspiracy to obstruct justice, destroying or concealing a document, record or other object, and making false statements. now, we should say that cnn has reached out to his lawyer, john irving. we have not heard back, but irving is among the lawyers whose firm received nearly $200,000 in payments for legal services from donald trump's save america pact. de oliveira is scheduled to be arraigned in federal court in miami and that is expected to happen this monday. >> so many more things to watch. >> we will be watching that. okay. with us now former federal prosecutors renato marriiotti

de oliveira knew this was criminal and took steps to promote it. it looks like employee four was asked to do this crime, to wipe out the surveillance video, and. so, employee four will be a crucial government witness, but it looks like he's an ideal witness for the government because he actually separated himself from the criminal conduct, and that's why he's not charged. >> i've heard different perspectives on whether or not this delays the start of the trial. where do you stand? >> i think it will. when you supersede as a prosecutor, it's a powerful tool. you get to add new people and charges. the downside of that you have to understand is you are opening the door for the defense to go to the judge and say, hey, there's new stakes here, there's new charges. if you're donald trump, you say three new charges. if i'm convicted of any of them, i'm going to prison, i'm entitled to more time to prepare. next time they're in front of the judge, that motion will be made. there's a basis for the judge to move the trial back more. >>> up next, new details

you've been looking into de oliveira, and what have you found? >> reporter: well, fred, we found that he really was not on the radar of anyone that cnn spoke with, and that includes eight current and former trump allies and aides who frequented mar-a-lago. the indictment calls him a property manager but the picture we're getting from folks that cnn has spoken with is really this low-level maintenance worker who did odd jobs around mar-a-lago. he didn't interact with club members, he wasn't part of trump's inner circle, he wasn't privy to high-level conversations until the special counsel investigation. we've also learned that he was at mar-a-lago working there for about 20 years, he started as a valet, then he worked his way up doing various maintenance jobs before becoming the property manager. but certainly, fred, it does look as though he was really pulled into this scheme, this alleged scheme to clean tup dirty work and get rid of all of this security camera footage before the grand jury and the prosecution and the special counsel could get t
