the term paddy is one of those negative ethnic slurs that was invented for the irish over a century ago. the paddywagon was named that because of it was named at a time when the primary criminal population of the north eastern cities of america were the immigrant irish. so those wagons were very frequently filled with irish passengers on the way to police stations. what changed in that population over a 50 70-year period was they changed from being the people policed so the people doing the policing. they were the first wave of community policing in america. and i've mentioned this once before in the program. when the first irish police officer was hired in the city of boston, there was a major protest by officials there saying that it was a conflict of interest to have an irish person in law enforcement because they're just criminals. that's how far we've come on the notion of community policing in america. it's a long-winded way of going to you with your experience in your practice in baltimore, could you take a wider view and tell us what you think the value of more community-oriente

this situation, they may be met with the blue wall of silence if there are six officers inside the paddyd and what didn't it's going to be a difficult task for the state's attorney's office to figure out who did what to whom. this is not a who done it. this is a situation where we all learn the second day of law school in torts, that fancy legal term the thing speaks for itself. once that prisoner is in your custody, you have an absolute right to ensure that prisoner's well being unless your conduct is justified is a matter of state law. >> well right, the question about the fact pattern we see from what we do know in the video, he does seem to be in pain making sounds as he's put in there. one argument might be was he somehow hurt prior to this interaction. did they come upon him and he already sustained an injury or was it exacerbated in the process? that would be the main defense, factually for these officers. if they are not speaking that is a problem for law enforcement and one to be investigated. what i want to ask you broadening out from this case is the investigation continues, w

we have an individual arrested thrown into the back of the paddy wagon and their hand behind their back and they get a rough ride. they're unbelted. the inside of these wagons are not padded. they can't protect themselves and they get thrown from one side to the other usually landing on their head and fracturing their neck. >> reporter: alston died after his injuries. on the street in baltimore this man had an account of his rough ride handcuffed unable to brace himself banged around in the caged rear of a police van. >> i guess that's your punishment. >> reporter: have they ever put a seatbelt on you? >> no. >> reporter: and this woman, 27-year-old christineable got is suing -- christineable got is suing the police department claiming she was the victim of an intentional rough ride in 2012, photos showing the bruises she claimed to have endured. baltimore has a policy of seatbelting all prisoners, but a union representative said freddie gray was not secured. so much of the attention in this freddie gray case is now focused on this so-called rough ride history. was he intentionally bang

because freddie gray isn't here to tell his story and there were no cameras in the back of that paddyzblel, not necessarily, poppy. and i'm not sure this is a case of a rough ride. he doesn't have a concussion. he has a crushed vocal box and a spinal cord injury that killed him. and i think one of the very critical moments in this case is going to be what happened at 8:46 a.m.? because remember you have the initial stop you have the chase, you then have the afsrrest. we see the video of that arrest where he's being dragged into the van. the police say he was speaking at that point in time but calling for medical attention. however, almost four minutes later, the van is stopped and he is pulled out of that van. he is put in leg shackles. and there are several witnesses that are speaking to the press that say they witnessed him being beaten with batons at that second stop poppy. so you know it goes more beyond a rough ride. there were several stops, second one where he was taken out and actually handled and so i think there's more video to come. there's certainly a lot more eyewitnesss
