pat toomey telling me earlier that a lot of his republican colleagues are indeed rethinking some otherno votes on gun-control legislation and the like. judge andrew napolitano says a lot of those proposed laws won't hold up the constitutional muster. he joins us. george, what do what do you me? >> good afternoon. it's always a pleasure to be with you. the proposal that the president offered the other day is called a red flag law. that's a law by which the federal government would pay the states to change their state laws so that anybody who wants to raise a red flag -- my next-door neighbor is a little crazy but he has a gum and i think -- has a gun and i think you should take it away, it can cause the gun owner to be dragged into court and in some states the gun is taken away before the hearing and the hearing decides whether or not the gun owner might abuse it in the future. that's the serious constitutional problem. in this country and it's been this way for 230 years, the presumption of innocence on the due process requirements mean you can only be punished for something you've don
