jessica schneider, cnn, palm beach, florida. >> chaos and confusion. well, alan dershowitz is a professor ee mer tuesday at harvard law school, joining us via skype in miami beach, florida. always good to see you and get your expertise on this. how do you think this case will be argued, this appeal? how likely successful, the trump administration? >> there are 29 judges on the ninth circuit and three gets elected to hear a case. so we've playing judicial roulette. the court has some of the most liberal and most conservative judges and it depends on who is drawn in the wheel. the argument the government will make will be that these states don't have standing to object to the president's executive order, that the president's executive order is constitutional, and the president has authorized to make the kinds of judgment he made, and it is impossible to predict what the outcome will be. my own judgment is that part of the president's executive order is constitutional, part of it is unconstitutional. what is required is a calibrated nuanced approach to it.
