rory cooper happens to be pat mccrory's democratic challenger for governor in november and polls showahead, one recent poll had him up by 10. that does look like trouble, governor mccrory. joining us is jim morrell, political reporter for "the charlotte observer," nice to see you, thanks for being here tonight. >> thank you, rachel. >> we heard late tonight that pat mccrory said he and legislative leaders will respond in some way to the justice department by monday. do you have any idea what that response might be? >> you know, i think i know what it won't be. i don't think they're going to repeal the law or change it in any major way. you know, i was at the press conference this afternoon with he felt like the justice department was bullying the state. i don't think that attitude is going to change a lot. they may make a legal response, i don't think it will be what the justice department necessarily wants. something that is hyperbole. it sounds like the university is caught between the federal and the state governments here. >> you are right. they are between a rock and a hard place

that's pat mccrory the governor of north carolina. positioning in this a different way than feds. t the feds made it clear this is a violation of the constitution. all people have equal protection under the law. specifically the supreme court has ruled on this matter. specifically according to the feds the law that's been put into place in north carolina is discriminatory. it's discriminatory in the same way jim crow laws were discriminatory. it's discriminatory against transgender people in the same way that jim crow laws were discriminatory against black people and there's a long history of this. the feds see this as no different in any way and that's the case they will make today. but getting ahead of them was this north carolina lawsuit which is being threatened at least by the state of north carolina. whether that might be having any legal standing is another matter and one for another day but today we'll hear from loretta lynch about what the fed's plan is against the state of north carolina. remember the state of mississippi ha
